    CombatVetVlog 051: Does static protect my rating from being reduced? how can you get your disability to become static? I will be discussing Static Disability and the pros and cons of having static disabilities. I also discuss how it protects you.

    Im at 90%, about to get 100. Just got my CD with my "c file" on it. Found out ALL of my disabilities are static! Booyahh!!

    Thanks for the info! Question: If I have a static disability rating, do i basically not have to worry about getting reevaluated again?

      @@combatvetvlogger8685 Thanks for the reply! That's good to know. I had a static rating and didn't even know about it. Found out second hand through my Vocational Rehab counselor.

      you are a complete different case.. do not go scaring the man based on what you have.. YES MIKE read the following CFR 38 code.. you most likely dont fall under AIR Strikes situation..
      § 3.327 Reexaminations.
      (a) General. Reexaminations, including periods of hospital observation, will be requested whenever VA determines there is a need to verify either the continued existence or the current severity of a disability. Generally, reexaminations will be required if it is likely that a disability has improved, or if evidence indicates there has been a material change in a disability or that the current rating may be incorrect. Individuals for whom reexaminations have been authorized and scheduled are required to report for such reexaminations. Paragraphs (b) and (c) of this section provide general guidelines for requesting reexaminations, but shall not be construed as limiting VA's authority to request reexaminations, or periods of hospital observation, at any time in order to ensure that a disability is accurately rated.
      (Authority: 38 U.S.C. 501)
      (b) Compensation cases -
      (1) Scheduling reexaminations. Assignment of a prestabilization rating requires reexamination within the second 6 months period following separation from service. Following initial Department of Veterans Affairs examination, or any scheduled future or other examination, reexamination, if in order, will be scheduled within not less than 2 years nor more than 5 years within the judgment of the rating board, unless another time period is elsewhere specified.
      (2) No periodic future examinations will be requested. In service-connected cases, no periodic reexamination will be scheduled: (i) When the disability is established as static;
      (ii) When the findings and symptoms are shown by examinations scheduled in paragraph (b)(2)(i) of this section or other examinations and hospital reports to have persisted without material improvement for a period of 5 years or more;
      (iii) Where the disability from disease is permanent in character and of such nature that there is no likelihood of improvement;
      (iv) In cases of veterans over 55 years of age, except under unusual circumstances;
      (v) When the rating is a prescribed scheduled minimum rating; or
      (vi) Where a combined disability evaluation would not be affected if the future examination should result in reduced evaluation for one or more conditions.
      (c) Pension cases. In nonservice-connected cases in which the permanent total disability has been confirmed by reexamination or by the history of the case, or with obviously static disabilities, further reexaminations will not generally be requested. In other cases further examination will not be requested routinely and will be accomplished only if considered necessary based upon the particular facts of the individual case. In the cases of veterans over 55 years of age, reexamination will be requested only under unusual circumstances.

    Do you know why my PTSD dissability would show as beeing STATIC even though Ive only had it for 1 yr?

    I injured my back and neck 20 years ago. The VA wants me to go back to work during Covid. Its been 2 1/2 years still no diagnosis! The VA is frustrating. Does static push u up to 100%. I need to pay for counseling because the VA doesnt help.

    Hey buddy you are gaining weight. Watch the BP. Good video. What do you do when the doc says how are you? "It hurts to move!" When the records get printed, it says you answer was "Good." A records correction is usually impossible.

      lmfao my brother.. yes i do need to watch my weight and start doing something to lose it.. thank you for being upfront.. shows you have been watching the videos.. talk to the doctor and have them correct that.. and make sure for future appointments mention not good.. thats what i have done.. i always talk to my doctor and have them record anything they mention from a diagnosis or their possible opinion and if they make a mistake as to something i said i have them correct it at the next appointment.. like that they know i am reading their notes and staying on top of it.

      @@combatvetvlogger8685 thanks. I lost you for awhile. Been watching others that are really scamsters. I would like to do something to protect the vets they are leeching off but do not know how.
      As to records correction I have used Myheathevet to make noise. It worked once. 2 other times not.

    I just contacted the VSO because I received a proposal to reduce my 100 percent to 30 percent after 5 years. If i am reduced I will certainly be homeless again. The VSO said that they will request a personal hearing to halt any rating changes. I have 100 percent for Mood Disorder, ptsd, tinnitus. Majority of my rating is for mood Disorder aggravated. Major depressive disorder. I have to say, this news has really got me scared, triggered, and anxious. My comp means my independence. When do inaska doc to make my condition static because I will always have to take meds as told by my doctor, this never goes away but I'm well as long as I take my meds. But we all know that ptsd and depression people live a yo yo lifestyle. I feel well, therefore I feel like I can stop taking meds. How do I ask for static diagnosis?

