      You forgot to mention that the officers words might not be guilty of disorderly conduct but it would be a policy violation to which it seems the case has been closed without accountability.

    Complaint forms against police should not be in the possession of, nor issued by the police. They should be available at city hall, and reviewed by a board of citizens. The board should then schedule an appointment with the person filing the complaint. Then the complaint filed with police, being overseen by the board. It should all be publicly accessible.

      That’s what I have been saying. It should be like how the jury duty system works. Except I don’t see a lot of people that would try to get out of this civic duty. It would probably be like winning the lottery when it finally becomes your turn.

      There should also be a whole government department for conducting police investigations, instead of an internal affairs unit that's a part of the police department.

      Problem many states are doing what they can to eliminate citizen review boards. The state of Iowa change the law where they limited citizen review boards are only allowed with cities/towns with a citizen cap. If I remember right the capped it at 5k people.

      These cops need prison, not lawsuits. They don't pay lawsuits themselves, and they don't learn anything from lawsuits. Maybe they'll learn something from prison.
      Or 2a, whichever.
      p.s. Before people start saying Abolish Qualified Immunity! that's largely irrelevant. First, QI only applies to civil lawsuits, not criminal prosecution, And, Even without QI they're usually indemnified, which means they still pay nothing themselves. Also, for example, Colorado officially abolished QI but also set a very low cap: $25k as I recall. But they're not indemnified for prison. Nobody is going to get locked up for them.

      Filing a complaint does not necessarily initiate an investigation. The police gave him a chance to file a new complaint, but he instead demanded to see the captain & chief, who were not available. This guy just wanted to instigate an argument with the police for clicks. That's not what good auditors do. They go to the AG, file lawsuits. THEY ARGUE IN COURT.

      But at least she spoke a few words. If she had remained completely silent, not only would an arrest be justified, she would have almost certainly been convicted of wiretapping; a felony.

      I tried filing a complaint after being arrested(not charged) at gun point by a SWAT team. The end paragraph from the department said that because I was not a police officer I couldn’t critique them.
      I can tell you having a dozen high powered rifles pointed at you, while unarmed, is not a lot of fun.

      Well that comes up a lot on here. You can be trespassed for anything the operator of the building deems inappropriate. You can complain in the correct venue later, but disputing it in the moment is a bad idea, because you can be legally trespassed.

      Going by your definition, voters could be trust past from polling places.
      When the operator of the building is the government it cannot trespass anyone for any reason.
      Someone could be trespassed for breaking the rules but the rules need to be reasonable and cannot violate people's rights.

      In general you must either/or 1. Commit a crime, 2. Create a public disturbance, 3. Interrupt/interfere with public service.
      Many locations will claim you are creating a disturbance by refusing to leave, though, your simple existence cannot be deemed a "disturbance". They will do the same with "interfering".
      Many people get arrested for filming quietly charged, released, and walk away with 10s of thousands in restitutions.

      @@shawn6986 As far as I know in NY law, there's no statute that criminalizes frivolous complaints. Nothing he did that was shown on this video is criminal behavior. Can you please point me to the laws he broke either in this video or other interactions with the police? I'm always willing to learn more and educate myself, I appreciate it.

      @@shawn6986 Its up to who ever is making the investigations to find out what ever the complaint is legit or frivolous. If there is multitude of unfounded complaints then pattern can be found and possibly step above go and look what ever complaints are fraudulent, how ever taking this step is questionable as best, cause completely corrupted police force will never find anything wrong in their actions and most likely investigation step above wont find anything wrong ether since that point rot has spread to that level as well, so in a sense you are defending that corrupt police force should be able to just claim complaints be frivolous and then arrest the complainer to abuse them even more... are you right in the head?
      I do agree if there is several complaints that didnt find anything wrong, lawsuit or complaint above them should be launched, but in this case they would not even take the complaint, witch is breaking to department policy. Being insufferable is not illegal

    Over and over again we see people trying to put in a complaint by requesting a complaint form and the cops refused to hand over any sort of complaint form and say that you must talk verbally to the people and they will decide whether you're complaint is valid or not... Here we see guy do exactly that by trying to file the complaint verbally and get a resolution and we see how well that goes for him.

      It’s to keep you scared of them. Not everyone will stand up for themselves in these situations. Those that do stand up may not due anyway for whatever gets done to them. Not everyone that sues will win. Anyone that sues and wins gets paid by the taxpayer, not them. They might rarely get into trouble. On balance they obviously think that they come out on top in the long run, as long as we still fear them.

    When someone asks to file a complaint against an officer or any other civilian, he or she is well within their rights to do so. That officer saying “I’m not going to do that because I didn’t see what happened and it wasn’t my shift” that’s not gonna hold up. Either way you have to take down the complaint so it’s on file. Refusing to do so just means you’re covering up for your boss

      He is literally following the law in regards to how that complaint would be upheld. Certain offenses have to be committed in the presence of the officer in order to be valid for citations or arrest, such as disorderly conduct offenses, which was the violation being discussed. The officer wasn't refusing to take the complaint, he was refusing to issue an unlawful citation for an offense he didn't witness.

    The Captain told them to go to the NYS Attorney General and file a complaint. Sounds like a good piece of advice and they should also look at contacting the FBI / US Justice Department "Public Corruption and Civil Rights Section" if he feels his rights were violated. I'm guessing that they will not pursue an investigation based on the allegations as presented in the video.

    All these "fighting words" statutes are BS. There are ZERO words that "by there utterance cause harm." WORDS CANT CAUSE HARM. They can hurt people's feelings but we live in a free country with LAWS where feelings are not enforced.

      You may offend someone with your speech. That offended person might take issue...
      Don't call the police now.
      Stand up for what you said. Words have consequences as well.
      Your words are not harmless. The government shouldn't be able to control your tongue, but you definitely can be held accountable by someone who doesn't like your words.

      I mostly agree that with words causing harm or inciting fighting, it seems, at first, ridiculous. Adults should be able to control themselves and not be swayed so strongly by simple words. I struggled at first to think of ways words would bring me to get physical with someone until I thought of someone claiming they were going to harm, or worse, myself or a loved one, and if I have every reason to belive they will follow through with their words. That's far beyond mere name calling or profanity and most likely overlaps with terroristic threats.

      The classic example would be yelling "Fire!" in a crowded movie theatre when there is no fire present. This is an example of how words alone can cause legitimate physical harm. Fighting words are determined by the context as much as what is actually said.

    How many times have we seen videos of police arresting people for “cussing” as this is public indecency. But when a police officer cusses at a citizen, then it’s a first amendment protected right.

    Document the complaints, investigate, and report the results to the complainant. If the complaints become a chain of causation for the next complaint, ask a judge for restraining order.

    THE MAIN POINT he was trying to express was "a citizen could and would be arrested for certain offences if the cop is arrogant or butthurt however a cop would never do so to another cop, only citizens" And he is correct that is not fair however he chose the wrong forum to try and make a point cops don';t give a shit they just want to get a pension . For these auditors to be able to create real change they should direct more of their energy towards promoting us to ELECT POLITICIAN'S THAT CAN! Pressure the PD's bosses!
