I believe many states when you get your license you’re agreeing to take the breathalyzer and comply on a DUI traffic stop. If you refuse, which is your right, you are immediately penalized for a longer amount of time then you would if you complied. I don’t know the exact details and each state is different but I know if you comply and do all the tests you get released with a future court date, like a week or 2 away, and you’re still able to drive until then. If you refuse to test then you lose your license that night for like 3-9 months immediately and it doesn’t matter what the court outcome is down the line. You have the right to refuse, but you don’t have the right to not face the consequences. I’m not sure on this but I know sometimes judges/courts can use your pleading the fifth/silence against you so that’s how the dui stops seem too. Go along with it and even if you fail you get to fight your case in court. Refuse you’ve now broken multiple laws so you have the dui consequences later but get thr refusal consequences immediately. I hope that makes sense.

I think it was about 200 DWI cases dismissed due to any arrest involving these officers. And now silence. This was supposed to be a federal investigation. What's happening? Where are these officers working now?

The arresting officer may not have pursued a warrant because by the time blood is drawn, several hours will have passed and the results will show a low (legal) BAC so its not worth it.
You can only get a warrant for a blood draw for a felony level DWI. This was a misdemeanor. So no, a judge wouldn’t have signed a warrant for a regular citizen either.
The drunk driver needs have his license suspended for 30 days, oh and he had a weapons, there is a special federal crime for this. And he should not be paid for his leave. So on paid holiday. Why didn't they get a warrant for his blood so they could test it. They would have for an ordinary citizen. He will be fired (transfered) and continue working in law enforcement. End qualified immunity so the bad law enforcement public servants can't investigate themselves and can be held accountable the same as the citizens they prosecute.

APD didn't fire any of the, was it SEVEN?, DWI unit officers who "allegedly" took money to not show up in court for DWI cases. They all resigned. And we are hearing nothing about that now. It's like it never happened!

The DUI officer likely didnt give a breath sample because of course hes scared that would convict him.
The arresting officer may not have pursued a warrant because by the time blood is drawn, several hours will have passed and the results will show a low (legal) BAC so its not worth it.
You can only get a warrant for a blood draw for a felony level DWI. This was a misdemeanor. So no, a judge wouldn’t have signed a warrant for a regular citizen either.

The drunk driver needs have his license suspended for 30 days, oh and he had a weapons, there is a special federal crime for this. And he should not be paid for his leave. Without a license he cannot work at his usual job, forfeiting all pay until when and IF his driving PRIVILEGES are restored. But he is LEO, there are rules for thee but not for me. Hypocrites.

Carrying a loaded firearm while driving drunk is another charge! Prison! This cop needs to be fired and sent to prison! We have two sets of rules in this country and most people are fed up with it!
It should be mandatory for law enforcement officials to give a blood sample when charged with an alcohol or drug offence.

If a police officer is stopped and charged with drunk driving, it should be an automatic breathalyzer test with no opting out. He should not have the right to say no to it. That should be part of his contract to work. This should be mandatory.