      I dont know how to request static but I will ask my doctors. I will make appointments just to get you an answer and possibly other veterans. I am sorry you are going through this. You can request the va regional office for permanent and total on your fifth year. you dont have a c&p on your fifth year? are they just reducing you on your fifth year?

      That doesn't make sense... How you get a proposal without a C&P??? by law, anytime your rate gets reduced or increased you need to have a C&P Exam or evidence in your records of improvement or aggravated conditions...

      How is your case going now? They tried to do the same with me but I called any congressman and threatened to call the Media if they wouldn't happen at me. Push Push Push with congress and the media. Chances are someone in that office will connect you with a high ranking VA Rep. They reduced me by 50 percent and then I reversed it in 3 months to Permanent and Total.

    Thanks for the videos!! Very good information!! I was hoping that you would be able to answer my questions. I have been rated as 100% since 2007 and after my recent C&P exam I received a letter that the VA is proposing to reduce my rating. What should I do now?

    Question!!! I was medically discharged from service back in 2012 with a 100% (combined) scheduler. None of my medical conditions are permanent, I haven't receive any reevaluations or C&P exams since I got out. I just go to my 6 months regular follow up appointment with PCM and every 3 months to Mental Health App. Why I see people saying that you have to get reevaluated at the 5 year mark or 10 year mark??? Apparently you don't have to be reevaluated exactly at 5 year mark, 10 or 20.... the VA is kind of weird.

      so you can call up the va 1800 number and request them to let you know when your c&p 5 yr mark is. you were also medically retired so call them up.

      @@combatvetvlogger8685 nahhh you don't need to be reevaluated at the 5 year mark! who told you that?? why should I bother calling them? It's like telling them, "eyyy I need to be reevaluated", when is my next reevaluation?...Lol; I'm already at 7 years medically retired. That is some dumb ass shit to do, calling them to find out about next revvaluation! They're gonna be like "oh yeah let's schedule you for a reevaluation! lol!
      I'm good the quiet way!

      lmao nah i wouldve not asked that. i found out about my re-evaluation when i asked for my summary after seeing my 100% on ebenefits. they had faxed over the summary and then told me i had a re-evaluation oct 2021. i then asked why and they said because i was a schedular

      I would go to more appointments rather than my 6 months appointment. Rule of thumb when Dealing with mental disorders I BEHOOVE YOU TO GET A CIVILIAN DOCTOR WHO KNOWS NOTHING ABOUT VA AND HOW IT WORKS!! Know your symptoms and tell them in your own words but know what car 38 says or if you have had any denial comp or c&p which I’m sure u haven’t is what u r saying here. If so they will always tell u how to get to the next rating....I had 50% for major depression alone at first I read those papers it will say something along the line in order to get to get to 70, all the details were there in order to get to 100% it told me what I needed in order to get that specific rating. I had a civilian woman do my c&p, after that I obtained a civilian doctor. Sadly he passed away!!! But was able to get in everything I needed from him.

    Hey fellow veteran i was wondering if you were available to talk about some static conditions. I got my code sheet from the VA but none of them said if they were static or not. I think three of them are just from looking at a picture on google images. Please help.

      alot of them are static.. migraines, hips, shoulders, knees, ibs, ptsd, and so on.. it all depends on the doctor and you exhausting all avenues for them to fix you and no avail.

      nay and yay.. so static can be assigned be assigned to a service connection or even all of them.. permanent can be assigned when you finally hit 100% and it will protect your 100% thats the nay.. yay because they both protect the veterans disability rating

      static covers one service connection and permanent and total covers all ratings... but permanent and total apparently can be taken away. idk how true that is.. its coming from veterans that have had this experience. static locks you down at the rating you are currently at for that service rating it is selected for

      yes my brother at combatvetvlogger@gmail.com.. and i can make videos on aid and assistance and housebound but that monthly compensation is based on you being bedridden, or 5/200 eyesight, or in a nursing, or activities of daily living are severely affected. i have not heard that theres a monetary difference between 80,90 and 100% for a&a and housebound except for your regular va compensation being increased.
