What Does the Constitution Say About the Right to Vote?

- You may be shocked to learn that nowhere in the original text of the U.S. Constitution does it say that citizens have a right to vote. Democracy Docket’s Sophie Feldman breaks down the voting rights protections found in the U.S. Constitution, federal law and state constitutions and the Republican effort to curtail these safeguards.

The actual reason that the 26th Amendment even exists is the Vietnam War. Old enough to be drafted @ 18 but not vote @ 18 was not working.
Democracy is a living breathing idea! Changing w the demands of a ever changing society! Bravo America!
I Love being American❤❤
Thank you Sophie and Mark. 💙
Marc and Team,
Thank you for leading the charge to save voting rights, fighting against voter suppression and saving Democracy. 🇺🇸🇺🇸🇺🇸🇺🇸🇺🇸🇺🇸🇺🇸🇺🇸

Thank you for the work you do, Democracy Docket, to help us preserve our precious voting rights.
Thank you Sophie✨🇺🇸✨💙✨💜✨💃✨
Thank you, Marc!
How can they not have the right to sue when the 1st Amendment guarantees Citizens the right "to petition the Government for a redress of greivences."?
That point is lost on the average MAGA knuckle-dragger
Well a combination of woolly wording and a Supreme Court which just makes stuff up, that clause can both mean anything and nothing.
Thank you from Canada 🇨🇦💙💙💙💙💙💙💙💙💙
Yes, 100% ‼️Also from 🇨🇦
Good content, this must be aired on national TV❤
Thank you Marc✨🇺🇸✨💙✨💜✨
Sounds like another Amendment to the US Constitution is needed: the right to vote!
And isn't your post a sad commentary on the state of our freedoms!
It's time to rewrite the constitution. It's almost 250 years old. Time for an update.
Australia has a compulsory voting system that creates very high turnout.
And just to be clear, despite the Australian Electoral Commission stating voting is compulsory, it’s actually just participation which is compulsory. You can still leave your ballot blank or spoil it, you aren’t actually compelled to vote, just turn up. But since you’re there anyway, you may as well vote.
if we did that in America, the republicans would fight it and also claim it was to benefit the Democrats! 😢
I remember when the age to vote was lowered. Young men could be drafted at 18 but could not vote until they were 21.
💙🇺🇸Thank You! 💙💙
Voting is State not Federal Jurisdiction care of the Constitution. That's the actual reason that 4 out of the 5 Amendments that deal with Voting Rights exist, to FORCE every State to comply.
The 5th, the 23rd, only applies to the District of Columbia, it was ratified and the Constitution Amended on March 29th, 1961.
Until that happened, the Citizens of the United States that lived in DC did not have the right to vote for the President / Vice-president.
The saga that clueless people are screaming that we never voted for Kamala Harris, should actually read the Constitution.
Until the 12th Amendment went into effect on the 1804 Elections, we voted for the President, #2 in the results became the Vice-president and there were multiple parties.
We have vote for both for 220 years, the other part of it, is that there is absolutely nothing anywhere within the Constitution regarding nominating a Citizen to run for President. It cannot be a violation of the Constitution if it does not exist in the Constitution.
Whereas Republican primary voters had no idea that Trump would choose an insectoid alien in an Edgar suit as his running mate.
Thank you for providing us with the information we need. I really wish more people would pay attention
C’mon America 💙💜❤️ Register & VOTE Harris Walz ‼️
Thanks for sharing your knowledge!
Thank you for all your efforts to preserve democracy!
Vote blue! Keep the right to vote! 💙
VOTE because we can !! The lengths R's go to suppress the vote shows how powerful our vote is. VOTE VOTE VOTE and then Get $$$ out of politics
I have a wish list. Pass voter rights, stop gerrymandering, no more life time judges, make people in states use
Monies giving for public schools. No more vouchers

