The situation is that if the Sun offer to settle for a sum out of court for say £500,000 and he goes to court and is only awarded £200,000 he will have to pay not only his own legal costs but also the NGN’s costs as the judge will consider that he has wasted the court’s time by not settling and of course if he looses he still has to pay

@@ladyvilla1956 no it was stated at the time re legal fees. The judge awarding £1 speaks volumes it basically said you one on a technicality but really you didn't deserve to win. Check out black belt barrister hes a UK Kings Counsel and often has discussed H and M cases.

@@ladyvilla1956 also if you win your case but the Judge awards less than a settlement offer previously rejected (think it's a part 36 offer) then you are liable for the fees of the other side from the date of the part 36 offer. This is what happened with Harry and hes case where he gave evidence. The judge awarded him 140K the previous year he had refused close to 500K as William settled out of court and between him and Catherine they received over a million pounds which they donated to charities including helping Harry fund the start of invictus.

The UK court system is quite easy to understand. The defendant is allowed to make a payment into court by way of Notice, which is a secret offer undisclosed to the judge, to pay an amount of money also referred to as nuisance money, to put the Plaintiff on risk. Should the plaintiff not accept the amount and the matter proceeds to trail and the plaintiff wins on the merits of the case and is awarded compensation even for ONE penny less than the offer, he or she pays all the costs, both that of the defendant and himself. If the judge awards an amount in excess of the offer or offer to pay, the plaintiff wins with costs. This rule was implemented to prevent spurious litigation. The UK has a rule called the winner takes it all. Hope this helps.
