People need to remember, Disney NEVER EVER wanted to make a Black Widow movie. It was only after Kevin Feige threatened to quit, that the Disney Company was reorganised and systems put in place, that the idea of the Black Widow movie was even entertained. And then what did Disney do? They used the pandemic as an excuse to use the movie to advertise their Disney + platform, at Johansson's expense. Look carefully at who profiteered the most from switching over the BW movie to D+ and theatre release. Iger and Chapek, both received huge bonuses for the 'growth' of D+. Chapek and co had no intention of talking to Johansson, because it didn't suit their purpose. They wanted a 'female' lead movie, to look as if they are woke, whilst paying her the bare minimum, and without the need to give the character a trilogy as they have done with Captain America, Iron Man and Thor (now on his 4th movie). Even Antman as a trilogy, and he isn't even an OG Avenger. Connect the dots ... the writers of Endgame originally had Hawkeye as the one who jumped over the cliff, not BW. Then some 'female executive' was said to have insisted that it should be BW because it would be wrong to 'take this moment away from her". I thought at the time it was an odd creative choice. But of course it was all an excuse to 'get rid' of the character, appease the fans with the BW movie, making said movie an advert for Phase 4 without the need to make sequels (and negotiate a lower pay package as a result), without the need to invest in the character long term. Max profit, min outlay for a character Disney never respected. Then, COVID happened and then the movie has now become an advert for D+. Note how Disney changed Johnson's compensation immediately, but they completely ignored Johansson's team over virtually the same issue. Disney knew they were in breach of Johansson's contract, but thought they would get away with it - because - 'hey BW is dead', and Johansson is female, so should be grateful she's getting pay anything at all. The fact that tried to suggest that Johansson was being greedy, not taking into account the COVID factor and then exposing her salary, proves that Disney is a sexist organisation. Of course Disney are trying to fight this case, because they don't want to pay their female employees their fair pay. Disney exploits their female talent, staff and employees, so that the CEO can get his huge pay packet. Funny how they didn't try this on with any of their male acting talent? Funny how they managed to negotiate a deal with Chris Hemsworth, Chris Evans, Robert Downey Jr., and now Dwayne Johnson, but were unable to come to the table with Johansson. It's time for Chapek to go, before he brings down the MCU even further with his greed.
Makes me wonder, if Black Widow wasn't dead in the MCU, would things have been different? If she was a character in an upcoming movie, they may have changed her contract. They probably thought they didn't need her anymore.

I'm wondering if Disney's thinking was that this was Scarlett's last movie as Black Widow and she's on the way out so they weren't going to give her a better deal, whereas they want to do more movies with The Rock and keep him happy. If so this thinking is incredibly dumb because she's a huge star too and they ruined their relationship, as well as the bad PR that came as a result of the lawsuit.

She did gain action film star after BW particularly Avengers and starred in Lucy and Ghost in the Shell. But she is Oscar nominated which has helped her gain a larger following. She’s been a recognizable and respected star for a long time and while the Marvel movies have definitely made her more bankable, she was brought in because audiences knew her name and face from other movies. And though I wasn’t initially enamored with her version of the Black Widow (I wanted a Russian accent) its clear by Winter Soldier that she was a major asset for the MCU and not just benefiting from it.
This sad because Scarlet Jo was going to produce, and even star on a movie about Tower of Terror For Disney. I think of all the rides that’s a must made movie.

Unless there's more bombshells coming from other actors/actresses, say from Jungle Cruise, I don't honestly think it'll be that big of an impact. The Disney+ angle was an unknown-unknown a few years ago when people were signing contracts. Obviously, they'll all know about it now, and moving forward actors will negotiate their contracts accordingly. Of all their projects, if the only contract renegotiation that comes to light is Dwayne Johnson, they can reason it away--there's only one Rock, after all, and other actors can't argue his influence in the industry. If it turns out they cherry-picked a bunch of contracts to redo, that could be a scandal. As for talent thinking twice about working for Disney, I think that's highly unlikely. Disney is such a large share of the pool of potential employers, most of the talent would be hurting their earning and career potential to refuse on principle.
@@hisbassness Actually, this does not help Disney at all. Their renegotiation with Dwayne Johnson leaves them open to recognizing that there is an obvious loss in profit. It doesn't matter Dwayne Johnson's influence in the industry. The issue here is the terms of the contract. Now they have to explain why her contract was not also considered for renegotiation when the terms of the contract changed, which they did. The terms of her contract were negotiated prior to Disney + being an option of release because the movie was never meant to be on the service. All people, especially ones with something to lose, should take into consideration the possibility of them being cheated in contract negotiations when a company goes through a public case and smears their contractee. They would be a fool not to.

