How do you get them to legally change their way of examining a disability? Range of motion test for knees should be done while standing and supporting one’s own body weight rather than lying down, as this would resemble realistic conditions under which knee strain occurs. It’s unbelievable that they get away with conducting knee ROM exams on patients lying down.
Robert and Zach, thank you for making and posting this educational video. It is a great prelude to seeing you and attending NOVA's 2024 Fall Conference next month in Salt Lake City.
They refused to help me as well, so they’re not really as good as you think they are. They’re only gonna represent you if they’re going to make a good sum of money from you.
Well I'm sorry that these people didn't help you guys. But for me in my case I'm thankful that they took my case. The VSOs from the VA I don't believe would have got me what I should have had. Which they are still working on my case so I don't have a final outcome yet. Maybe a different LAW Firm might help your all or Good VSO.
No longer a fan of DAV as I have an ongoing appeal of 7 yrs now, and I am currently being represented by CCK, and in particular Mr. Zach Stolz. Sounds like I've made the right decision...
@@bryonwatkins1432 My final VA claim/case took 4 years (and I had to go it alone w/o any help and all the way to the BVA). Yes, 7 years is outrageous but not that uncommon. However, there IS one bit of Good News for claims that take a long time to resolve: If you end up winning, you get a huge (usually) retroactive paycheck, then whatever your new rating is monthly from then on. So as long as a claim isn't closed (kept open), the taxi-meter (!) keeps ticking, and if you win, it's like money going into your bank acc't each month no matter how long it takes. Of course, if you LOSE then you get nothing. :-( That's what happens to a lot of us -- a long claim process, a win, a retroactive check and more $$ (higher rating) each month from then on. But yes, if you CAN get it resolved earlier, good -- after all, we aren't going to live forever -- but if not, and you DO end up winning, you WILL "get paid for waiting." ;-) -- BR
I spent 13 years submitting doctor evidence an each time I was given a year to appeal the decision. After the 13 years I didn’t open the letter. After 6 month I opened the letter and the decision letter said I had six months. The VA closed the case. I reopened the case and was awarded 70%. I don’t think it was fare to me. Now all the back pay has been null and void. Please read all documents from the VA and look for a timeline.
i broke my foot in basic training. its on record. it never healed 20 yrs later. rare injury. i got denied. even the denial was contradictory saying you did injure it 1st in service but then later on made it worse in civilian life. the va even makes me a special brace to wear for my foot so i can walk with a cane
This is incredible, these lawyers should be commended explaining this process, sounds like my case! Nevertheless l am very impressed, if you have a case hire these very tenacious and professional lawyers, l can assure you they have the goods and resources to assure you the best representation in the V.A. Whole!
I was diagnosed with COPD, several years ago. Vietnam vet, V.A. denied my claim. I was in country 71 Oct -72 Nov. We were in the USAF Combat Engineers tearing down and removing debris from the bases that had closed out the flying activities. Burning wooden structures at: Tuy HOA, Nha Trang, Cam Rahn Bay and a couple structures at Danang. The Tiled Roofing turned the smoke dark gray with a bluish tint. Question: Possibly ASBESTOS?
The switching thing doesn't always make sense to me. What is the value in switching? Does switching to something supposedly faster sacrifice something else? It's not clear what the downside is.
The va sent me a letter indicating that my claim had be approved that i should receive a minimal percentage, then i received a letter stating they had made a mistake and i had to go through more steps appeals. The PAC ACT should help myself and others.
Hey CCK attorneys I have request. Please post a video on subject of Writ of Mandamus. Been fighting VA for decades, I have an advocate but eventually I might have to go it alone and take it to CAVC. I am PTSD and mental health disability claimant. In advance, thank you.
Part of the problem with the system is there’s no qualified advocates and most states. the other problem is that’s why veterans have to go to Lawyers to lose 2030 4050% of their backpay to get an actual claim processed.
Wheres the law suit in making the VA get every one on the same page how is something like this , you knowing that its possible but the board over seeing it doesn't?! This can not be accidental ?! The people at the VA administration in the new New Orleans VA hospital dont even know that in an m&p exam that i only have to demonstrate how far i can bend on my worst days not that i have demonstrate how far i can bend that day they were actually advising me "not to lie"😉😉😉but if i was to mobile it wouldn't be good ! And proceeded to argue with me when i tried to educate them ! Where are the fckng standards and why arent anyone trying to force them to have them !!! Unfortunately i know the answer its not profitable for any of you guys ! It would speed up the reviews! And the more screwed up it is the less reason for you guys to fix it !!!!
Thanks for watching! These are two major developments that will certainly shape the future of veterans law. Stay tuned with CCK for updates!

I thank God for CCK!!!!

Thank you for tuning in! We look forward to seeing you there!
I want to thank Mr Chisholm and the team for what they do for veterans , I can attest to that ❤
One of the best things I've done is to let CC&K help me with my VAclaim. If your having issues with the VA maybe you should give them a call.
They refused to help me, not enough money in it for them.

thanx, guys
Could you please explain for non-advocates watching the video what "switching the docket" means. Thanks for a useful video update on the law.
Accredited representation is important.

Thanks

The administrative board is not a court...it's the exec branch policing itself, period.
You're right. My understanding is that the "judges" are employed by the VA.
I had an appeal in for nearly 3 years and I tried to have this law firm represent me and they denied me
