    Tax evasion is literally organised crime that hurts everyone who isn't rich. It should be regarded in line with other serious organised crime, and those held accountable should be jailed. Zahawi says theres no money for nurses but there's plenty money for him to not pay tax. Real big time criminality.

    Two tier fairness in the HMRC. If we owed a thousand they would get every penny. If you owe 10 million then you can argue how much you will pay. Bloody disgusting. And I thought we ALL had to pay what we OWE.

      If I owed 10 million I would also have a battery of tax accountants and tax lawyers to explore every loophole to make sure I paid the least amount possible, all completely within the law as it stands. Therein lies the problem.

    A couple years back I underpaid tax by about £600 on PAYE (HMRC error not mine). HMRC were very quick to inform me, change my tax code and take back what I owed ! One rule for the working classes and one rule for the rich elite !

      It's easier to see if someone hasn't paid PAYE
      Nadim Zahawi would have paid expensive accountants and lawyers to find complex loopholes including tax havens to avoid tax which would take HMRC a while to trace

      HMRC didn't ask for immediate repayment if they changed your tax code! You paid back the underpayment gradually over the course of the tax year. Seems very fair to me.

      Shouldn't those in charge of where tax money is going be people without negative tax status?
      In the past 3 years we have seen the largest increase in inequality ever in this country. They sent £700 billion to the super rich without putting in place any method to bring it back in.

      @@TheJbsportstechhe does need investigating as to why he hadn’t paid it though. Such a large sum was clearly not a mistake so how did it happen is the next question which the police should now be investigating.

    I submitted a self-assessment to HMRC back around October. They told me that I owed £1.40p. Since then I’ve had 3 phone texts from them reminding me that I had until January 31st to pay arrears or I could face a penalty! Different rules for different people?

    My take away is that there is no evidence of the minister attempting to take reasonable steps to provide a wholly accurate tax statement.
    So, by either direct fraud or incompetence the minister lied to HMRC, and should resign.

    We just need to know why the HMRC thought it was appropriate to give such obvious intentional tax avoidance the benefit of the doubt?
    There is no way anyone else would view this as a careless mistake. They must think we are all fools.
    The mistake he made was purposely trying to avoid paying in the first place.

      It all comes down to evidence. Actually getting evidence to prove that it's been a deliberate act, enough for said evidence to stand up in a court of law, is exceptionally difficult. So even if they know there's wrong doing, if their case isn't strong enough to prove it's deliberate, then all they can do is fall back to the next stage which is careless.

      Careless for HMRC is the language they use for "not an honest mistake". The more capable the tax payer the higher the standard.
      Careless is what they call breaking the rules when you should know better, i.e. lying on your tax returns.
      They don't say illegally avoiding tax, they call it "carelessness".
      They also can't call people out for lying about taxes. So they are obligated to stay silent while Zahawi lied in interviews and in parliament.
      Not saying you shouldn't by angry, just that HMRC are following the rules.
      Crap rules, but followed.
      We need tax reform which doesn't protect the wealthiest from paying their fair share. No chance of that under Sunak.

      @@Sciopticl just to add to your point that in court the burden or onus of proof changes depending on the appealable decision. For tax assessments that burden is with the taxpayer and for penalties it is with HMRC. Based on the balance of probabilities it isn't easy to prove deliberate behaviour even if it seems obvious. The fact a Failure to Take Reasonable Care penalty was 30% highlights there were no reductions for telling, helping or giving, likely meaning evidence towards a deliberate penalty was thin at best.

      Also it's not 'the' HMRC, as that doesn't make any sense in a sentence. It makes sense for other tax authorities like the US' IRS being THE Internal Revenue Service, but THE His Majesty's Revenue & Customs doesn't read right at all.

      @@ZooHeretic That was in 2010, there's pretty much nobody else in charge who was there then. Look at the subsequent scandals and drop in every conceivable metric when it comes to quality of life since. I agree that Labour aren't the best right now but part of the reason for that is that Tories are so poor, they don't have to do anything. I also think they're frightened of the right wing tabloids, although that is sad.
      It was Tories who sold off the trains (Thatcher) and the electricity grid (Major), which finds us in the problems we're currently in.

      @@ZooHeretic What you say is fair too. I'm not some blind supporter of Labour and they've definitely had their fair share of issues over the years. I live in Australia nowadays but I do follow UK politics because I was hoping to eventually move back at some point, but getting less and less keen over the years (not that Australia is perfect).
      It reminds me of something that Russell Brand said, not that I agree with everything he says, but on this point he was right - UK needs a political revolution because voting for the least worst of the options in front of you isn't very inspiring to me.

    In the last two years there have been many ministerial cabinet appointments with the Tory musical chairs circus, and not once did the PM (whoever's turn it was at the time) contact HMRC to check if the ministers tax affairs were in order?? HMRC are saying its not their job to flag anything, even if they hear the lies being spouted publicly by MP's about their tax affairs?? Personally I think if you are an MP your tax affairs should be made transparent to the public, as a matter of trust. If you are not prepared to have your tax affairs public, then you don't become an MP, its as simple as that. I also think MP's tax affairs should be vetted regularly by an oversight department. If an MP doesn't feel this is fair, then they have something to hide from the public and shouldn't be in office. I'm tired of this corruption, and these self-serving greedy shysters.

    In short Parliament can if they choose require potential MPs or Ministers to waive their right to tax privacy. They currently choose not to make such a requirement.
    The 'gaining compliance' relationship with 'tax payers' who pose ' a risk' is a joke.

    So in no uncertain terms of Zahawi had made an honest mistake after diligently filing his taxes he wouldn't have been fined. So the fine was the result of either negligence in paying and reporting, or outright deliberate evasion. There's no IF or BUT, that is the law.

