Thank you again for sharing. Q: should we see the client's ID to prove they have given us the correct address or will their email and phone be good enough proof that it is them who gave us the information? and does a contract have to have both parties' signatures on it or is just the client's info ok?

Does it matter whether or not their name , address , phone number , email etc. is pre filled in by the photographer or by the client and does it matter ? If my client and I discuss a specific location for example, I want to be the one filling that in on the contract so that they cannot switch it up while signing and then I’m legally agreeing to something I didn’t know about until after the fact when reviewing a copy of the signed contract. I feel like the best way is to ask them for their number and other info before presenting them with the contract and already having all pertinent info already filled in to where all they must do is sign their name after reading. Is that a valid way to do this?

I've heard people tell me that they don't use written contracts because a contract is only as good as the parties to it. However, enforcement is not usually about trust, it's about a different understanding of expectations. Honest people can have honest misunderstandings. Written contracts are about documenting expectations so that nobody has to count on everyone remembering the agreement the same way.

Exactly! Which is why you should have contracts in every single transaction.

Yep, it's actually about avoiding future conflicts.

And helping you remember exactly what each party has committed to.

Hello, I have a question, I work for a scrap company based in Mexico, I contacted a company in the United States, and offered a material, I explained to the buyer that we needed a Power of Attorney to import the material, since we are not importers only exporters, he sent me a Purchase Order Number but didn’t tell me his terms and on top of that he told me after sending me the P.O.N that he couldn’t sign the Power of Attorney, so in good faith I told him I was going to investigate how to be able to import; which was expensive for us at the moment, kept trying other options and after a month and a half I let him know that we tried but didn’t find a way to become importers and that we wouldn’t be able to honor the P.O.N and he just sent me a bill for hedge loss. We didn’t sign anything, he didn’t explain me his terms and I want to know if he can force to pay something if no contract was sign and if he didn’t explain his terms to me.

@@Marianne_Hickman so my copy being unsigned by myself makes the contact invalid?

@@Marianne_Hickman yes my copy is blank it only has his signature not mine. I only signed his copy, we agreed I still was going to do a final walkthrough. I didn't surrender or submit any payment no holding fee or deposit was given. My copy of the lease doesn't have my signature only the landlords signature. I did sign his copy of the lease. My question is do both copies have to be completely filled out and signed by both parties to make it a binded contract?

Six Figure Mastermind I am an attorney. Your lack of signature but the sig on the other copy, in addition to conduct, can make your lease bind as what we deem an implied contract. Depending on the timeframe of the lease, other rules come into play. But from what you describe here, especially if the renting party is dwelling in that apartment, you still have a binding agreement. Leases and landlord tenant law have very specific laws that lie outside of this video. This is a dangerous slope, these videos, bc despite the attempt to disclaim, there are statements that viewers may take to their detriment. Do not do that. All the best.....

I always recommend that people check the local laws where they live with an attorney whenever they have a contract.