Oh dude right away I know exactly why they chose to do what they did. Dwayne The Rock Johnson is going to appear in future projects whereas at the time Scarlett Johansson was not. Therefore they felt the need to make the Rock Happy because they needed him for other projects. However they didn't have any further need for Scarlett Johansson at that time and that's why they treated her differently than the Rock. I don't think it had anything to do with the fact that one is male and one is female. I do believe it had everything to do with a future business standpoint. Regardless it was still wrong and Disney needs to pay her.

Not necessarily. Unless their contracts explicitly mandated an exclusive theatrical window, (Key word: exclusive) Disney may have very well met their contractural obligation. Renegotiating with The Rock and Emily Blunt could have been more of a professional courtesy to maintain a good working relationship with those actors. My theory is, they offered Johansson a similar deal and her team rejected it hoping to negotiate a bigger cut and that’s when Disney went silent on them.

Disney totally screwed Scarlett but what added to why Disney negotiated with The Rock is because his production company co-produced Jungle Cruise. He has part ownership of the project... Disney literally can't make a move without him being on board. Emily Blunt learned her lesson. No she didn’t. She’s not even that popular outside of marvel movies and a few voice animated jobs. Out of her 48 movies, only eleven made over 200 million at the worldwide box office. I have not been privy to the contracts and I am pretty sure no one here has either. So anything any of us say is pure conjecture. It is possible that the Rock's contract may have a clause about digital release. Or, he is a bigger star and they want to keep him happy. They see more future profit from him in various movies. Her character, while part of a huge franchise, is dead. But without reading the contracts, we will never know.
Forget legal merit, it's disturbing how Disney has no concern about appearance that could easily be implied. I am sure that whatever they would need to settle this quietly is less costly to the brand then having a highly public case in the media. Just poor top down leadership.
Not that any of this changes the clear sexism and that Disney were a mess for sorting The Rock out with a deal and not Scarlett Johansson. But I think two factors that worked in The Rock's favour was that Jungle Cruise is directly a Disney film, not Marvel. And that The Rock is the executive producer of the Disney+ documentary 'Behind the Attraction' and probabaly has other Disney projects in the pipeline.

Scarlett Johansson's best movies are the ones without Marvel. Be it Marriage Story, Jojo Rabbit, Lost in Translation, Lucy, Match Point etc. Even bad movies like Rough Night managed to do okay job at Box Office because of Johansson star power. Her most successful movie remains Lost in Translation which did 25x the budget. It was well before MCU started. She's one of the few marvel actors with a good resume out of Marvel otherwise RDJ and Hemsworth can't do anything without marvel
guarantee Feige is gone after this phase, if not sooner. i bet he hands off the reins once the last few films have begun production for a smooth hand-off. he knows Disney, or any other production company, ain't shit without the creatives who actually formulate & execute this stuff. and he's shown himself very loyal to his collaborators throughout his career. if the Big D are going to start behaving like big Ds, being corporate and mucking up the works, he'll gladly tackle new challenges elsewhere.

One question that springs to mind is why agents for female talent aren’t able to get good deals? It’s not like The Rock or Scarlett Johansen are sitting across from someone hashing out a deal, surely they have lawyers and agents doing a lot of that, and those people surely at least have an idea of what comparable people are getting, who why is it that they can’t get the same deals?
If ScarJo’s lawyers are lying, I think they will end up ruining her career. With all the hype and momentum in her corner now, I can’t see ending well if they “misspoke”. I hope the best for her.

Disney didn't admit to violating anything. They see more of a future with the Rock. So to keep him happy they threw money at him. Johansson is done with Disney so they see no reason to offer her (at their complete discretion) any more money. Unless you're saying you actually read the contract and it's plain as day.
No John the only thing that Disney admitted is they like the Rock more and consider Scarlett more trouble than the Rock. A renegotiation does not admit the previous contract was changed only that the payout has changed. I know that sounds stupid but believe me lawyers make a living on stupid assumptions.
Why is no one talking about the core issue? The issue was never JUST the Premiere Access money. The issue is ScarJo’s agents want Disney Plus subscriber revenue in addition to the Premiere Access revenue. Disney bristled at the idea of having to give up subscriber revenue because they feel no one star is the draw for subscriptions. Disney violated her contract so they should pay her for that. No question. But I don’t blame them for not wanting to turn over subscriber revenue as well. That opens a Pandora’s box.

