My father has been selected in dv lottery 2025 , and we filled the form in the last October I was 20 yrs and 6 months old, two weeks before 7th may 2024 (time that names listed) I turned 21 so still im eligible for the visa along with my family?

- Is there a possibility of a child be rejected with the reason of aging out at the interview even after a child's DS-260 form and civil documents are qualified by the NVC?
- If a child delays to seek within one year of visa availability to benefit from CSPA, how or in which step can we know? is it before or after receiving documentarily qualified email? Who will let us know that a child is ineligible under the CSPA?
@may, usually once the interview is scheduled there is a good chance they will get the green card, but you can do the math!
Wow this is such great news.... but hope that they will honor the dates that became available during the last 8 months pandemic when they stopped working as usual .
Lilian....GN all the time. Yes they must honor a CSPA age that is locked in...remember, you must take steps to pursue the visa within a year of availability!!!!

I filled for my sister in 2007. I got her approval in 2010. Her priority date was June 2022. I submitted documents and added her son to the application. He just turned 25. NVC is saying that he is not eligible to immigrate with her because of his age. It took 15 years to process her application. I thought his age based on CSPA should be 10 years old. Who is wrong here, me or NVC?

Yes attend for sure and try to get the green card!! I dont know the category or if there are any opt out issues etc, but it wont hurt to try.

Hi, sir. Amazing content. My grandma (American citizen) filed an I-130 for my dad when I was 15 years old. Yesterday, after almost 14 years, my dad received the Notice of Immigrant Visa Case Creation. In principle, I have aged out, which is why the only beneficiaries shown in his CEAC account are my mon (his wife) and my 14 year old sister, in exclusion of me, who is now 28 years old. I know the CSPA could be applied for me to be included as a beneficiary, but I do not know WHICH STEPS TO TAKE. Which forms to present and when? Can my dad pay the fees for him, my mom and little sister, upload the documentation and make the CSPA request on a later moment?
@manuel, i have done some videos on NVC processing and CSPA...it seems however you might need an attorney to help...it is a bit complicated.

I want to know this what will happen if one used his leaving address as mailing address. And used used another address as leaving address all I'm saying is this on his tax like the W2 at his work has the second address and he file joined with his wife she is a US citizen and they have been leaving in the first address for two years now on the tax returns the leaving address is used as mailing. Hi Khaled...thanks for being a GN sub! No, if the children age out or if they do not pursue the visa within a year of availability, the parent must apply for them separately after the parent gets the green card if the child still qualifies.

Hi sir. Appreciate all your youtube videos. I’m learning alot. Here’s our story my grandma applied for my mother family visa since 1999 when I was 6 years old. But uscis takes too long to process we received a letter back 2009 but from then we never heard anything from them. Me and my brother are 27 and 28 now . Can we still be under CSPA? Even it’s my grandma applied for it.

Hello, my F4 visa has been documentarily qualified at NVC prior to Covid but my eldest a derivative applicant turning 22 this coming March and still we didn't received appointment for interview does this means he is still qualified for a visa. Petition has been approved April 2019. Filed 1997. Thanx a lot.

This is a great question....if your eldest was under 21 when the visa was available, she is what we call following to join...she is locked in to the age under 21.
Same thing happened to my kids dad. Now his mom is scheduled to do interview and medical but she said she'll find out at the Embassy.

hello sir good day. how about we failed to seek to acquire for 1 year? my grandmother filed for my mother under f3 family based petition last 20 years ago. last 2020 we received our welcome letter and we should start uploading files and documents. we were DQ last 2021 but unfortunately my dad didn't tell us that he filed an annulment against my mom and my mom also didn't know. I think my dad paid the judge or court under the table here in the philippines. so that means our category changed from f3 to f1. does that mean we failed to seek to acquire because our visa should be available according to f1 category long time ago?

Please can someone answer this question ? My aunt has filled a i130 for my father and my father and all of us have valid B1/b2 visa . Do they know that I have my name on i130 form even though only my father’s passport number is in the i130 ? Hello! Is application for adjustment of status a separate process or is it automatically applied for when DS260 is submitted?
Adjustment is the process in the US and the DS is the process for consular processing.

Hi Muhammad, you must do the math! You need to wait until the Final Action Date is current and subtract the amount of time the petition took to be adjudicated. You will get a fictional age!

My cspa age was below 21 in Dec 2019 and I got the visa bt due to pandemic my visa got expired nd i was unable to use it.. Unfortunately nw i have exceeded my cspa age. I fall under f4 category. Hi John, yes your CSPA age is indeed well under 21. Here is the key however, you must file and adjustment or consular process within a year or you lose your derivative status!! So before this July 2021...you need to do something!

Hello sir..l am 2022 lottery winners and my interview will be next month. my son turned 21 his name in the 2 letter but when I checked I found 4 number of visas and we are 5 what can I do sir? I applied for the Visa in November 2020
1) Calculate the age of the child on the date when an immigrant visa number becomes “available” or the approval date, whichever is later; and
2) Reduce that number by the days the diversity visa petition has been “pending.”

Hey @kibrom yes he can apply can apply for your mom when he is 21 years old. Then your mom can apply for you if you stay unmarried while she has a green card. If she becomes a citizen, then she can apply for you even if you are married.

Arsalan...I answer your question in this video if you take your time, right down the formula....I don't have enough information here to calculate for you. I don't know how long the petition was pending, but if it was more than a year your age may be under 21. Then you must pursue your visa within one year of the approval of the petition or when it becomes current whichever comes later. This means start either the NVC work or USCIS adjustment of status.

My pending time was 3 years and I am under 21 according to CSPA, and visa bulletin date was november 2019 and I have done all my submission to NVC including( DS-260, affidavit of Support, form I-864, civil documents) on september 2020, thats means I have done all the work of NVC within a year ,

But you are eligible, your age needs to be under 21 when the consulate calculate your age

Where are you? If they filed a separate family petition ok. On the CSPA, you can file a motion to reopen or appeal to Washington DC.

You must still be at the NVC stage. They will ultimately ask you to complete the DS form....this is great news...your name is there!

My Case is F4 and my priority date became current on 2019. I started my case NVC
Completed IV application , paid fee and submit document but on of elder kids name got removed my system after submission.
We contacted the NVC center through email and call but they just said we will add him back but they didn’t and case got delayed???
As the final decision is taken on interview. Is there a way to add him ??????

Hi any update on your case for I'm currently in the same position
If my child is over 21 when my EB2 i140 priority date becomes current, even after subtracting i140 processing time (6 mnths) the child is still over 21. So he cannot apply as derivative in my i485. But when I get the green card, I can apply again for him in f2b category , will he get new priority date , or can he retain my i140 EB2 priority date since he was derivative applicant in that i140 (with his name written as dependent child at that time).
Hey Vijay...thanks for your thoughtful question. Your son will have a new priority date F2b category. He can use your priority date for 245i purposes(if applicable) , but that is about it.
@@GrayLawTV the law should allow him to retain my PD from my i140 since he was also derivative applicant as minor child on that i140 for me by my employer. it is so unjust that he will get a fresh PD on a new f2b petition I will file in future when I get GC. He has done all his schooling from US right from elementary. He is not applicable for 245i since that needs petition filed before Apr2001 which is way too back in past.

No. To be a stepson, the marriage must occur before his 18th birthday. His father(your husband) can sponsor him after he get his green card.
