- Ruth Herbel moved to Marion, Kansas, as a young woman and has lived there for over 60 years. She raised a family while serving in several state and federal government jobs. But rather than opt for a quiet retirement, Ruth kept working to make her hometown a better place. She was elected to the city council in 2019.
Ruth’s focus on fighting what she saw as corruption brought her into opposition with Marion’s mayor, David Mayfield, and his allies, who tried at least four times to have Ruth removed from office.
In August 2023, the small-town conflict in Marion exploded, making headlines around the world.
The Marion County Record has been published continuously since 1869 and, like Ruth, it often came into conflict with the mayor. Both Ruth and the newspaper received information that a local restaurant owner close to the mayor had a DUI conviction that could have prevented her from getting a liquor license. In a contentious city council meeting, Ruth and the newspaper were accused of improperly accessing the restaurant owner’s driving record.
The mayor and his recently appointed police chief, Gideon Cody, saw a chance to punish their political opponents. The police chief drew up warrants that hid the fact that he knew that neither the newspaper nor Ruth had accessed any government databases improperly, but nevertheless alleged charges of identity theft. They shopped for a judge who would sign that warrant and found one nearly an hour outside the county. The chief and his deputies were soon pounding on doors and collecting cell phones and computers.
One of the warrants was served at the home of Joan Meyer, the 98-year-old co-owner of the Marion County Record. Meyer died the day after the raid as a result of an stress-induced heart attack. The police also showed up at Ruth’s door, traumatizing her husband, who suffers from dementia. They seized her cell phone, which was her only phone and had all her family and medical contacts on it
The outcry over the raid of the newspaper and Meyer’s death turned the tables on the mayor and police chief. The county attorney withdrew the search warrants and, while the police continued to draw up a warrant to arrest Ruth, they never went through with it. Under the cloud of the abusive raids, the mayor left office and the chief resigned.
The retaliation Ruth faced for her political opposition is a grave violation of the First Amendment. Ruth is suing with the Institute for Justice to hold the mayor, the police chief, and the city accountable. Her lawsuit is about sending a clear message that government officials cannot use criminal investigations to silence their critics and protect their friends..

The judge should be investigated, but judges have almost absolute immunity when acting as judges. Being thrown off the bench is the worst that can be done to a bad judge.

Almost is the key word. But it can and has been overcome. And a judge signing a warrant they have no jurisdiction to be signing would overcome that. There is no plausible argument that they believed they were acting within their authority in their official capacity as a judge.

The affidavit for the warrant would need to be looked at. Police lie on those stating that they have PC when they don't.
The judge who signed the warrant should be barred from practicing law.
He should be jailed for treason, they take oaths to the constitution, to violate the Constitution under the color of authority and violate American rights is treason. This destroys the country. Justice and rights are a foundation. To destroy those is treason.
She's had 2 DUIs that she was able to hide, with the help of this police chief! They were in two different counties, but very close together in time!

If the judge is an hour outside of the county, why do they have the jurisdiction to sign the warrant at all?
This is an example of qualified immunity abuse.
The only people time that qualified immunity should be is for LEOs in the field who are breaking in to save a life and do not have a warrant. Even then challenge should be able to be made. If the evidence is not compelling, qualified immunity disallowed.

I'd wager many judges commit highly crooked or criminal acts every day. They know that unless the wrong person or too many people find out, they're in the clear. Its gross, but common I'm sure. Judges can always be sued, charged by the DA and removed (which rarely happens to my knowledge, but can), or voted out next cycle, unfortunately ost people will never know of their misconduct unless it's reported on.
I get so depressed of how corrupt American government has become at all levels.

Because of what they did and how they did it, Marion County should be sued out of existence! They had NO RIGHT to do what they did and I bet they knew it before they did it!
They thought that as it’s a small town in the middle of nowhere in Kansas, no one would pay any attention and they could get away with anything they wanted.
They did get away with it. Everybody knows about it and they still have no consequences. The only ones to be punished were their victims and the tax payers. The system's completely broken.
The county didn't do this. Corrupt individuals, using the county as a weapon, did it. Serve justice against those individuals, not against the offices that were criminally misused.

The KBI is still investigating both the search and the original mail theft investigation that triggered the raids. Truth is that the KBI is having to wade through both side's BS stories to get to the real truth, which isn't going to put either side in a favorable light. In any other city in America this would be an equivalent to 2 separate factions of Karens fighting for control of an HOA board.

If they had a warrant, it's a "legal raid". But somebody should be punished for signing off on the warrant with no valid probable cause to believe a crime had been committed. Unless, of course, the person applying for the warrant committed perjury, which seems entirely possible in this case.

No, Judges have absolute immunity. The mayor and police chief on the other hand only get qualified immunity that is much easier to punch through since they violated clearly established law set by Supreme Court precidence.

I hope Ruth and her husband make a full recovery after such a traumatic incident. Nothing infuriates me more than injustice, so I'm happy to hear the Institute for Justice is helping Ruth with the injustice she experienced. I've unfortunately known many criminals and can pick them out of a group, but Ruth isn't one of them.

If you think this doesn't happen in your town to some extent you are mistaken. In many cases they are all in this together, I don't mean as a conspiracy I mean it's in their best interest to cooperate with one another when you're talking about the mayor and the chief of police or sheriffs department. I live in Westmoreland county Pennsylvania and I can assure you that the former district attorney who was voted out of office two years ago was in lock step with the Pennsylvania State police and the local police on everything. They would throw a lot of charges against the wall and dismiss many of them because they wanted a plea deal giving them a win in court. Four sheriff deputies and 11 Pennsylvania state troopers showed up at the scene of a mobile home to arrest someone who didn't show up for their parole hearing. They beat him and tased him in the eye in retaliation for what he had done to a police officer a number of years before. There is no end to what some of them will do but don't get the idea that your cops and sheriffs and troopers are good guys because they have their share of bad ones. In the last eight months two Pennsylvania state troopers have been arrested for domestic abuse one can't make bail right now.
This is the power of the press. With out it no one would have known and nothing would have been done.

This is one of the most outrageous government corruption case I’ve ever heard of. I was aware of the newspaper raid but never heard about the council member. Both the major and sheriff deserve a prison sentence and the judge should at an absolute minimum be reprimanded.
Tired of seeing criminal activity shielded by government. Criminals must be held accountable at individual level.
