- Article 17 of the Constitution of India specifies the provisions related to Abolition of Untouchability.
Fundamental Rights are discussed under Part III of the Indian Constitution i.e., under Article 12-35, which guarantees 6 different fundamental Rights. Amongst them, Right to Equality is discussed from Article 14 to Article 18 of the Constitution. In this Video, we will discuss Article 17 of the Indian Constitution which says “Untouchability” is abolished and its practice in any form is forbidden. The enforcement of any disability arising out of “Untouchability” shall be an offense punishable in accordance with the law. The term “Untouchability” has not defined either exactly in the Constitution or in the Act.
In this Video, we will understand the incorporation and Application of Article 17, the relationship between Article 17 and Article 35, Evolution of the Untouchability (Offences) Amendment Act, Civil Rights Protection Act and various important cases relating to Article 17 such as:
Jai Singh v. UOI
Devarajjah v. Padmanna
People’s Union for Democratic Rights v. Union of India
State of Karnataka v. Appa Bala Ingale
