What:
Two patrol deputies are disciplined following an investigation into an excessive use of force complaint. The complaint was made after deputies arrested a man on May 25, 2017.
When:
The incident occurred at about 11:37 p.m. on May 25, 2017.
Investigators received the excessive use complaint in October, 2017.
Deputies were notified of the disciplinary action on December 13, 2017.
Where:
The incident occurred near a residence located at 7171 79th Street North, Pinellas Park.
Why/How:
Sheriff Bob Gualtieri held a press conference on December 13, 2017, to discuss the outcome of the excessive use of force investigation involving Deputy Alexander Edge and Deputy Jason Fineran following the arrest of 25-year-old Jimarez Reed on May 25, 2017.
Administrative Investigation Division investigators began their investigation in October 2017, after dash cam video of Reed’s arrest was brought to their attention.
After a thorough administrative investigation, the Administrative Review Board determined the following:
Deputy Edge violated agency policy pursuant to General Order 3-1.1, Rule and Regulation 5.15, Custody of Arrestees/Prisoners, by making physical contact with a person who he believed to be armed with a gun, in a cross fire situation, while his gun was holstered which was unnecessary, contrary to effective and accepted police practices and caused a use-of-force situation that could and should have been avoided.
Deputy Edge violated agency policy pursuant to General Order 3-1.1, Rule and Regulation5.4, Duties and Responsibilities, by failing to conduct a thorough investigation and failed to properly handle evidence.
Deputy Fineran violated agency policy pursuant to General Order 3-1.1, Rule and Regulation 5.4, Duties and Responsibilities, for intentionally muting the audio to his dash cam video during the incident in question.
The excessive use of force complaint against Deputy Fineran was unsubstantiated.
As a result of these violations, Sheriff Gualtieri said Deputy Edge will receive a 15 day suspension without pay and Deputy Fineran will receive a 5 day suspension without pay.

It happens on a daily basis. Rodney King happens everyday, I know this because it happened to me on a camera that magically malfunctioned. Their cameras malfunction every time that they commit crimes on camera. Those cameras are not to protect the public.

I think we all know why the deputy with the 5-day suspension turns off his dash cam mic. I've watched previous videos of yours where you stress integrity, but that deputy has none if he has a "habit" of turning off his mic. Doesn't your staff audit dashcam video? How could he be permitted to develop a habit of turning off his mic?
If you really care about your officers conducting themselves in a professional manner with integrity, you'll keep a very close eye on that deputy and find out how many other deputies are turning off their mics out of habit.
I think the mic disabling is the biggest problem here, not the use of force. This is a person who is intentionally concealing his actions. The only motive here is underhanded and dishonest. Why should a community place their trust in the hands of dishonest people. This won't be the last we hear of this guy, leopards cant change their spots and dirty cops never come clean. Let pray no one has to die.
He's allowed to get away with it, because his boss, and his boss' boss all condone it, until they get caught. Even then, they try and hide it, even though there's actual video evidence.

The whole problem is if an Officer turns off his audio or video equipment this needs to be automatic termination no if and or buts. What never seems to be brought into the equation is at sum point when a person is put into a fight or flight position by 4 to 5 Officers betting them and won't stop can you blame an individual for trying to protect themselves. You have one Officer trying to get compliance and as this is going on the other Officers are beating his ass. How can you expect compliance when other Officers continue to beat the suspect.

video contradicts this saying that while lying on the ground the deputy could not see the right hand. ??? on the ground right hand is extended. ... He "only" struck him with the soft part of the forearm? looked like elbow contact to me.... only 7 blows in 6 seconds therefore not damage... ??? what? did you do a concussion protecol? I have done an investigation and can clearly see in the video evidence provided that your testimony does not align with events of that night. Because i wanted to get it right i have further investigated on UA-cam , My professional unprofessional opinion is that yourself and the departments under your control are corrupt. there is the right amount of evidence to support my opinion And since the audio equipment was turned off one can only conclude that the statements from officers cannot be trusted. Your testimony does nothing to strengthen the integrity of your officers and yourself. Furthermore one can clearly see that the angle of the cruiser puts the officer approaching from behind in the shadow of the cruiser in front of the camera and since the officer was carrying a large flashlight he could clearly see the subject, One can see in the video that the cruiser is close enough to the subjects car that the headlights would not effect the ability of the officer to see the subject, If that was in fact true that the officer was walking into the lights and he could not see the subject clearly and believed the subject had a weapon i would question the IQ of the officer and his ability to do his job. One can also clearly see that was a rear naked choke and severely effects the airway and the foot twitch is the bodies reaction to suffocation and the video is stopped at the point where the subject was unconscious. So statements made by sheriff are in fact lies to cover his officers actions and the punishments are laughable compared to the crimes seen on video. The sheriff has done this so that he does not have a massive uprising from the public, He has to do something so he has done as little as he can and in doing so has made corruption stand out in Pinellas and also made himself look like a complete idiot ! Thank you sir for allowing your officers to serve and protect the sh*t out of us, your contribution to tyranny will not be forgotten and i urge people to avoid Pinellas like the black plague because you could be next ! That being said the subject may have acted a fool and deserved punishment but not to that extent, You have successfully turned the subject into a victim. If you’ve never been in a fight w/a street thug (I have been many times) then you’re in no position to make the judgements you have. The Sheriff has articulated the actions of his deputies clearly, what they did right and what they did wrong. His discipline is pretty harsh from my perspective but he (the Sheriff) has watched all 15 hours of the videos while you and I have have not.

