My condolences to the owner of Duke and I know his mother who was walking his dog must feel horrible, but when you live in the city, you have to be very cautious your head have to be on a swivel, especially when you crossing the street .when you crossing the street especially when you have a dog less than 20 pounds you have to make sure they’re walking Right next to your leg away from on coming traffic and the leash is short so you’re both walking next to each other not having your dog walking all the way behind you while crossing the street when people are swinging their cars around they don’t care they’re in a rush. I had that happened to me with my dog who was less than 20 pounds because he was a puppy at the time. If I didn’t have my head on a swivel and grabbed his leash My dog would have gotten ran over. that was my lesson to keep my dogs leash very short and have him walking right next to my legs not in front of me and not behind me. I’m so paranoid since that incident I like to have my dog walking in between my legs when I’m crossing the street.
I take every single precaution I possibly can with my dog cause I don’t want this type of thing happening to her. I never let her in the road, she’s never off leash, if we’re by a road she’s walking on the opposite side of me, if we’re in a parking lot I’m carrying her, etc. she’s got a high visibility jacket for when it’s dark and I’m walking her, too. She’s literally everything to me. I refuse to let anything happen to her

@@jdw0426I disagree. There are people who believe their only reason to live is because of their "fur baby." Possibly even war veterans who have trouble connecting with people because of PTSD from being in a war.
Yes, if the law was judge-made law to begin with. We're a common-law country - we got that from England. That means we have two types of law - the law made by Congress and state legislatures, and the law made by judges. The law made by judges actually predates the law made by legislation, since we adopted much of the judge-made law that had already been made in England and Great Britain in the centuries before the US was created. So yes, some law is made by judges and can be changed/updated by judges as well. But Congress and the state legislature can _always_ decide to make legislation that either codifies the judge-made law that's already existing (so judges don't continue to change it) or that changes the judge-made law if the legislators don't like it. That has happened many, many times. It's a check on the judges' authority, just like judges ability to decide that a Congress-made law violates the Constitution is a check on the legislatures' authority.
Even the fact that we obey the courts in this way is an artifact of common law because the constitution is very, very vague about the actual powers of the courts, including the Supreme Court. So while it seems obvious that they have the powers and checks they do it actually not clear at all from the perspective of strict legal codes. In many ways they get their powers from the fact that nobody has ever tried to really dispute it. I think somebody should and they should move us into a civil law system. I’m tired of the courts being a political battleground just because legislatures are too lazy to write code and the president is too cowardly to assert the only obvious reading of the constitution which is that the congress and president are the only two coequal branches and the President has sole enforcement authority and the congress has sole sole legislative authority.

The driver was definitely trying to hit the woman but she was able to run out of the way in time. How is he not charged with making an attempt on her life?
That's why you should always have your pet next to you crossing streets or in parking lots. Drivers don't care about your pet. Even the law doesn't care about pets. The laws on animal abuse are iggregiously light.
Let me, and all others who supports it, sign whatever we have to in order to help change this law! I'll sign whatever petition I have to that will help get our fur babies seen LEGALLY as immediate members of our families, and can be protected in court!!!! As a Papa myself of an adorable little doggy named Mimi, I support that poor family and hope they find the justice they deserve! This is exactly why my Mimi is always close by my side on her leash, every single time we go outside. She's my baby girl. 🥺😤🤬😩😮💨💔🐶
He almost hit the woman, thats attempted murder. Any lawyer worth his degree could see that within a heartbeat. Make sure who you hire is competent, alot of lawyers out there don't know jack.
Why does it matter if a dog is considered property or not? This person was inches from taking the owner right along with the poor dog! This wouldn't even be a debate if the dog had been another vehicle. That person was driving like an asshole and caused irreparable damage to another person.
That person blew right through the crosswalk. They should have seen the dog. I would be devastated. You should be able to sue. Thank God it wasn't a human.
Now was it an accident or deliberate? If deliberate then thats worse than animal abuse which should warrant heavy fines and jail. If an accident then moderate fines should be in order.
In the video, the car came VERY close to hitting the owner's mother! I don't think it was necessarily deliberate (dachshund's are low to the ground & could be hard to see from inside that big car), but coming THAT close to hitting the human too makes it seem like a case could be made that the driver was operating the vehicle recklessly & negligently.
If that dog tears up the neighbors lawn furniture, can THEY sue? Yes, that's property. A person invests time, money, vet bills, license, and more. That's property, too!
My dog Hank saved my life. I was alone and depressed and fighting drug addiction. I pushed everyone away but Hank wouldn’t go. Tried to get him to stay at my mom’s but he wouldn’t go. That dog is my brother, my best friend.
Well it could be considered attempted vehicular homicide. They tried to run her down to not just the dog. If that was a cop they would have said she was trying to run them over and they would have charged the driver with it. Weird if you kill a police dog it counts as killing a police officer. So clearly a dog is more then property, am I correct?