Monies, also means money.
As a senior in Florduh, I agree 100% !!!!!!!
@NickHernandez2024 it's a real word. Look it up when in doubt.
10 kids per teacher. Hey I don't have any kids but they'll be working and paying Social Security
A bit of reality regarding the "Equal Protection Under the Laws" clause in the 14th Amendment? It SPECIFICALLY applies to States.
Thank you Marc and team❤
Apparently it says that corrupt politicians can take them away from you anytime they decide they're losing.
As I've said before and will again a long as necessary, that all matters of voting rights and the conduct of elections needs to be addressed in an Voting Rights Amendment to the United States Constitution 🇺🇸.
Agreed. A national holiday too.
We appreciate this explanation on voting. Well said ya'll.
This segment is fire🔥. This information is so vital for a healthy democracy.
Very good information ..alll the more reason to vote out ALL present day republi-cons ..we have this election now, and we must vote bluevto stop their move away from democracy towards dictatorship/authoritarianism/fascism...be the patriot that you claim to be and place your votes for blue candidates to give Harris/Walz the team needed to make these necessary changes to keep us free from tyranny. thank you and keep up the good fight until the republi-con party can once again be called the Republican Party!

How does less government even remotely correlate to dictatorship/authoritarianism/fascism? Sometimes I don't think liberals think before they talk.
@@garretth4082What, less government? Like space force? That is more government! Like voter I'd. requirements, when we already have state Id.s & licences? That is more government! I truly wish you people would actually look at what the commie-red, cap cult wants to do to the country! Revealing Project 2925 to the world is not a political strategy to hurt the republicans! It was simply to get you to look at what they are planning for the country! And it is only 1 step shy of authoritarianism! Think man, think!

Scrap the electoral college!
CONGRATULATIONS!!!!!🍾🎉🎉🎉..I just heard THAT YOU AND YOUR TEAM , are officially on KAMALA & WALZ's legal team to get ahead of the BEAN COUNTERS SUPRESSION ridiculousness! AND YOUR THE QUARTERBACK!!!! Am I correct? .. I hope so.
That would put the future of our Democracy in very good hands, indeed!
Super instructive
It bothers me that it's left to the states to uphold democratic ideals, as if it's not in the interest of the federal government to do so.
Very well stated!!
Thanks, Sophie & Mark, U’re very informative.
GREAT INFO!! Thank you, we needed this! ❤
Great report
I remember watching on TV George Wallace stood in front if the doors, so black children couldn't intergrate into Alabamas sll white schools. President Kennedy sent the National guard to open the doors, & escort the kids in. Can we do the same at our voting sights to protect us to vote?
So sad it's even necessary
Tobpug ir simply, Yes! If you encounter any of those Commie-red, cap wearers blocking your way, don't confront them, contact the police!!!!
3:24 Good? Reps already represent you, you dont need a senator too
💯👍🏾
Also constitution was drank up during slavery
Thank you!!!!😊
Very interesting & informational. Was not aware the Constitution did not haave this in it. The Constitution states, "All men are created equal". It does not say, all White or Black, just all men. Changes/amendments need to be made, to also include Women. Of course, magatpublicans would fight this tooth and nail. VOTE HARRIS/WALZ 🗳 ☑️ 😊
Yes, Thomas is a real credit to his race!
New Jersey’s original state Constitution, pre War of 1812, including women’s right to vote. I had to write a paper on it during my 1st degree in education because my professor for my ethics class thought I didn’t know what I was talking about.
Thanks so much for this. Were the Republicans , at that time ,the ones to do such voting amendments?
This is why we have the option to "amened"!!
Hmmmm. The 14th Amendment, Section 2, states, "But when the right to vote . . . ." Doesn't that acknowledge a right to vote by its plain text?
Hopefully the Democrats will not only win the presidential election on November 5, but also the election for the House of Representatives and the third of the senators. And then everyone will have to work very hard to ensure that all the injustices regarding the elections are eliminated.
But if that happens he country would run smoothly and very well! Then what would the Commie-red, cap cultists have to whine about?
Electoral college needs to be removed and popular vote enacted. Term limits for SCOTUS need to be enacted. The Constitution, those that choose to follow it, need updated to meet today’s standards.
There isn't anything that says how the electoral college should be handled, and at first it was meant to represent the popular vote. Thomas Jefferson was upset that he lost to John Adams and realized that he would have won if he had received all of Virginia's electoral votes. In the next election, he convinced the Virginia electors to do this, and he won. Other states followed suit so their guy would win. We can switch to representation by percentages as Maine and Nebraska do if we choose
Tell me what you think of, Anna Applebaum’s book ( autocracy Inc. ) ?
I think it explains a lot of the problems we are having in our United States country and our United States government!
A very important read to understand!!!
Help us in Texas. It has started with Paxton trying to disenfranchise Hispanic voters with searches for helping people to register to vote
Glad to hear that the Harris campaign has hired Marc. They got "the best".
Seems pretty strange that the party that claims to be "original constitutionalist" wants to change that document 🤪
One of our objections to Vietnam was that we were being sent to die, before we could legally drink a beer, vote, or sign a legally binding contract.

