They only get away with it because it is _slightly_ altered, and they only sell merch of the blue SMG4 Mario hat and their OC's anyways. I'm really surprise SMG4 hasn't been sued by Nintendo though because they use unaltered ripped assets straight from Majora's Mask and obviously Mario 64 (among a ton of others.) You are right on as to why SML can only push Jeffy merch though!