    Zahawi did not make an innocent error. So is not innocent.
    He did not do what a reasonable person would do.
    He is therefore unreasonable.
    By paying the commensurate fine he has accepted his culpability as a not innocent, but unreasonable man.
    This means he was not fit to be Chancellor and is not fit to serve in the Cabinet.

    Interesting. Harra seems to be an incredibly competent, honest and lucid official. His evidence was fluent, coherent, impressive and comprehensive and this testimony certainly helped restore some of my faith in the Civil Service. I'm not suprised he's reached the very top of HMRC.
    Of course, Harra is bound by strict rules of confidentiality and disclosure and his replies to the questions posed were fully answered within the bounds of his own competence. He's a trained lawyer, a very senior and experienced tax expert and highly respected and long serving senior official in HMRC.
    I can't say the same about the Cabinet Office, or those who sit over it, especially the current mob of gangsters.
    I also thought that the questions posed by the Select Committee were balanced, probing, fair and very appropriate to the current situation. Clearly, "carelessness" is not something to be brushed off lightly - it can and did result in a penalty. A very large penalty in the case of Mr Zzzz... Further penalties would be a matter for the courts, and if the current tax laws need strengthening in order to cope with today's unprecedented levels of dishonesty and corruption, then it's up to Parliament to legislate accordingly. Clearly, the current rules on Ministerial disclosure on appointment are too weak to cope with the apparent "carlessness" of MPs these days - the Select Committee appear to have acknowledged that.

    Why are convoluted offshore tax structures not counted as negligence for making someone's tax affairs more opaque and complex leading to "mistakes" being more likely?
    Doing this makes it more likely that the person is "careless" and misses something yet their deliberate obfuscation is being used as plausible deniability.

      Jim is virtually the only HMRC Board member who is a career Tax Inspector.
      He got there cos he is Northern Irish so ticks a convenient box.

    As a novice it seems to me that the HMRC has a two teer set of rules. Pick off the easy targets the small business man or woman and pussy foot around the rich who may be potentially defrauding the system massively. The rich can employ expensive lawyers the poor can't. In the case of a very short lived chancellor I would however give credit where credits due and say well done to HMRC for exposing this careless behaviour.

    Lot of hate in the comments for a professional simply explaining the way they work. There's nothing wrong with anything the HMRC boss said. He wouldn't routinely disclose details of someone's tax affairs publicly, regardless of who they are. That's a good thing. If people want change around people's tax affairs (specifically, re: people in public power) then they should be asking that of the Government. I feel like the HMRC held themselves to a good standard and followed it.

You can hold the same standard to people's healthcare information - do you think everyone should know all of someone's private information regarding their health? What if they're in public office? These standards exist for a reason - so that everyone can be treated equally. Yes, I realise the system falls down because there's a lot of corruption, but that doesn't mean the system itself is intrinsically flawed, just that some people are scum (like Zahawi).

      A will is in general a matter of public record. I would have thought that publishing the tax records of every member of parliament is not too big an ask. It’s not as though any of them are on PAYE and the forms have to be filled in any way.

      Off shore entities and trust funds only exist to avoid tax , corporations make no profit in the UK entity because the offshore entity has weirdly a management and consulting fee that matches the profit . Only employed people pay tax and I think there are legal ways around that one too . A man in his position didn't get there by not fully understanding tax law and how to bypass it , it's more likely that he was advising his accountants on how to do it .

    At last - someone who appears before a select committee who knows their stuff and can answer questions. Well done Jim. On Zahawi he could afford top advice. Either the person advising him is a crook for giving him dodgy advice or Zahawi is a crook for ignoring the advice. From Jim's testimony if Zahawi had been wrongly advised he would not have received the penalty.

      Every Tax Advisor is just one step away from breaking the law, so many people have been caught using schemes and loopholes to avoid paying what's due, to be totally honest I would do the same, if I could avoid giving cash to a government who will waste it, sending it abroad to people who don't want it or hate us, I would love to pay tax and know it was going to fund the services, NHS, travel networks, social care. Things we will use and may rely on one day, not funding scams, furlough cash handouts, dodgy green energy schemes, special payments for PPE we cannot use or has expired.

    There is no way this was a quick case. Investigations (he was found out, not disclosing liability), negotiations and settlements take time. He took up office and swore that his affairs were up to date when clearly they weren't.

    What a 'cop out' by the HMRC chair. Tax affairs may be a private matter, BUT the 'Public Interest' outweighs the principle of 'confidentiality' when suspected wrongdoing is alleged!! The only way to maintain public confidence and transparency, is for full disclosure to be made by HMRC in this context. The truth must be known to all. Failure to do this, only leads to more suspicion, more anger, that the wealthy are protected from wrongdoing. Requiring 'Consent' is simply a barrier to prevent the truth from being exposed. People who have done nothing wrong would happily consent for the avoidance of doubt.

    Remember Sunak’s first speech where he promised to lead his government with integrity, professionalism and
    accountability at every level. What an absolutely disgusting vile joke. There should be complete transparency on MPs earnings and tax affairs,
    instead of that we now live in this shady underworld of shell companies in Gibraltar and using Non Dom status, a philosophy which stems
    from the very top. The Norwegian government government are light years ahead of us in terms of honesty and transparency.

    I worked with 2 people who weren't PAYE like myself and they used an umbrella company (legal loophole). They were hounded by hmrc to pay what they allegedly owed and it certainly wasn't in the millions like the minister in question. They were normal working people who didn't have the means to fight the decision. One paid it and the other didn't.
