I recently watched a video where a maternity ward was getting bombed in the middle of women giving birth in syria, a baby was left behind and a doctor passed out, thankfully they're both ok, but basically, i'd like to see her preach about the original constitution being sexist there
There are people in our society who feel anyone who doesn't have the same views as they do, they are the scum of the earth. The reason there are numerous people on a court jury is to hear the different views and to weigh them against what the charges are to hopefully come up with the correct decision.
That's not to say someone's title automatically labels them informed or not, (her other credentials spoke for that already) but rather a subtle way of him reminding us that she's NOT a professor.
I don't think it was meant as an insult, as he said he wanted to address her correctly. She didn't seem offended by it (nor should she, because if you call yourself a professor without being one, you should expect people to ask that question).
We talked about this in our Constitutional Law class and my teacher talked about how both extremes are bad, not interpreting the law in a way that it can be applied now a days and also using the law in a way that it benefits you or your beliefs, which is actually not a normal evolution of the law, but an arbitrary modification! In Mexico we have a lot this problem that the Supreme Court makes an interpretation that changes the meaning of the law and they make it mandatory for all judges, so they are not actually doing their job, but overstepping in the jurisdiction of the legislation. Ben is right, if this woman wants the law to be different, she should change it via the legislation with democracy, not try to get progressive judges to just interpret the law differently
The pet peeve I have is that it's always being referred to a s "democracy" when it's a constitutional republic. So the employees we hire to represent the people, i.e., elected representatives, are not our leaders, they are just hired hands . The dog wags the tail, not the other way around, and we didn't hire the representatives to tell the people what to do, we tell them what we want done. If it was sexist it would’ve said something like, “women are property, they don’t have the right to vote, etc.”. I believe that later on the women’s rights laws were added to clarify that women are also people, because many men did not think that. Again, never in the constitution did it say/imply that women are lesser beings than men. This is an argument about punishing the authors for their beliefs rather than punishing the constitution for what it says. The writers of this document purposefully tried to remove that bias that resides in them in order to create the constitution. Like Charlie Kirk says as he was debating on a similar topic (don’t know if you agree with him, but I do) “tell me what’s wrong with the constitution itself, not the sins of the authors.”
I love that Ben didn't pull any punches, but he was also not rude. Very good interview, and hats off to her for coming on a show where the viewers might not share her same opinions. Great discussion. There are many fewer shows from the other side that would have shown this level of respect and reciprocity. Hopefully we see many more in the future. This is UA-cam....it's pretty clear that clickbait titles are never going away. You have to take that into account when you click on *any* video. It's the nature of the beast - I agree that it sucks, but the truth is we all have to get used to it. I don't want UA-cam getting involved with mandating what can be put in the titles of videos because it will eventually go too far.
Hobby Lobby isn't taking away your right to any type of contraception. They're just choosing not to PAY for certain forms of it themselves, or have it covered under their insurance plan due to their religious beliefs. You, as a woman, if you insist on these types of contraception, are more than welcome to purchase these on your own, and I'm sure that Hobby Lobby will not exact any sort of punishment on you for doing so. Fairly certain that they also do not want to be involved in any related lawsuits. They simply do not want to PAY for it. And that should be perfectly acceptable.
Except for if the employee is paying a portion of their own insurance plan witch I am 99% sure they are. If they are paying as well how can it be determined what the employee and employer are paying for. It should have been ruled if they would like a say then they need to pay 100% of the plain. This just gave insurance companies an excuse to not cover more more things. Now in the case of the bakery that didn't want to make a wedding cake for a gay couple. That was ruled discrimination. That should have been ruled also by the language with religion in mind. Not serving them because they are gay would be discrimination but the bakery should have the freedom to not place or carry things that support gay Marriage. So they should have to make the cake but should be able to refuse to place 2 men on it or write Mr and Mr. And i personally support gay Marriage. But can not force others to do the same

I'm all in favor of government not only giving idiots birth control but requiring them to be on it (& drug screening for rehabilitation purposes) if they are receiving any government assistance. (Though assistance should primarily be in the form of seminars education, basic food growing supplies, & the like so they can learn to support themselves better (& could reasonably include their kids.) Some basic knowledges to help them with better paying employment also.) This should also all be done at the lowest reasonable community government level & even through &or by nonprofits.

I believe that in child custody cases, the courts are sexist. Some fathers would be better parents than the mother. I believe that some mothers file for custody in order to receive child support. IMO.
I was called for jury duty a long time ago , and during the jury selection if the judge had a question about anything , he would call both lawyers up to the bench and they discuss their interpretation of the law so there was not any misunderstanding.

I agree with Ben's position that the constitution isn't a "living" document to be re-interpreted however those in some future era see fit. It means what it meant at the time it was written and that meaning is very easy to decipher. The amendment process is the right way to go to effect change if change is sought.
The fact that the constitution can be changed is what makes it a living document as it has not been finalized but that was distorted or corrupted when they started using the courts to sidestep the lawmaking process. So this adapt to current times philosophy in court decisions is a tyrannical dictatorial approach to governance.

