Sir, I have a question for you.
A person, only son of a parent, born in 1950, his Father died in 1953. And his Father is the only son for his parents.
The person's, Grandfather dies in 1958, when the person attain 8years old. So, by default, he was the only descended for the family. So he got all the properties from his Grandfather directly.
The person who got the property has, a son, 47yrs and 2 daughters, both about 50yrs.
Can he give some properties to his daughters in the form of Gift deed or should he go for a Partition deed?
If Gift deed, then as per which act he can give?

sir please clarify one doubt of mine . my mother got lands under Telangana Area Protected Tenancy act, 38 E Certificate. As it is a Heritable property as per Tenancy act. But my mother has executed gift deed to my 3 sisters. she has not considered my name In the gift deed. can I get justice by filing a case in court of law, stating that my mother acquired this land under protected tenancy act. as it is heritable property, and I should also get my share in that property as I also have inheritance right as I am the son and myself and my mother together cultivating that land. kindly clarify and give your valuable legal opinion in this regard.

4. అయితే కొనుక్కున్న ఆ స్థలం మా నాన్నగారు కు మరియు మా పెదనాయన కు సోదరి స్థలము.
5. అనగా ఆమె మాకు మేనత్త. ఈమె స్థలాన్ని మా పెదనాయన వాళ్లకు మాకు చెప్పకుండా 2.5L₹ కి అమ్మేశారు.
6. ఇప్పుడు వచ్చింది పెద్ద సమస్య.
ఏమిటంటే మేము ఉమ్మడిగా నివసిస్తున్న పెంకులతో నిర్మించిన ఇల్లు కలపను కోసి ఇంటిని రెండు ముక్కలుగా చేసి వారు మేము నివసిస్తున్న ఇంటి భాగాన్ని cut చేయాలని చూస్తున్నారు.
7. అలా కట్ చేసిన ఇంటిని పడేసి ఇంటి వెనకాల ఉన్న ఖాళీ స్థలంలో వారు ఇల్లు కట్టుకోవాలని నిర్ణయించుకున్నారు.
8. శాస్త్రం ప్రకారం ఉమ్మడిగా నివసిస్తున్న ఇంటి ని కట్ చేసిన ఇంటిలో మేము ఉండకూడదు అని బ్రహ్మనులు అని చెప్పారు.

1988 లో A అనే వారు జి.పి.ఏ. రిజిస్ట్రేషన్ చేశారు. నెక్స్ట్ మంత్ జి పి ఏ. ఏజెంట్ B కి రిజిస్టర్ చేయడం జరిగింది. కానీ2005 లో జి.పి.ఏ. రద్దుచేసి పొరపాటున తన మనుమరాలికి గిఫ్టుడీడ్ రిజిస్ట్రేషన్ చేయబడింది.షెడ్యూల్ ప్రాపర్టీ లో B హక్కుదారుగా ఎంజాయ్ మెంట్లో వున్నాడు. తప్పు తెలిసేసరికి గిఫ్ట్ ఇచ్చినవారు చనిపోయాడు.B ఈ ఆస్థిని మీ అబ్బే నాకు రిజిస్ట్రేషన్ చేశారు.కనుక మీ దస్తావేజు చెల్లదని , రద్దు చేసుకోవాలని కోరగా తప్పును తెలుసుకున్న ఆమె రద్దుకు అంగీకరించింది. కానీ రద్దుచేయాలంటే కుదరదని సబ్ రిజిస్ట్రార్ అంటున్నారు. సలహా ఇవ్వగలరని కోరుతున్నాను.