Shouldn't have been disciplined, Should've been arrested and incarcerated. A badge shouldn't be a get out of jail free card, but just the opposite. Should be held to higher standards because as a LEO they represent an agency with a lot of power and authority over regular citizens by just pinning on that badge and wearing a uniform. Hate to say it, but a lot of people respect and trust them for just that reason. Sad that in this day and age when almost everyone has the ability to record and be heard, it's not difficult to find an officer abusing his authority and public trust.

If a normal citizen intentionally acted to conceal evidence, for example turned a microphone off to prevent audio from being recorded, do you know what would happen to them? I believe that citizen would be charged with felony tampering with evidence. Yet this officer received what I would consider a slap on the wrist. And this is one of the problems with law enforcement today in my opinion. They are held to a much lower standard than the people they lock up in cages.
The sheriffs office would look more credible if you enacted a policy that If any officer turns off or mutes his body cam the officer is fired no if ands or buts. This would be be a good start to gain the public’s confidence.

But because it's a cop, no matter what they do it's justified as gaining compliance as if the public needs to comply with whatever a cop says even if it's wrong. One of the cops was hitting the man with hand cuffs. Did they not see this action? The chief said they reviewed hours of evidence and he made no mention of the use of hand cuffs to beat the guy. This looked really bad for the police.

If two officers can't take down or subdue a suspect without resorting to physical attacks, they either need to be retrained or the officers need to do some type of personal physical training to become stronger and increase their stamina!!! This is sad, because 99.9% of the time, I'm with the law enforcement. But this makes me sick, not only "they" could deal with it with bodyweight and overpressure, but they dealt with it like it was personal. That aside, a fist is a deadly weapon. So if the suspect had expired, and they had no control of it, what would be next?!

It does not matter what Mr. Reed said while talking to his girlfriend over the phone. He knew he was being recorded and expressing his emotional feelings. The COP who PURPOSEFULLY turned of his mic, KNEW exactly why he did that. POINT BLANK, but NOT for the COPs wrongfully actions, NONE of this would have taken place. Hence why COPs are suppose to follow protocol. MIC muted, NON-compliance. Engaging a suspect- NON compliant. Not saying Reed was in the right, however, it should have never happened.

I was in Palm harbor the Pinellas county sheriff were called to behind a store for man with gun call my friend and I were next door to store in a neighborhood on the next street over we were thrown on ground with guns to our heads and after they found out it wasn't us ...I needed to go the hospital due to I have heart problems..open heart and at this time three heart attacks my daughter had told them I was a heart patient ..the sheriffs were laughing at me lieing on the ground in pain praying to God for my life...these are some evil sick bastards...I moved from Pinellas county after living there for over 35 years...it's not the same there anymore.... Bob needs to do a lot of house cleaning and get help from the FBI to really get the scumbags out this uniforms...

He words about his expectations of the character and conduct of the deputies under his command seem forthcoming, honest and sincere. Yes mistakes were made the sheriff said that and he has taken steps to correct the cause. Believing that this is a "mistake" is the problem with your entire argument. You don't mistakenly jump on someones back and then say I beat the shit out of him because I feared for my life. You do realize that's there go too, "I feared for my life." If he was so concerned about his right hand why didn't he just grab it. Nope he spent his time with one hand pushing his head into the ground and the other pounding the hell out of him. Then the second officer got control of his right hand, you know the hand he was so concerned about. So why didn't he then go after his left hand? Oh yeah that's right, both of his hands were busy pulling the guys hair back so far that his chest was up off the ground. Not to mention they pinned between the curb and a car. Then this officer is known for turn off his mic. That in of itself should be grounds for termination. If you worked in any other profession these types of "mistakes" wouldn't be tolerated.
