      Agreed. But you have to think about what the jury will think two years down the road when they are reading your complaint. If it looks like the victim is being the aggressor (even if they are not), the jury will not want to rule in the victims favor. Juries are biased and you want to stack the deck as far in your favor as possible.

      @@braniganrobertsonlaw Exactly. The victim must think ahead, in context of how it would appear to the jury, not merely from their own POV. To them, if the victim doesn't complain politely, if the victim seems too aggressive in their complaint, the jury might think it's possible, and/or even probable, that the individual overreacted, and/or even is trying to set up an innocent person. That has happened too, and still does. Sexual harassment is very, very serious, and must always be taken very very seriously, that's a given. But it is just as vital not to jump to conclusions, and/or inadvertently accuse an innocent person. That would be just as wrong. That is unfortunately true. No jury is 100% unbiased and/or objective.

      @Ruby Ramirez In the context of employment law, no. The statute of limitations would likely be expired if we're talking many years down the road. However, there are some laws (not employment) where minors can sue for sexual abuse decades later. But you'll have to consult with a lawyer who knows more about that area of law.

    I have a strict, personal policy that I apply to myself:- when I'm at work, I only talk about work matters with everyone. This way, there's no argument, no grey areas, etc.
    People aren't afraid or threatened by me, and enjoy my presence. Same at the club or church:- I never ask women personal questions or make them feel intimidated in any way. All these places belong to everyone, and everyone should feel safe.

      I agree. I am just now starting to understand that. What I can perceive as being friendly or cordial to my colleagues. It can be interpreted as being flirtatious or too friendly.

      If a man looks at, smiles at, scratches his head in front of, etc. a woman who doesn't like him, she can file a complaint. Don't believe me? Staring is grounds for sexual harassment. What's staring? Looking at the witch one second longer than she judges crosses the line? Remember the defense against staring: You were staring at the wall behind her, not her ugly puss (slang for face)

      It's the opposite for me. People don't like me at work because I'm the only one who isn't super friendly & doesn't hang out with anyone afterwards. I've always had a personal policy to never be friends with people at work. I keep my work & personal life separate.

    My manager has definitely crossed the line in my own opinion but this gave me a peace of mind in knowing that that Language doesn’t belong in the workplace and that I should complain and that I have rights after I do complain. You’re helping me sleep tonight, thank you

    I've experienced this in the past, long before there was an awareness of such things. And most of the workplaces I used to work in had a lot of talk of a sexual nature which a lot of people seemed to think was perfectly fine. And then the rumours spread of my own sexual nature, the gossip, the laughter and the verbal abuse. And hell, my home town got to know of it. It is utterly humiliating to be a target of this behaviour. And people think its funny. Today, I actively avoid all people like that, all workplaces like that and even ask in interviews what kind of behaviour goes on in the workplace.

      You get smart as you get older. When you work in a workplace and already observe married people getting it on with cheap women at the workplace then you already know there is no way you will ever have any kind of normalcy in such a workplace. Where employees and managers openly sexually harass you based on what they are used to do to cheap women at work: well, then you know there is no way you will have any kind of normal relationship with them.
      When freaks start to chase you and openly show they harass you within the same gender: well, you know it would be a joke to try and turn them in. Because you know you are in company that is used to cheap behavior and there is no way you would get anywhere with a complaint.

    This video definitely solidified everything I have experienced at the Mayfield, KY Purchase Area Development District. I was sitting there with my mouth hanging open when you said a couple of things. My boss and his secretary are an item, he promoted her, took my job duties/potential salary away, and they both harassed me continually. Its so gross. He's like 100 years old, they are both married, and stay shacked up in his office. She blocked me in the egress of the doorway. I have reported these things continually, taken them to our Board Chair, and nothing has been done to rectify the situation. They withhold information from me and truly create a hostile work environment.

      Today's world you can't even handshake Pat someone on the back or give Them a hug when they seem to feel down are you trust Are you think they're nice to be able to do that it's not sexual where I come from it's all about how you're cool our trust I care our you're awesome but The media and socialism and the far left and liberal lifestyle has made everything sounds so terrible against those that are not doing anything to be sexual And a lot of people use these tactics to harass the people they're saying are harassing them

    This was an excellent find at a bad time.
    I work in a huge corporation in Los Angeles and recently one of my male coworkers was sexually assaulted(a manager exposed his genitals to him and asked if he liked what he saw) in a bathroom here.
    My coworker immediately reported it to our HR department and nothing was done. HR informed them they can’t do nothing because there is no evidence of the conduct and they took absolutely no record of it. My coworker kept his records and texts between his manager.
    Can he still file a police report against this manager? This makes me feel incredibly uncomfortable that there is a sex abuser at my job and has not even been reprimanded

      He can file a police report. But my guess is if a lot of time has gone by since the incident it’s highly unlikely they will do anything. I recommend that he watch the 4 part series i made on “How to Document Bad Behavior at Work”. If it happens again or if he gets fired in retaliation, he should reach out to a lawyer.