Ulysses S. Grant established ways to make laws and amendments to push back against the other people, I have said we need to do that today. It figures that the oldest leader starts first to use Grant's way of fighting them. Now don't stop, push back with brilliants and the pen, and make them obey the Constitution.
Oh hell. If it wasn't in the original, the ol' Clarence will want to revoke those rights as well.
That document was written over 2 centuries ago that is why amendments was written
There a several things that need to be ratified in our constitution to make our nation the true democracy it claims to be.. The Electoral College needs to be nixed and replaced with the popular vote so that each and every voters vote ACTUALLY COUNTS.. And the right to vote for American citizens must be firmly installed into our constitution permanently without individual states being able to work against that right.
Not a flaw from the perspective of the founding generation. INDIVIDUAL STATES were the ultimate sovereign entities at the time the Constitution was originally ratified in the late 1780s. That was INTENTIONAL then, and was likely the only way a FEDERAL government could have been formed.
EACH STATE determined eligibility to vote in state elections which INCLUDED voting for representatives in the US House of Representatives. Some states (South Carolina foremost) had different property ownership requirements to be eligible to vote for different offices.
That SUCCEEDING GENERATIONS haven't changed that is the fault of those succeeding generations, not the founding generation.
It's in the bill of rights
There is a reason, Founders gave states the opportunity to adapt to different ways of voting. If going back to why vote, who gave the Founders the right to vote in state assemblies. Voting was assumed a fact in the republic definition. This is indirect representation from voters to politicians. Cos, voting was unfair Congress created laws. Voting is implied in Constiution of a republic. Unfortunateky some states did not play fair.
What Does the Constitution Say About the Right to Vote?
Republican Party : "The What? And What?"
We have to expand the Extreme Court, too, (or something), before otherwise they'll just knock out the teeth of the new bills, just like they've done so up to now.
VOTE BLUE ALL DAY LONG AND SAVE DEMOCRACY
The Amendments to the Constitutions gives black men and Women.
That kind of developing legislation occurred world-wide. So now, the general policy in Western democracies is to give the franchise to adult citizens, period. the the USA is notable in that it has a strong group in one of its only two parties that wants to limit the franchise on grounds of race and age and has put those limits into effect. That really does contradict, even negate its oft-repeated claim to be the largest democracy in the world. There you go, Canada 🇨🇦

The right to Vote belongs to All Americans but , by constantly attacking in Voter Suppression the Republican Party does not want the American people to Vote . Freedom for Voting is How We Win Elections !
Trump has outright said via 2025; you will not [have to] vote again! Translation; you will no longer have a say about your government through voting!! Think about that! 💙💙

Voting is as Apple Pies And Chevroles
Biggest is miney in politics!! If only citizens could give not businesses .make all the difference in the world!
I don't think it was a flaw. We're seeing that play out now. We need to overhaul our system. We need basic civil tests.
There are many flaws and oversights in the constitution and poor language in some of the amendments .There are assumptions that are in the constitution also .
VOTE RED UP AND DOWN THE BALLOT❤❤❤❤❤❤VOTE RED UP AND DOWN THE BALLOT❤❤❤❤
Doesn’t the very nature of requiring elections imply the right to vote? It isn’t really a true election if the government can prevent some people from voting.
Tldr, *it can be removed.* Looking at women, specifically. Watch yourselves, vote accordingly.
No Wonder the current scrotious SCOTUS is so confused , they're using that old first draft !!!

IT DOES GIVE ALL LEGAL REGISTERED VOTERS THE RIGHT TO VOTE
Florida is bad at gerrymandering.
I got my voting rights in 1973 only cause they were anticipating sending me to nam rt after my grad from hi school 😮
Gerrymandering would not be a thing if Officials were elected by a simple majority.
That would mean every state legislator and every US Representative were at large (representing a whole state, not a district within a state).
