I am indeed grateful to all 3 illuminaries of our legal system in educating the masses in criminal law. My request to you all, please have a similar talk on civil matters pertaining to ancestral properties given on lease prior to/ after independence independence, which till date , matters are kept pending , with no results, generations have long gone, and the present living generation is losing everything, due to this delema.

What about compensating people who were wrongly incarcerated or whose cases were delayed for years and they were found innocent? What is the compensation for their loss of income and impact to their personal lives?
What about IPS Sanjeev Bhats arrest. He is not given bail because of PM. Our CJI should bring the file out and give justice

Supreme Court must review of PMLA, UAPA ACT through a constitutional bench because so many innocent people or leader of opposition party are being sent into the jail while they are completely innocent people they nothing to do with crime scene and even then they are not getting the bail this is clear cut violation of fundamental rights, excellent and important debate over the burning issue of TODAY'S DEMOCRACY of india🇮🇳

It was a very enlightening discussion by three most eminent lawyers of the country.Singhvi was brilliant n Rahotgi too, but he was bit prevaricating on the issue of Electoral bonds. Risk aversion by courts has become a serious malady for a common citizen of the country. This talk deserves to be mandatorily shown to all trial and appellate judges to hammer them on the basic tenets of law n fu damental rights. Enjoyed thoroughly.
Returning back to the colonial period. I feel sorry to say that the judiciary at a lower level has lost its morale. I remember the old days.

We citizens wish our legal system was simpler and geared towards quick, dignified (for both the defendant and accuser) and rehabilitative justice, rather than punitive judgement, harassment, draconian filling of jails, beating up by police, fleecing by greedy lawyers and waffling non-judgements by judges - all of which happen more frequently than they should.
The best debate I have seen so far. Having lived in the US for 12+ years and having seen how the criminal justice system works there, these are the same questions that I used to ask myself every day when I hear about any cases in India. These guys must have been reading my mind.
Around 24min the statement regarding the sort of cases that make their way to Supreme court is right on the money. This is my long-held view as well. I am appalled at the types of cases that come to Supreme court and nowhere else in the world such cases go up to Supreme court level. The second interesting thing is the last 5-6 min where when it comes to deciding bail how at each level the judges seem to be passing the buck up instead of taking a call. A must watch for all Indians.
The other interesting observation is an accused has the right to remain silent, but he must cooperate with the police, how absurd is this? I have not seen such nonsense anywhere else in the world.
Once again, this debate has lent big boost to my long held belief that out of all the institutions (Legislature, Executive, Judiciary) in our democracy, it is the judiciary that has let our people down the most when it comes to protecting the rights of the accused. There is no two ways about it.

The crux of the legal degradation in our courts is primarily due to the influx of judges with dubious backgrounds. This has happened in the last 5-7 years. Amongst n number of cases with flaws like Sisodiya ,Pradhksaya of Quint and other media and opposition political leaders, arrests and confinement has become a norm to silence any sort of dissent . Lately, the Calcutta high court got involved in the Akbar, Sita naming of lions is rediculous. The IFS officer is suspended.

Some judges in the Supreme Court have forgotten the freedom struggle of India. Supreme Court judges should go and read the judgements of J. Vivian Bose, who reminded the people of this country in his judgements that the freedom struggle of this country should not be forgotten. That is why, the Judges don't know how to give relief to the common man or the corporate world? The judge doesn't know whether it should go with the govt.or the people or the opposition or the minorities or the tribals or the dalits or the underprivileged? This is the tragedy of judges who have made it to the Supreme Court for wrong reasons, like having been a lawyer for X or for Y.

These three scholars may bring their points to the supreme court before effecting these new laws . New laws must be come under vast scrutinies. New laws must not hamper the fundamental rights of citizens. I believe in these highly respected personalities to save people from any tyrannical aspects. In present time ordinary people are following the Court Proceedings live .People are finding how these lawyers are protecting the high profile cases . Constitution is designed for common people but Courts are busy with debating the political leaders cases. Eg. State of Ap.
And we hope our Judiciary, of whatever be the status - district level/session level/high court or supreme court level, do find some time to listen to this discussion (because while listening they will not on the judicial chair with that stiff collar/attitude) at their homes and understand what general public wants from them, because here all these high class lawyers are not talking for their cases or for their reputation or for any fee. They are discussing आम आदमी की परेशानियां at the present juncture .

Another commonly imposed condition for granting bail to the accused is the requirement to surrender their passport to the court, even in cases where the investigating officer hasn't presented any material suggesting a flight risk. Consequently, individuals granted bail must obtain court permission each time they need to travel abroad for business purposes, adding a cumbersome layer to the process.
In some instances, if the travel application is submitted within a long timeframe, typically two or three weeks before the intended travel date, the court may grant permission. However, if the application is made on a short notice, the same is more likely to be dismissed. This raises questions about the principles established in the landmark case 'Maneka Gandhi vs. UOI (1978) 1 SCC 248' and the protection of the fundamental right to carry profession, occupation etc under Article 19 (1) (g) of the Constitution of India.

If a person not getting bail till ninety days expired, in the name of investigation, it's clear infringement of fundamental rights as laid down in Article 21 of Constitution of India
All points were touched, but in the end nothing is going to happen in India. Here you don't get justice, here you buy justice.
There is need to change mind set of some advocates who are influencial and can get bail for miniscule population even in mid of night but are least concerned about public in general. 😢

However, it raises ongoing concerns about the overwhelming number of cases in the Supreme Court, hindering proactive measures. Can ordinary citizens play a role in addressing such legislation? Perhaps not directly, as the responsibility primarily rests on esteemed advocates to safeguard the nation against laws susceptible to misuse for personal gain.
Learnt a lot .....new laws are really not eliminating the impact of colonial legacy and our criminal law especially sections like 120 B etc. of IPC are in converse orders with our basic rights of freedom!
Whatever little constitutional values are left in our politics now should be preserved but i have less hope from the present dynast opposition leaders who are not ready to stand firm in face of struggles.

So the honourable judges are saying there shouldn’t be any arrest just because person is accused in sc/st act.Agree.
The police officers misusing the law and putting charges on the accused as the officers wish . Probably the accused did nothing wrong but the police creating story and produce the person before a magistrate. Usually the Magistrate hear the version of police story only . The court may not even pay attention to the council of the accused. This is a good subject matter to discuss and place before the authorities to reform.
