I am so glad I live in NZ, where we have a "no fault" system, and this practically eliminates all personal litigation. It is not possible to sue someone for negligence in NZ. If you committed criminal negligence, then police may charge you with the crime, and you may be directed to pay compensation to the victim if found guilty, but in 99% of cases, New Zealand's Accident Compensation laws means you get taken care of by the government: 80% of your lost wages and all your medical bills are paid. This system is funded by employee-paid levies which are a part of the income tax automatically deducted for wage earners. The more dangerous your job, the higher the levies. Protip: Don't take up commercial fishing, or become a forestry worker. Those people have by far the most injuries of any industry!
This is a fairly accurate and well researched presentation. However, I feel like you may have missed the primary issue in the McCease case as you describe it. To me, the real question is the attempt to invalidate the liability waiver, which is a standard feature and an important protection to the disc golf tournament, structure and format as we know it. If the challenge to the liability waiver is upheld, it remains to be seen whether or not disc golf tournaments as we know them can possibly continue.
The McCease case not being closed makes the DGPT decision to have the "Florida Open" there a head scratcher. Also the fact that course needs a lot of work from what people have said .
It does appear, from reading the reviews of the McCease course on Udisc that no improvements have been made yet. Still complaints on cow poop even. Expect more lawsuits because that course is dangerous.
Accepting her gender doesn't mean you can not except her participation in the FPO. The fact has always showed that a gender borned man has a lot more strength then a gender born woman. Therefore it is unfair to compete for money. I accept Natalie's choice to change gender but not her competing against women.
How many events did she win again this year? I fail to see this dominance everyone is referring to. I personally dont care either way but it annoys me that people are so hateful. Maybe I don't agree with everything but I will still treat her with kindness and respect. At the end of the day she's a touring pro & I think that's cool.

We don’t evaluate each of them to determine if they actually are capable of more. We have decided that we want to see females who have achieved the highest skill possible for a female. Just in case there is anyone here that can’t understand why we are against trans in the FPO, here is some perspective. I am an Am1 dude with a 950 rating, not even close to sponsored and nobody will probably ever know me…. But someone made a transition, with my skill level and rating, and made $10,000 in the biggest tournament in our state and has many sponsors….
Nate was playing most of the tournaments at the end of the year...badly. So he was nowhere near lead card. He was there though...still complaining and making every card he was on awkward as hell
Waivers are common practice for lots of activities - climbing gyms, ski resorts, paintball, ropes courses, etc - they usually have an explanation of the risks and consequences a participant may encounter, and the person who signs the waiver usually acknowledges and accepts the risks and agrees to hold the business harmless (aka won't sue them) if something happens. However, waivers can only do so much. If there is negligence by the business they may still be sued and owe damages. In this case, if the waiver said that there is a risk of being hit by a disc and that's what happened and there was no provable negligence, then the plantiff might not have a case. As the sport grows up, the PDGA probably should have an umbrella waiver and an umbrella insurance policy that covers all participants in its events. I'm not a lawyer, and I could have this wrong, but I'm sure discgolflaw will be able to clarify.
yea, idk the story but if thats the law suit against mccease, thats actually kinda delusional. like that would be like me suing the state because some random guy hit me with a disc at a park. i just dont see how there is any grounds for that. as far as it goes i feel like getting hit by a disc, falling all that is just a part of the game. all i think its gonna do is make tournament directors make people sign waivers so if and when someone gets hurt its not on them
