    That waiver is ridiculous! If repairs aren't done correctly there WILL be health problems. This happened to my Grandmother after an apartment above her had a leak. The apartment didn't replace all of the wet drywall and the back wall of her pantry was completely covered in mold. She ended up in the hospital with a respiratory infection. We had to threaten legal action before the complex would release her from the lease so we could move her to a better place.

      Yeah, legally this is bs and if these people pushed their case, they'd eventually win. The problem is, most people don't have the time nor the money to deal with crap like this and are just trying to live their lives.

    Grier property ought to have flood insurance, rather than trying to force the hand of tenants to sign new leases stating that they’ll be responsible for damages/ repairs.

      It's not just evil, it's libelous, and potentially fraudulent.
      And blowing an active lease in the process is also breach of contract.
      The landlord is asking to be sued.

    Why didn't the judge stay the eviction until after the next hearing? Very simple to execute an escrow order for the rent. Seems the laws in this state favor the landlord and there's no protection for good tenants.

    Leah your a strong woman and we love you and the kiddos. These people know they are wrong on so many levels! I hope the legal aide helps you guys and that those apartments get the reputation that they deserve. Maybe it can be filed with insurance fraud?, since they wld get paid for thier building bc of disaster, yet they collected rent while the place was uninhabitable as well ?. Just a thought. Love yall

    What's the use of signing the lease if it has no meaning no protection and the courts wouldn't even listen to her it was just a means for them to tell her you have to move there's so many things wrong with this morally and to see the courts stand by it is sickening. I hope nobody signs that lease taking on responsibility to fix their property that too is ridiculous

    So sad to be bullied out of your home. I just don't understand the world we are living in. TN first state to pass a law that camping on public land is a felony. Yet so many people being pushed out of where they live for a number of reasons. Wow just wow. I love helping anyone in need but billions and billions of dollars going to Ukraine like it's a faucet running over and we still have homeless on our street, unaffordable housing, and run down schools in the inner city. Ty "goons' from other states coming in buying up Nashville's property and selling houses for an incomprehensible amount. One house originally on a property and now sets 4 or 6 with no yard space. Damn joke.

      Wow I thought colorado was bad, here in colorado it's illegal to camp or live in your car but it's only a misdemeanor as far as i know. I stayed in my van for about 3 years but I clean houses so I was always on the go, I kept on repairs and tires on my van so I made sure it wouldn't break down anywhere, I never threw trash out anywhere and I rented a storage unit to put my things on so my van wouldn't get too full. The government doesn't want you to be independent they want you to feel like you have no other choice bit to pay rent and give your hard earned money to evil landlords who always seem to be able to screw people in the end and get away with it. The government doesn't seem to get that just because a person doesn't pay rent somewhere that doesn't mean that they don't pay taxes or spend money in their community

    Going through the same thing my basement flooded mold found and sewage smell coming from basement told my landlord cussed me out when I informed him and gave me till June 30th called legal aide they said it was legal and I had to get out he told me just use bleach me and my daughter stayed sick and my rent was paid on time every month I will not get my deposit and me and my daughter are done all due to him not wanting to do right I feel for her because no matter what the landlord won and he told me he would win if I took him to court he’s right !

      Because a law suit for mold damage illnesses down the road would be. 1000 times the rent check if the tenant remains in an unsafe apartment and gets sick due to mold exposure.

    I HAVE A NEW OWNER DOING THIS TO MY FAMILY WE ALSO HAVE RENTAL ASSISTANCE AND THE NEW OWNER IS NOT CORPORATEING WITH THE RENTAL PROGRAM TO GIVE THEM PROOF HE IS NEW OWNER AND HE IS REFUSING TO GIVE US INFORMATION WHERE TO SEND THE RENT PAYMENTS AND IS TAKEN US TO COURT FOR NON PAYMENT OF RENT BUT IS REFUSING TO ACCEPT OR ANSWER TO RENTAL ASSISTANCE PROGRAM and IS NOT CORPORATEING WITH US....by law your supposed to send a letter within 10 days of buying a property and tell us when and where to send the rent NEVER DID THAT he actually took us to court for an ejectment because he didn't believe that we have a residential lease with the last owner the judge dismissed it because we have a lease and 3 days later he filed a verified complaint for non payment of rent plus late fees attorney fees and the water and sewer bill because he paid it off which is not in our name....... I've never seen someone ignore the laws like this and are trying to make us get a bad record when we are able and willing to pay AND have a rental assistance program that he is ignoring!! He wants to flip the house and sell it he doesn't care that I have 5 kids and have been here for 3 years the house said it has tenants in it but he chose to buy it anyway and now he don't want to take responsibility as a landlord and now breaking the law hoping we will just run away scared but NOT MY FAMILY! we have done NOTHING WRONG this shit is so messed up!!