I refuse to let anything happen to her
Oh hell yes they're like one of my children they're my best friend, companion and protector just like I am theirs
They Are family!
Yes they are family
So if it’s property they destroyed property that was irreplaceable and had sentimental value. I’d sue for even more on that basis alone make a mockery of that law
They are family members….more than some blood family members ❤
Disgraceful! Such a beautiful dog!!! Someone’s family member for sure!!!
Pets are family!
If that had been a police dog the driver would have been prosecuted to the fullest extent of the law. Whether their was laws in place or not.
Damn that was terrible 😢 Animals are family members, we feed them, we take them to the doctor , and we love them . They are so loyal to the family. Please change this old law.
Omg nooo poor puppy 😢😢😢😢 Pets are family. Not property.
Pet is property, companion is family
@@jdw0426I disagree.
There are people who believe their only reason to live is because of their "fur baby."
Possibly even war veterans who have trouble connecting with people because of PTSD from being in a war.
The worst part is that that was a zebra crossing and the driver should have known to be extra careful. This is crazy
You're a good candidate for the special Olympics
Can judges expand laws on their own without a legislative change?
The supreme court does. They can expand upon a law or make a law passed by the legislative branch unconstitutional
NO HEART SOME PEOPLE DONT HAVE FEELINGS TOWARDS ANIMALS
100% without a doubt they are Family 😢😢Pets are emotional support for the families Children soldiers and why shouldn’t they be considered family members
The driver was definitely trying to hit the woman but she was able to run out of the way in time. How is he not charged with making an attempt on her life?
Yes all pets are family!!
Yes!-pets ARE FAMILY!
God make the roads safer for pets and people❤🙏🙏🙏
You bet pets are family!❤
Every state should have the same law when it comes to animals and they are a family member and everybody who owns a pet realizes that
Unfortunately not all take care of them properly. 😔😔😔
Intentionally without a doubt
It's the owners fault. Vehicles own the street she should've waited till it was clear.
Cone million percent, our pets are our children!!!!!, a part of our families
Now was it an accident or deliberate? If deliberate then thats worse than animal abuse which should warrant heavy fines and jail. If an accident then moderate fines should be in order.
In the video, the car came VERY close to hitting the owner's mother! I don't think it was necessarily deliberate (dachshund's are low to the ground & could be hard to see from inside that big car), but coming THAT close to hitting the human too makes it seem like a case could be made that the driver was operating the vehicle recklessly & negligently.
That wasn't animal abuse. Dogs are property they can only sue them for the money it cost
The 4 legged creatures are more valuable than some of these 2 legged animals for sure.
Family for sure
Naturally the defense lawyers want it thrown out.
The legal system is polarized, just like politics…guilty or not guilty!
Fair and ethical verdicts be damned!
They are God made creatures not unlike us. They should be treated as such. Poor baby and his family. 😢
If that dog tears up the neighbors lawn furniture, can THEY sue? Yes, that's property.
A person invests time, money, vet bills, license, and more. That's property, too!
They were on a pedestrian crossing!!!!! The driver didn’t even slow down!!! I say they have case!!!
Update the law 💯
Ignore the law, because cops ignore the law too. Visit them at home and work it out.
Cops only have the power that we give them
Any one could scare someone with a gun...it's about respect and responsibilities...
@@darkfafnir4389DID THE DRIVER GIVE RESPECT?
SERIOUSLY YOUR ARGUMENT GOES OUT WITH THE WIND... TRY HARDER NEXT TIME 👎
My dog Hank saved my life. I was alone and depressed and fighting drug addiction. I pushed everyone away but Hank wouldn’t go. Tried to get him to stay at my mom’s but he wouldn’t go. That dog is my brother, my best friend.
That’s a shame. …loosing a dog like this
Well it could be considered attempted vehicular homicide. They tried to run her down to not just the dog. If that was a cop they would have said she was trying to run them over and they would have charged the driver with it. Weird if you kill a police dog it counts as killing a police officer. So clearly a dog is more then property, am I correct?
Few years ago my town had more the 1 person's drove CATS all over. I'll just say they had community services. But, they knew they should've had JAIL, of the town citizens. It was sad.
They won't transfer the principal to other pets, probably. Like cats vs dogs in the UK. It is an injustice, and this should be seen properly not just to pass another bill to appease the public til another incident with another pet, if thy can refer it to a previous law or this. Great catalyst disappointing probable action I hope I'll be wrong
I have fish in a pond in my backyard some people call them pets they actually come to the edge when feeding them or when my dog put his nose in the water so I guess nobody in the world should eat fish I care about my dogs but they aren't humans
They're family
Im sorry this looks like the owners fault. As a dog owner, i would never walk a dog that small a cross the intersection like that. Pick the dog up. One of your steps is like 20 of there's. Then your dog shouldn't be that far behind you when you walk it, especially when crossing an intersection. This looks like she wasn't paying attention when crossing the street.
Justice for this baby and the family 🙏🐾
THE FACT IS THE DRIVER STARTED WITH ANIMALS THEN AS IT TURNS OUT LATER PEOPLE ARE THE NEW TARGET LET'S FACE IT OUR PETS ARE AN EXTENSION OF OUR FAMILY WE NEED TO UPDATE THE LAWS BECAUSE THEY ARE OUTDATED PERIOD
They are NOT property. They are family. When my dog, Max, passed away, I was so heartbroken. He was my friend and to me he was like my own son. I miss him so much. Justice for Duke.
UPDATE!
UPDATE!
UPDATE THE LAW!!
RIP DUKE, I’m sorry, buddy !😢🙏🏽
It should be the law in every state ❤❤🎉🎉🎉
Most of us love our furbabies like they are family but they are in fact property, just the same as someone takes something of sentimental value. I'm sure you can sue for some type of emotional distress, along with applicable property reimbursement.
Would you as a living, breathing being be willing to be considered property ?
Dogs possess and display emotions , so I would consider them sentient beings.
What is dog spelled backwards ?
@suesanders1169 get over it. People are still being trafficked, bought and sold as property. Plants have been shown to have some sort of sentient as well. You can abandon your pet at any time. Something you can't do with your child. You don't have to report your animals death to the coroner or abide by any specific rules when burying the carcass. So like I said, loving the furbabies is great but, they're still property
Yes stop that clear menace to society
That could’ve been her or her baby.
That is insane
God bless her ❤❤❤
Yes the dogs 🐕 or any pets are family
