According to CJI , the art 370 says its can be modified which itself indicates the abrogation is constitutional and hence there is no need of referendum
Not only modified but it was also a temporary law and not permanent
@@Dark_Universebut technically by process wise it became permanent because the only body which could make changes in it was dissolved in 1957 so it automatically became kinda permanent. But in document it's written temporary till this date this is the issue.

If a referendum has to happen then they should first let all kasmiri Hindus return first and the demographic should be restored to what was in 1980s. Let's see if they agree with that.
The referendum is an obsolete option.
Even if we consider it as hypothetical scenario, the referendum won't be possible without annexation of PoK and pulling out of Pakistan military and their people from J&K ( Pok ).

Before abrogation of Article 370 , Article 367 was amended
Article 367 an additional clause, which has four sub-clauses. Sub-clause 4 stipulates that “in provision to clause (3) of Article 370 of this Constitution, the expression ‘Constituent Assembly of the State referred to in clause (2)” shall read “legislative Assembly of the State.” And by the virtue of Article 356, in the case of Presidential Rule in any State, the power of Legislative Assembly vests into the Parliament.

When the central government can change the status of a state without the opinion of the people there, then the question of having an opinion for Jammu does not arise.