    Im a superintendent here in Ontario CANADA!!!! (I love CANADA!!! LOL), An I manage houses apartment buildings etc etc, an we could NNNNNEEEEEEVVVVVEEEEERR!!!!!!! Get away with this bullshit, your rent is whatever the lease said from point of unit control aka move in day, we hold last months rent in holding so the last month their here we have the money already but we have to pay the tenant interest every year on their rent we have in holding for last months rent, In CANADA we tell tenants when they move into an apartment that yes we have insurance but that only covers the building an building maintenance, in Ontario renters can get $25k in renters insurance for$25 a month an that covers their belongings an its a lease term that must be filled before entry!!, but a lease is the same lease from day 1 an rent increases for existing tenants are set by the government last year was 1.5% so $11.50 per $1000 not much. But this crap here!! the court would destroy the landlord first court hearing! lol an there's also that one3 clause every landlord has in their tool box its called, be a nice person!!. oh one more point once a tenant moves out you can put the rent up to whatever you wont, doesn't mean someone will rent it, but if the tenant is still there on their original lease is only raised what the government says like the 1.5%... also landlord can offer the tenants money to leave the unit an to avoid the lease if they wont too, but the tenant can say nope!, An that's why we screen the poop out of applicants, we have tenants who've been here 20 years, an we keep them in mind when we select new tenants. Also there is one clause that you can ask a tenant to move if someone in your immediate family (not a 3rd cousin twice removed, lol) needs the unit to move into (parents , kids, brother sisters mom dad etc etc) An the court does MULTIPLE checks to make sure that was the truth an not an excuse to move a new tenant in to make more money, they check over an over months an months later if you lied your gonna pay soooooooooooooooooooooooooo much money to the tricked tenant an you will be arrested for purdgery an contempt of court an lying on documents, so dont do it! lol ok GOD BLESS EVERYONE! AMEN!.

    Yet another reason why I'm glad I own a home and don't rent. The whole point of renting is that while you never own the home nor build up equity, you at least don't have to deal with repairs. This landlord wants it both ways: you don't own the home, but we the landlord don't have to fix things either! And it's stunning that the law seems to be on their side. I have always found in life that the more you can rely on yourself, the better and apartments or condos give you a false sense of "hey, I don't have to handle that!"

If they don’t want you there they will make you leave. Then add to that she went and had 2 kids and they want to toss that in as a sympathy card. I don’t feel any sympathy. We all need to make better financial choices.

      BE careful of even owning your own home. Your town, your county and the state can take it from right under you if they like. No payment of taxes, Not following the laws on housing like keeping your lawn cut at a certain height. if the house is considered a blight on the community, the town, county, city, state can even knock it down. And the payment is like 1% of it's total value of the house is actually worth or even less that you would get paid from the government.
      The two words that would scare any homeowner is...
      "eminent domain"
      Meaning any government agency can come and pay you what they consider "fair" amount for your property. Mostly it's about 90% less than the value of your property.
      So remember your house is not your house even though you own it, if your mortgage is paid in full, if not, it is still owned by the bank.

    I know people don't want to live in what they call a 'big city' but at least they have more options in the way of laws for both sides. These little hick counties, make up stuff on a daily basis to suit their mood. They are so twisted, they can evict you if they don't like your dress that day, seriously. Talking about stone age mentality. Someone refusing MONEY.
    Also, concerning the repairs, her insurance company most likely paid off, and now she has decided to keep the money for her self.

      If they accept the rent check they are giving the ok for the tenant to stay in a possible mold infested apartment and would be liable for health issues of the tenant in the future which would be 10,000 times the rent check.

    I can’t believe that judge is making the tenants leave when they signed a lease in January for a year! And if she’s paid every month, she now has an eviction for non payment of rent? It makes absolutely no sense at all! Landlords are responsible to fix things when something isn’t right Imo!

    This is all I’m seeing on UA-cam. I’m being evicted for no cause because they don’t want to fix the sewage that has been pouring under my home for 4 months. I’m fighting it though. Can’t wait to see the judges face whej she sees the video of it flowing underneath my home🤣

    Most fail to understand our economy is in the toilet 100% due to how insurance companies control every single market in todays busineses. cars homes business medical, everything is insurance controled, their is no safe haven for anyone to be free of the scams they over charge everything for, and since they are in every aspect of poeples lifes. cant be free to save money any more due to insurances costs in the USA is rotten to the core.
    Cant even go to a doctor get a referal for xray or anything without insurance approval, even medicine, cant get even get the right stuff doctor prescribed for you have to get a cheaper not the same generic or other brand type, due to they wont cover the one you need because it costs alot more. So insurance now controls your life health. not doctors any more.
    This is the biggest crime we have today. Insurance companies controlling everything that happens in todays world with no way to stop them currently. Only the super rich can get by they can afford the high prices of all the extra insurance options, that are not available to 95% of the country. normal working poeple elderly students, kids, they dont get those luxery insurance options afforded to them.
    Think about it insurance companies they are not doctors control your life health, how did we get to this agenda in todays world, it was not this 30 years ago. Now its in full effect. Insurance is wether you live or die, has nothing to do with your doctor any more. they decide with their greed what to fund or deny, reguardless of your doctors input on the topic of your health needs. Insurance greed is killing more people then ever before. Nobody is seeing this effect but me ??
    Stop living in closet and fight back against the corruption of insurance companies controling our lives today, especially your health. This is a true fact as its happened to me on several occasions, insurance deny my doctors request for medication for my health issues, DUE TO COST, they denied it, no actual health reasons at all the insurance stated ?? This is obsurd you can die, they dont care long as they keep lining thier pockets with your cash, they wont cover your needs after the fact every single dam time.