Well, to play the Devil's advocate: You kind of mentioned it, but the Rock is probably the most bankable star on the planet. It's possible that they renegotiated not because they were legally obligated to do so - but to keep The Rock in the fold for future projects. For all we know Scarlet was already done with Marvel AND Disney, and they saw no reason to pander to her, or they simply didn't think she was worth it. So in short: it's possible they renegotiated with The Rock because they WANTED to do it, not because they LEGALLY HAD TO, in order to keep him pleased, while they didn't feel Scarlet was as valueable to keep happy.

Legal saying: if you don’t have the facts on your side, argue the law; if you don’t have the law on your side, argue the facts; and if you have neither, bang on the table. Disney is banging on the table.
The issue is that we only have parts of the facts or not all the facts for Scarlett (only her side of the story). People need to take a breather and not automatically jump to conclusions, as John is doing. Those are probably very complex contracts with 100+ pages (given the multi-million investments) and nobody knows what are in those contracts. BTW, legal analysts working contract law (I saw or read) who initially reviewed her claim (what she and her team made public) either said that she would lose if this goes to court or she faces a very steep hill in front of her.
If Her contract didn’t help explicitly say “Exclusive to Theaters” then they didn’t actually break the contract. Maybe it being exclusive was the assumed way of things in 2019, but if it’s not written on paper then it doesn’t legally mean jack. Morally Disney is probably in the wrong, but legally They might be fine.
I wonder if the 2 legal departments dealing with these contracts are separate. Disney is obviously the parent company of both and distributing both films in most places around the world, but in all likelihood, Walt Disney Pictures and Marvel Studios, who are the production companies that made these films, each have their own legal departments dealing with each of these contract negotiations.

Without knowing what the Rock’s contract was negotiated from, this is a random conversation. We don’t know how biased his contract was toward box office relative to Scarlet’s. We also don’t know if the Rock’s contract had explicit language regarding digital release. Are we just going to pretend they didn’t skip theaters all together for Artemis Fowl? I suspect they pour over the contract language very carefully when they decide what they will do with the film and what contracts will be renegotiated. All of it is handled case by case, so there should be no surprise when people are treated differently.

I know this is on a larger scale than what we normal people make. But it is healthy for the work environment to sometimes discuss wages. Keep in mind that you are protected if you decide to do so by the National Labor Relations Act, and can discuss wages if you choose without fear of repercussions from your employer. It is illegal for an employer to enact a policy forbidding discussions of wages or safety.

I remember John explaining this years ago. He does it because most people don't retain what they hear the first time. So he feels the need to pound it into people's heads, just so there's a better chance that they will retain what he's saying. Probably a good idea in concept but it does get a bit irritating for those of us who can actually process things efficiently.
People need to remember, Disney NEVER EVER wanted to make a Black Widow movie. It was only after Kevin Feige threatened to quit, that the Disney Company was reorganised and systems put in place, that the idea of the Black Widow movie was even entertained.
And then what did Disney do? They used the pandemic as an excuse to use the movie to advertise their Disney + platform, at Johansson's expense. Look carefully at who profiteered the most from switching over the BW movie to D+ and theatre release. Iger and Chapek, both received huge bonuses for the 'growth' of D+. Chapek and co had no intention of talking to Johansson, because it didn't suit their purpose. They wanted a 'female' lead movie, to look as if they are woke, whilst paying her the bare minimum, and without the need to give the character a trilogy as they have done with Captain America, Iron Man and Thor (now on his 4th movie). Even Antman as a trilogy, and he isn't even an OG Avenger.
Connect the dots ... the writers of Endgame originally had Hawkeye as the one who jumped over the cliff, not BW. Then some 'female executive' was said to have insisted that it should be BW because it would be wrong to 'take this moment away from her". I thought at the time it was an odd creative choice. But of course it was all an excuse to 'get rid' of the character, appease the fans with the BW movie, making said movie an advert for Phase 4 without the need to make sequels (and negotiate a lower pay package as a result), without the need to invest in the character long term. Max profit, min outlay for a character Disney never respected. Then, COVID happened and then the movie has now become an advert for D+.
Note how Disney changed Johnson's compensation immediately, but they completely ignored Johansson's team over virtually the same issue. Disney knew they were in breach of Johansson's contract, but thought they would get away with it - because - 'hey BW is dead', and Johansson is female, so should be grateful she's getting pay anything at all.
The fact that tried to suggest that Johansson was being greedy, not taking into account the COVID factor and then exposing her salary, proves that Disney is a sexist organisation. Of course Disney are trying to fight this case, because they don't want to pay their female employees their fair pay. Disney exploits their female talent, staff and employees, so that the CEO can get his huge pay packet.
Funny how they didn't try this on with any of their male acting talent? Funny how they managed to negotiate a deal with Chris Hemsworth, Chris Evans, Robert Downey Jr., and now Dwayne Johnson, but were unable to come to the table with Johansson.