      If the behavior happens one time, he is a sexual assaulter, if it happens multiple times, he is an abuser.

      @@braniganrobertsonlaw "Supervisors" need to be held accountable if nothing is done..regardless of how much time is passed. People are afraid of reporting because..nine times out of ten...they're the ones who ends up without a job and/or are harassed even more.

    I coped sexual abuse and harassment over and over again with in the Catholic Church from male married parishioners and the Parrish priest who asked me out on a date. When I contacted the diocese I was shuffled from one department to the next. Nothing was done about the unwanted attention from the priest even when I drafted a full report documenting what I went through over a ten year period. Even when this priest left the parish and retired the abuse continued. It got so toxic that I had to stop attending Catholic Mass. Because of the stress it caused me I have now being diagnosed with post traumatic stress disorder and I have lost enjoyment of life. I was violated, disrespected and I was stripped of my dignity. I have since given up my faith and I don’t want anything to do with the Catholic Church anymore.

    I am a loader at UPS and I am currently going through this with my part time supervisor. He is constantly staring at my body parts, I can feel it and it makes me extremely uncomfortable and I’m scared. I told my full time supervisor yesterday and he denied it, and did nothing! He told me I need to seek counseling for my emotions bcuz they’re clouding my judgment.

    I just contacted ur firm as you are local to me. Extremely professional thus far! Good location in the biz district! I do have a question though. U said the employer must have known about the sexual harrassment. If the person conmitting harrassment to me is a male manager of the company, does that count as the company having known about it? I never told HR or the Owner due to fear of retailition.

      The manager also lied to me and made me believe he is a part owner of the company too, which was not true. They are a large company but had no HR.

      Complain to another supervisor or manager. Carbon copy human resources. Be sure to include your personal email outside of work as one of the recipients. I say this because that way you will have access to the conversation from your personal phone or computer if the company fires you or you quit. If you did not do this part then if you get fired or quit you will no longer be able to access the emails because you will no longer have access to your work email account. Be sure to be professional and include specific examples of the harassment, the date and time when the harassment happened, and where the harassment happened. Include that names of any witnesses to the harassment. If there are witnesses this will help you out a lot. Include a line that says something like "I will be saving a copy of this email for my lawyer in case legal action becomes necessary". If all of this is done properly you will be amazed how fast upper management, human resources, and lawyers will work together to make sure your situation is resolved professionally and legally in most companies. If they know that there are witnesses and that you are keeping records in case a lawyer becomes necessary the last thing the company wants at that point is for you to call a lawyer so they will do almost anything possible to fix the situation.

    Thank you for the video! I learned a lot, but I have one question. Towards the end, 9:34, you say that if an investigation comes back and it turns out there's merit to what the employee is saying HR should go to legal console and hire a defense lawyer. What are the next steps, or series of events that will happen after that? Like, what will the defense lawyer do, or what is the purpose of hiring one, how could I defend my decision for wanting to hire one to management? Will they be the ones to decide on the severity of the punishment for the accused? Is it best to leave those types of decisions to someone else, and not just higher up management? As someone who's going for HR in school right now, I'm looking for information on how best to handle these types of situations from start to finish. Thanks in advance!

      It completely depends on the situation. There is not a cut and dry formula in employment law.

    Hi. Wondering if the constant nagging from my employer to put gender pronouns and self-ID as to whether I’m transgender or not constitutes as sexual harassment or a hostile work environment. The requests have remained optional thus far.

      Omg !!! Is this a coincidence?? Your name is exactly like mine . I just went through sexual assault by my boss !! He’s a Chiropractor and he’s always said weird comments every now and then and I always tried to ignore them , he’s hugged me without my consent !! The last straw was this past week when he gave me a 500$ bonus and I was Thankful , he then proceeded to ask for a kiss on the cheek!! I was hesitant and he kept insisting, I felt a bit obligated so I said okay ? I went in and he turned around really fast and kissed me on the lips !!!😫🤮🤢 so traumatizing . My coworker saw everything and I’m so thankful she’s my witness .

    What if you're being accused of sexual harassment and the victim STATED to management that they were not offended?! All I did was ask her what her keychain meant. I asked a question and was accused of sexual harassment and harassed into quitting.

      Yes, I was accused by my asshole boss who wasn't even around when I asked the question. His best friend overheard me talking about it and reported everything to him. 🙄 He wanted me out of there so he made a big deal out of it and turned everyone against me. I was forced into a corner and quit. I know I shouldn't have quit. He couldn't fire me for what he had. It sucks. I think about it all the damn time.