    Makes sense to me. Why would you want to stay in a building that flooded? They can’t fix it correctly with you living there. Move, that’s why they are saying if you are still here then it is your problem because it can’t be fixed with you in the way. Ppl crazy. You can’t make someone keep you on as a tenant. That’s why the judge was against her. They gave you notice and a period to decided if you wanted to take on the cost of the repairs or move. There was not an option that said I’ll just keep paying rent and ignore the question.

    Realtors/Landlord's in Cabarrus County nc turn in blank unfilled out documents to courthouse & they still get stamped thus giving you a eviction on your name with no rhythm nor reason...help lawyers

    Giving a false reason for eviction: libel
    Refusing to honor the lease: breach of contract
    Can someone please sue this landlord? He's committing two tortious acts.
    This is a good time for a counter attack because the landlord is fibbing about the eviction reason, and badmouthing someone on paper and getting them in hot water as a result is something you could sue over.

    The problem is, is the high income and class making it worse for middle low income and class people and families to live because they want more high income and class people and families to come in and live, or they want to place some kind or sort of a atrocity to replace the building or buildings that is already there... yet this is not isolated in one area of Tennessee, it is all over Tennessee. In my personal opinion we the people need to fight back legally, if that does not work, then fight back illegally, and make it time for a revolution not just in Tennessee but for America.

    That why you should try to buy your own place ASAP. Just get a lot out in the county that is zoned for mobile homes. Then set it up for utilities, then a used trailer. It might take you 15 years from the time you buy that lot until you can move in but it's soo worth it because nobody can tell you to kick rocks from then on.
    I know it's not possible for everyone but that's what I did and I had a little luck come my way. Two years after I bought my lot, I saw a FB post where someone wanted a trailer off their land so I got it for moving and set up cost. It is possible if your determined.

    That's why renting from large apartment complexes owned by mega corporations is bad. To them you are a easy replaceable asset. Most of these place that own the place you are living in does'nt even have their main office any where near you. All they have is maybe 1 or 2 managers for the whole huge complex. You're better off renting from small complexes where you can actually talk to someone.

    Corporation owned housing... they have lawyers who know how to write a lease.. even if it does seem unfair they make sure it's *technically legal* you cannot win with them.
    My old complex had sewer problems... and they were forced to fix the damage it cause.. but they didnt fix the *Actual Sewer problem* .. when the new lease rolled around.. it specifically said any sewer problems are now the responsibility of the renter...
    Either sign the new lease or you move out.

    I'm hearing due to the area being a war zone from the flooding if tenants wish to continue living there they have to release the landlords from responsibility from health complications due to the flood. With supply chain and labor issues I understand repairs are slow, especially the the vast devastation from the storms in that area. I would think the mold risk would be huge there. The storms were an unpredictable occurrence that destroyed buildings and made others unsafe to live in. It's a very tough situation to be in for landlords and tenants. It would be smart to get out of an unsafe apartment until repairs have been made, but where are those people going to go?

    Why shouldn't the landlords cover themselves with a contract like this? If there is mold the landlord should fix it immediately but doesn't want to get sued in the process.

    I’m so glad I bought my house when I did in 2010. Now I’m ok but we never know why the owners that rent out are evicting paying renters. What’s behind it all.

    I'm sorry to say this, but the judge is utterly stupid. The law is crazy and ridiculous and absolutely leans heavily towards the landlord. The tenant was at no-fault here since she was paying timely rent.

    You have owners insurance and you have renters insurance. If she would have gotten renters insurance to cover her situation that's on her. Same as owners insurance. People need to handle their busness.

    How the hell do you have the whole county with less than 20,000 residents??? Here in CALIFORNIA, a tiny small rural farming town has more than 20,000 people, and we're not even counting illegal immigrants

      Weather controllers have been stealing California rainfall for decades and diverting it to other areas as floods. The weather is controlled. Government patents for how they do it is online for all to see. Type in weather modification patents. You will see.

      @@cheryljohnson4742 seen it everyday.....with this white streaks in the sky everyday....we were told that the white streaks are meant to reflect sunlight away so CALIFORNIA can stay cool...well, this has had a horrible consequence on rainfall....

      @@Aikynbreusov I've been watching California fires 🔥 since about 2017. These fires were deliberate and rainfall was withheld from California, even tho companies in UAE sell you the kind of rain you want. The technology is there. They know how to make it rain and make it drought. I've been praying for California since, that the people will wake up and rise up against the destruction of their State.