I'm wondering if Disney's thinking was that this was Scarlett's last movie as Black Widow and she's on the way out so they weren't going to give her a better deal, whereas they want to do more movies with The Rock and keep him happy. She’s been a recognizable and respected star for a long time and while the Marvel movies have definitely made her more bankable, she was brought in because audiences knew her name and face from other movies. And though I wasn’t initially enamored with her version of the Black Widow (I wanted a Russian accent) its clear by Winter Soldier that she was a major asset for the MCU and not just benefiting from it.

Unless there's more bombshells coming from other actors/actresses, say from Jungle Cruise, I don't honestly think it'll be that big of an impact. The Disney+ angle was an unknown-unknown a few years ago when people were signing contracts. Obviously, they'll all know about it now, and moving forward actors will negotiate their contracts accordingly. Of all their projects, if the only contract renegotiation that comes to light is Dwayne Johnson, they can reason it away--there's only one Rock, after all, and other actors can't argue his influence in the industry. If it turns out they cherry-picked a bunch of contracts to redo, that could be a scandal.
As for talent thinking twice about working for Disney, I think that's highly unlikely. Disney is such a large share of the pool of potential employers, most of the talent would be hurting their earning and career potential to refuse on principle.
@@hisbassness Actually, this does not help Disney at all. Their renegotiation with Dwayne Johnson leaves them open to recognizing that there is an obvious loss in profit. It doesn't matter Dwayne Johnson's influence in the industry. The issue here is the terms of the contract. Now they have to explain why her contract was not also considered for renegotiation when the terms of the contract changed, which they did. The terms of her contract were negotiated prior to Disney + being an option of release because the movie was never meant to be on the service.
All people, especially ones with something to lose, should take into consideration the possibility of them being cheated in contract negotiations when a company goes through a public case and smears their contractee. They would be a fool not to.

Oh dude right away I know exactly why they chose to do what they did. Dwayne The Rock Johnson is going to appear in future projects whereas at the time Scarlett Johansson was not. Therefore they felt the need to make the Rock Happy because they needed him for other projects. However they didn't have any further need for Scarlett Johansson at that time and that's why they treated her differently than the Rock. I don't think it had anything to do with the fact that one is male and one is female. I do believe it had everything to do with a future business standpoint. Regardless it was still wrong and Disney needs to pay her.

Not necessarily. Unless their contracts explicitly mandated an exclusive theatrical window, (Key word: exclusive) Disney may have very well met their contractural obligation. Renegotiating with The Rock and Emily Blunt could have been more of a professional courtesy to maintain a good working relationship with those actors.
My theory is, they offered Johansson a similar deal and her team rejected it hoping to negotiate a bigger cut and that’s when Disney went silent on them.

Disney totally screwed Scarlett but what added to why Disney negotiated with The Rock is because his production company co-produced Jungle Cruise. He has part ownership of the project... Disney literally can't make a move without him being on board. Emily Blunt learned her lesson. Her next movie for Amazon Prime she is co-producing so that she is FULLY compensated and has ownership of the property.

I have not been privy to the contracts and I am pretty sure no one here has either. So anything any of us say is pure conjecture. It is possible that the Rock's contract may have a clause about digital release. Or, he is a bigger star and they want to keep him happy. They see more future profit from him in various movies. Her character, while part of a huge franchise, is dead. But without reading the contracts, we will never know.
Forget legal merit, it's disturbing how Disney has no concern about appearance that could easily be implied. I am sure that whatever they would need to settle this quietly is less costly to the brand then having a highly public case in the media. Just poor top down leadership.

Not that any of this changes the clear sexism and that Disney were a mess for sorting The Rock out with a deal and not Scarlett Johansson. But I think two factors that worked in The Rock's favour was that Jungle Cruise is directly a Disney film, not Marvel. And that The Rock is the executive producer of the Disney+ documentary 'Behind the Attraction' and probabaly has other Disney projects in the pipeline.
If the average person had their salary/pay cut in half without talking about it with their employer because of working from home during the pandemic they would be pissed and this is essentially what is happening to Scarlett.