    The Asst Manager (female) constantly makes sexual references and inappropriate comments with the manager (male) and myself. My manager laughs and feeds into the comments. I have told her that the comments are inappropriate and unprofessional. She continues to make the comments and ignore my repeated requests to stop. Any suggestions on what to do next?

    Ok so what if someone has done all of them. They've done the verbal, physical, and visual. Over months and it's consistent even when you ask them to stop. And then I talked to my manager and now the employee is giving me the silent treatment. I've documented all the things he's said/done and taken screenshots of problematic text messages.

    Back when I was young and starting out, there was a rule that the victim if sexual harassment had to inform the perp that they should STOP before they could file a complaint. Also, even then, dating or trying to date co-workers was frequently equated with sexual harassment.
    Today, in spite of what lawyers tell us (trying to get more clients?), the apparent definition if definition of sexual harassment is "anything a man say to a woman or that she overhears and doesn't like." It doesn't seem to matter if its sexual in nature or not. "Nice dress" doesn't sound sexual to me, but men have gotten into trouble for saying it. Same with off color jokes two guys are telling when a woman walks by.
    So, the KEY to avoiding these problems is to NEVER talk to a woman for ANY reason except the most dire emergencies (for you, not hero- if she's about walk into traffic or her hair is on fire, don't bother). If you work with one or more women, I'd recommend getting a new job, something women don't do, like automech or forestry.
    If you're out walking, wear earphones and if you see a woman approaching either cross the street or go around the block to avoid her. Don't make eye contact.

    Yesterday I mentioned I was thirsty after finishing up our training and my coworker asked me if I have heard of a golden shower and when i said no, as i was shocked and uncomfortable he proceeded to tell me he would show me. I'm a female firefighter age 30 and he is a male firefighter age 65. It's been ongoing for a year with comments like this. Reported him today.

    If a man says, would you like to help me to push that, and cups his hands 6 inches from my breasts, as if thats how he intends the offer to be taken? I reported it to a supervisor today and they walked over and witnessed me telling him, when you did this (cupped hands toward my breasts while making an inappropriate inuendo), I never wanted it to happen again; I felt disrespected and it is unprofessional and inappropriate... you would never do that to "supervisor/manager/etc...". The male employee first apologized and so I thanked him. Unfortunately he had an afterthought and said it wasn't intended the way I took it. 🙁😡. Now I am strongly thinking about putting it on writing.

    I have dealt with unwanted touching and have been offered money for sexual favors by a maintenance supervisor at work. I finally told my supervisor and now the harasser will be terminated tomorrow. I'm scared he is going to retaliate. What should I do?

    I work in an industry similar to entertainment Hollywood where powerful men invite aspiring young women into their conference rooms etc and indirectly they show they are keen to spend the night with her and if she doe not follow their line that leads to severe ignorance and loos of career opportunities . What is this then?’

    So at my particular job we do not have females the work is way too grueling and hard. With that being said we had our first female at the company since 1955 with this the female had to go on a job with me, she confided in me because evidently some home life issues were bothering her she was extremely emotional about her friend and brought it up continuously throughout the three hour long job towards the end as we are getting done with the job she had watery eyes at that point I realize that this friend was more of a love interest come to find out it was a female. And I told her everything would be OK I tried to comfort her through the entire thing and give her the best advice I could. At the end of it I said you’re a very pretty person I would date you. To help her confidence because this female in particular seems that she does not have any self-esteem or confidence in herself. She had also told me that her mother said maybe you can find a man to be with on the job site then she turned around and told me that it sounds like she was my type of girl because she likes cars and that’s when I said what I said. Her cousin which is a male coworker and a good personal friend of mine at my job approached me and told me that I made her Uncomfortable with telling her I would date her. So with knowing this a little bit of information thrown for a loop I was genuinely trying to be nice and help somebody but this is what happens

      That can be bad. I have a female manager that kisses me on the neck everyday. Sometimes it gets in the way of my work. So I tell her very politely maybe later.