I'm no legal scholar, but I've heard a lot of people that say there is no right to privacy in the constitution. In Roe v Wade the court looked at the 14th amendment and said our right to privacy is stated in that amendment. I don't see it there but I do see it in the 4th amendment. It's states very clearly. We have a right to privacy, including a right to be secure in our "persons", and because of that right we can not be subject to unreasonable searches or seizures. Why didn't they use that?

I don't think it was meant as an insult, as he said he wanted to address her correctly. She didn't seem offended by it (nor should she, because if you call yourself a professor without being one, you should expect people to ask that question).
We talked about this in our Constitutional Law class and my teacher talked about how both extremes are bad, not interpreting the law in a way that it can be applied now a days and also using the law in a way that it benefits you or your beliefs, which is actually not a normal evolution of the law, but an arbitrary modification!
In Mexico we have a lot this problem that the Supreme Court makes an interpretation that changes the meaning of the law and they make it mandatory for all judges, so they are not actually doing their job, but overstepping in the jurisdiction of the legislation. Ben is right, if this woman wants the law to be different, she should change it via the legislation with democracy, not try to get progressive judges to just interpret the law differently
The pet peeve I have is that it's always being referred to a s "democracy" when it's a constitutional republic. So the employees we hire to represent the people, i.e., elected representatives, are not our leaders, they are just hired hands .

Tbf, The constitution was written without the women’s rights laws we have now. So, then, by standards now the original constitution would be considered sexist. If I am wrong and you could link a video or text, feel free. I would be happy to listen or read it and rethink.

If it was sexist it would’ve said something like, “women are property, they don’t have the right to vote, etc.”. I believe that later on the women’s rights laws were added to clarify that women are also people, because many men did not think that. Again, never in the constitution did it say/imply that women are lesser beings than men. This is an argument about punishing the authors for their beliefs rather than punishing the constitution for what it says. The writers of this document purposefully tried to remove that bias that resides in them in order to create the constitution. Like Charlie Kirk says as he was debating on a similar topic (don’t know if you agree with him, but I do) “tell me what’s wrong with the constitution itself, not the sins of the authors.”

Hobby Lobby isn't taking away your right to any type of contraception. They're just choosing not to PAY for certain forms of it themselves, or have it covered under their insurance plan due to their religious beliefs. You, as a woman, if you insist on these types of contraception, are more than welcome to purchase these on your own, and I'm sure that Hobby Lobby will not exact any sort of punishment on you for doing so. Fairly certain that they also do not want to be involved in any related lawsuits. They simply do not want to PAY for it.

Except for if the employee is paying a portion of their own insurance plan witch I am 99% sure they are. If they are paying as well how can it be determined what the employee and employer are paying for. It should have been ruled if they would like a say then they need to pay 100% of the plain. This just gave insurance companies an excuse to not cover more more things. Now in the case of the bakery that didn't want to make a wedding cake for a gay couple. That was ruled discrimination. That should have been ruled also by the language with religion in mind. Not serving them because they are gay would be discrimination but the bakery should have the freedom to not place or carry things that support gay Marriage. So they should have to make the cake but should be able to refuse to place 2 men on it or write Mr and Mr. And i personally support gay Marriage. But can not force others to do the same

I'm all in favor of government not only giving idiots birth control but requiring them to be on it (& drug screening for rehabilitation purposes) if they are receiving any government assistance. (Though assistance should primarily be in the form of seminars education, basic food growing supplies, & the like so they can learn to support themselves better (& could reasonably include their kids.) Some basic knowledges to help them with better paying employment also.) This should also all be done at the lowest reasonable community government level & even through &or by nonprofits.

I was called for jury duty a long time ago , and during the jury selection if the judge had a question about anything , he would call both lawyers up to the bench and they discuss their interpretation of the law so there was not any misunderstanding.

I agree with Ben's position that the constitution isn't a "living" document to be re-interpreted however those in some future era see fit. It means what it meant at the time it was written and that meaning is very easy to decipher. The amendment process is the right way to go to effect change if change is sought.
The fact that the constitution can be changed is what makes it a living document as it has not been finalized but that was distorted or corrupted when they started using the courts to sidestep the lawmaking process. So this adapt to current times philosophy in court decisions is a tyrannical dictatorial approach to governance.

I'm no legal scholar, but I've heard a lot of people that say there is no right to privacy in the constitution.
In Roe v Wade the court looked at the 14th amendment and said our right to privacy is stated in that amendment. I don't see it there but I do see it in the 4th amendment. It's states very clearly. We have a right to privacy, including a right to be secure in our "persons", and because of that right we can not be subject to unreasonable searches or seizures. Why didn't they use that?