Her most successful movie remains Lost in Translation which did 25x the budget. It was well before MCU started. She's one of the few marvel actors with a good resume out of Marvel otherwise RDJ and Hemsworth can't do anything without marvel

One question that springs to mind is why agents for female talent aren’t able to get good deals? Disney didn't admit to violating anything. They see more of a future with the Rock. So to keep him happy they threw money at him. Johansson is done with Disney so they see no reason to offer her (at their complete discretion) any more money. Unless you're saying you actually read the contract and it's plain as day.
Indeed, nobody knows what is in the probably 100+-page contract. It is all speculation, but discussed here as certainty.

No John the only thing that Disney admitted is they like the Rock more and consider Scarlett more trouble than the Rock. A renegotiation does not admit the previous contract was changed only that the payout has changed. I know that sounds stupid but believe me lawyers make a living on stupid assumptions.
Why is no one talking about the core issue? The issue was never JUST the Premiere Access money. The issue is ScarJo’s agents want Disney Plus subscriber revenue in addition to the Premiere Access revenue. Disney bristled at the idea of having to give up subscriber revenue because they feel no one star is the draw for subscriptions. Disney violated her contract so they should pay her for that. No question. But I don’t blame them for not wanting to turn over subscriber revenue as well. That opens a Pandora’s box.
You're right.. that's a whole new viewpoint. I'm sure scarjo representatives did want cwratin things that Disney didn't want to give up. As John said there are other things and information that is certainly not public (yet) ... But yes , Disney is a dick for not having the foresight (or perhaps inclination) to renegotiate and/or alert scarjo in advance of the release. Whatever it is, the house of mouse smells very fishy here. In the end, they're the ones that look very bad from any viewpoint. At the very least, they're incompetent and at worse, they're extremely biased and dismissive. Which says a lot.

Well, to play the Devil's advocate: You kind of mentioned it, but the Rock is probably the most bankable star on the planet. It's possible that they renegotiated not because they were legally obligated to do so - but to keep The Rock in the fold for future projects.
For all we know Scarlet was already done with Marvel AND Disney, and they saw no reason to pander to her, or they simply didn't think she was worth it.
So in short: it's possible they renegotiated with The Rock because they WANTED to do it, not because they LEGALLY HAD TO, in order to keep him pleased, while they didn't feel Scarlet was as valueable to keep happy.
Disney are doing so many shitty things for their employees... they are screwing over their theme park even more.

The issue is that we only have parts of the facts or not all the facts for Scarlett (only her side of the story). People need to take a breather and not automatically jump to conclusions, as John is doing. Those are probably very complex contracts with 100+ pages (given the multi-million investments) and nobody knows what are in those contracts. BTW, legal analysts working contract law (I saw or read) who initially reviewed her claim (what she and her team made public) either said that she would lose if this goes to court or she faces a very steep hill in front of her.
If Her contract didn’t help explicitly say “Exclusive to Theaters” then they didn’t actually break the contract.
Maybe it being exclusive was the assumed way of things in 2019, but if it’s not written on paper then it doesn’t legally mean jack.
Morally Disney is probably in the wrong, but legally They might be fine.

I wonder if the 2 legal departments dealing with these contracts are separate. Disney is obviously the parent company of both and distributing both films in most places around the world, but in all likelihood, Walt Disney Pictures and Marvel Studios, who are the production companies that made these films, each have their own legal departments dealing with each of these contract negotiations.

Dwayne Johnson was one of the PRODUCERS of the movie. It is not the same his contract was not only as actor but producer.
Scarlet was also a producer on Black Widow. So, not different at all.

Without knowing what the Rock’s contract was negotiated from, this is a random conversation. We don’t know how biased his contract was toward box office relative to Scarlet’s. We also don’t know if the Rock’s contract had explicit language regarding digital release. Are we just going to pretend they didn’t skip theaters all together for Artemis Fowl? I suspect they pour over the contract language very carefully when they decide what they will do with the film and what contracts will be renegotiated. All of it is handled case by case, so there should be no surprise when people are treated differently.

I know this is on a larger scale than what we normal people make. But it is healthy for the work environment to sometimes discuss wages. Keep in mind that you are protected if you decide to do so by the National Labor Relations Act, and can discuss wages if you choose without fear of repercussions from your employer. It is illegal for an employer to enact a policy forbidding discussions of wages or safety.

IMO, It is starting to feel more like Johansson's representatives dropped the ball. The Rock didn't pick up the phone and call Disney, his representatives did. This only proves that Johnson has a better team around him.