    I'll put it this way, where I work, I'm among the youngest workers there most of the employees are at least 5-10 years older then me, I turn 21 in two weeks to put that in perspective, half of my coworkers are Hispanic women and half of them have poor English and I'm not the best with Spanish so I try to keep it basic, I try to avoid going past como estas (how are you) long story short there's a lot of looking, men and women mostly women do the staring, personally a lot of the younger 18-25 women stare at me, then there's the hugging, since I have been there for a while the women stopped saying "Hola Kai como estas" they now say "Hola papi, Hola baby" and I don't think it's too much of a big deal, the most I've said is "Hola mama" to my shift supervisor, she's an elderly Hispanic women but I don't wanna call her grandma or abuela, I just feel like It's my responsibility to draw the line of how far the interactions go between me and these ladies cus I know they won't draw the line, and yes I looked up this video I got nervous

    does a coworker asking if she can take a shower at my place, and doing so in a way where she's about to whisper in my ear until a coworker in front of us asks her to just say it out loud, count as sexual harassment? I think she did it because she noticed me staring at her from behind, but if so I do think there's better ways to address that and I apologized to her a few days later for behaving inappropriately towards her.

      @@braniganrobertsonlaw yeah there's definitely more context behind it but that's something I learned from watching this video. I get the impression from watching your video that compared to other types workplace behavior/acts that can be considered bad/mistakes/troublesome, it's not a clear-cut matter of discipline because it's all about interpersonal communication. Either way that situation is behind me and doesn't really need to be resolved. If I have other questions or I want to follow-up I'll let you know. Thanks so much.

      @@mac1bc I got over it but I'm not working there anymore. But if there's more context, I told my former manager that she told me she hooked up with another co-worker 4 times (right in-front of him), she told me about their relationship before I got hired there later on when I didn't ask for details. I found out later that this other former co-worker didn't get in trouble but she did. And just recently I found out she got fired for taking inventory without marking it out and trying to barter with Dominoes.

      Just don't say anything to them . You see the definition? Unwanted verbal conduct.Even if you say goodmorning with a way she might misenterprent(you might say it sofly and low tone) she will accuse you. Don't even look at them even if they dress half naked. It says unwanted visual conduct. And dont tell me I have to ask her "excuse me can I look at you?" Ok it says of a sexual nature.How the hell does she know that I look at her in a sexual manner and not in disgust,wonder,contempt or whatever?

      It is best not to say things like that. You can't control how the person will interpret it. If you think about it, is it really necessary to even say that? When a woman is not interested, she will have a negative reaction to such comments. At the end of the day, you can't prove how you meant it.

    I remember asking a girl for her instagram and she willingly gave it to me by searching herself via phone. She accepted it and I DMed her. It was office banter and I said something about a post of hers, not in a sexual nature. She blocked me and I apologized to her the next day and she told me her boyfriend got jealous.

    My sister said her boss grabbed her around the waist and hes like 70 and then two of my aunts work there and a similar thing happened to them. So one of my aunts got her heartbeat checked by him but he put his hand inside her shirt and under her bra and checked it. Then my other aunt was stopped and got told by the boss and said something then said “then you can get whatever you want” mind you hes around 70-75 and my aunts are in their 30s while my sister is 19 like ew tf. Also he gave a girl “special treatment” bcuz she was pregnant but it was too special yk? I was so disgusted by this but it isnt just men either.

    Ha. Its not fun im in a fight now. Told my boss not to re hire this man who was sending me harrasing messages asking for pics for $. Well long story short. He hired him back. He continued to harrass me as well as 3 more adult women and ended up harrasing 4 minors also.... its way more involved then that but if he just listened to le when I begged him not to he could have saved the pain coming to him now. I dont feel bad..i feel bad it took me 8 yrs to learn what a monster the owner of the place i worked was he wasnt the s.a. person but he protected him over n over n over. Fingers crossed all goes well for me.

    I’m working at a new office… Human Resources makes sexual jokes and I don’t mind it because of the way it was done, and that I wouldn’t be working there forever it was only while I was in training. Now though, I was moved from a calm quite work office after corporate into a loud work place where cheating is talked about as well as what girl is hot or not and n*ppl* piercings and gay jokes and other stuff, a woman calling a man handsome when she has a partner and etc. is very common and this is only my third or fourth day…. Today I was hugged by a maintenance guy and he hurt my neck and I don’t feel the pain as much now after an hour but holy sh*t it hurt for a while after… I’m also very bad at saying know, I’m 23 and don’t know how to yet and it’s because I don’t want to seem as a problem starter especially if I’m going to be stationed here for a while…. Or forever…. Especially bc I’m moving into one of the properties soon. So idk if moving would be available… gah….

    I have imposed pretty much the Pence rule on myself (though I am not a Pence fan by any means). I am a man and I prefer to deal with other men. I can count on one hand how many females I personally deal with. I work in higher ed. I am never alone with a female student in a classroom unless that room has windows. There is no "joking" or anything like that. Just professionalism, as it should be. Female readers may wonder if I am professional, what I am worried about? The answer is that I trust my professionalism but I mistrust yours. And if it ever comes to an HR case, they will believe YOU and not ME. So when you avoid the puddles you don't get wet. Hence the Pence rule. It has been working great!
