The rider is under no obligation to help the officers with their investigation, and he doesn’t have to answer any questions. If it were me, I’d give them my license and registration (this is not a traffic stop, i.e. the rider is not suspected of any violation, so that may not be required), and that would be IT.

If a person is more aware of his constitutional rights than the police officer then it is reasonable to believe that he is less impaired than the police officer.
How does handing over your license determine if you have been drinking? Seems like a scam to make more money by fishing for other problems like warrants, expired tag probation ect.

They exist either to generate profit by handing out tickets, or to retaliate against people who stood for their rights previously. And that's that.

Apparently, many people in this comment section fail to comprehend 4 things:
1. Us citizens have constitutional rights.
2. DUI checkpoints are unconstitutional and inefficient (in what they should do, catch drunk drivers), they're purpose is "fishing".
3. Public servants are not your friends, they're trained to make you believe they are.
4. Everything you say (even the most innocent things and simple answers) can lead to truly awful stuff.

Those of you calling the biker various names should consider that it is possible the true answer to the question of whether he has recently had a drink might be 'yes'. Doesn't mean he's DUI, but he is not obliged to give the cops that info, and he'd be a fool if he did. But he'd be just as big a fool to lie and say no, because it's possible he was observed by other officers exiting a bar. The best policy is to exercise his right to remain silent, and not assist the cops in their fishing expedition.
To anyone who thinks this guy should’ve just said no, you’re wrong. First off, whether this questioning is legal is questionable because there is no probable cause or even reasonable suspicion that he’s drunk. Second, when police are trying to talk to you about a crime, nothing you say can help you. Third, if he said no, the police could have continued to ask more questions, and anything you say during questioning can and will be used against you. Even innocent people will inevitably say something incriminating during questioning. Lastly, remaining silent does not make you look guilty. Doing so cannot be used against you and for the reasons above is the best course of action even if you’re innocent.

The plain language is very clear. A driver "shall display the [operator's license] upon demand of any police officer ..."
Any other time a cop must have reasonable articulateable suspicion (RAS) you have committed a crime or about to commit a crime to ask for your ID.
That is the only reason these commie checkpoints are legal at all.

Idk who actually is a certified law enforcement officer here but I am. We don't do these in the city I work in. The city council tried to make us do it once because we have a lot of drunk soldiers driving around but our chief refused. It is illegal. If I don't have a reason to stop you then I can't LEGALLY stop you. I can't just assume everybody is driving drunk and start demanding licenses and vehicle information unless I have probable cause. The majority of the time its the political figureheads who order this kind of stuff to fill their pockets with your money and it makes us look corrupt. For some reason everyone just refuses to question stuff. I've been told my whole career to stop questioning stuff and just follow orders. I just go full 6 year old and ask why a hundred times. Lol. It took a very long time to make Sergeant.

Honestly, catching drunk drivers is a good thing. But so is standing up for your rights. If they took a drunk or two off the road it probably saved taxpayers over the cost of an investigation into a deadly car crash. Based on when this was posted it was probably 4th of July weekend.

If you know anything about motorcyclists or drunk drivers, you would know that the two almost never overlap. If you pulled over every single motorcyclist alive on the same day, maybe five of them would be drunk. You can spot a drunk on a bike like that.

Without probable cause, these detentions are illegal. You have the right to travel unmolested. As soon as he said he didn’t answer questions, the next response should have been “you are free to go.” Because that is so foreign to the people in the comments, it’s easier to vilify the guy riding the bike. He didn’t do anything wrong.
If inspections like this get one drunk driver off the road, it may even save your life one day. No need to exercise your rights at every cost..

It’s a DUI check point. How stupid are you people. It’s set up to keep the innocent driver’s safe and alive. He chose to drive that road now do what everyone else is doing and answer the question. This is exactly how to handle this type of stop. A citizen has a right not to answer questions. The police know this very well. They had no indication he was impaired and cannot simply demand answers. The driver was polite but firm. He asked if they ordered him and then complied. The reason to ask if it is an order is that later their commands can be challenged in court if arrested. The conduct of the police may not be legal but don’t fight it at the side of the road. He did very well and remained polite at all times.

Exactly. The side of the rode is not the place to argue. Always clarify if it is a command and frequently ask if I'm free to go. This shows you are willing to cooperate with lawful commands but do not wish to be there.

In the jurisdiction in which I live the statistics show that regular patrols catch DUI drivers at a rate 4x higher than check stops. What a waste of resources, 4-8 officers at one location. But we think the real reason is to slowly turn us into a "Papers, please!" society.
All we need to do to stop this is everybody exercising their right to remain silent. But it's far easier to simply comply.

A lot of people here licking the boot. I can only assume they think that police officers are naturally good people. And most of them are! But, as the saying goes, a few bad apples spoil the bunch. Here we see a classic bad apple situation.
A man, who has literally done nothing wrong, is stopped by police. That already should not happen. The police do not have the ability to just pull you over whenever they want. They need to be able to articulate exactly why, otherwise it's an illegal stop.
Next, the officer punishes this man for not providing documents. Being secure in your papers is your 4th amendment right. The officer has no reasonable suspicion that this cyclist has committed any crime, and as such has no right to ask for an ID or driver's license.
Finally, the officer clearly does not understand the 5th amendment. Our cyclist here cannot be forced or compelled to speak to an officer. Even if he has committed a crime, even if he had performed a traffic violation, he does not need to answer or respond to the officer in any way.
This man was unlawfully detained and unlawfully searched. These police officers committed crimes. Now, sure, they probably did it for a good reason. They probably did it to make sure no drunk drivers were on the roads. But it's still a crime, and good intentions don't make good excuses for committing crimes.

If he is driving a vehicle police can legally ask for a drivers license. How can you go on such a rant and not know this? Driving a vehicle is not a right. However, police do not have the ability to pull you over for no reason. When an officer asks you to identify during a traffic stop, they're doing so because a traffic violation is a crime. This man committed no crime, nor did he do anything that would initiate a traffic stop. As such, he should not have been stopped and detained, and they had no right to ask for his driver's license.
I'm not a sovereign citizen talking about how road pirates just stole his soul or whatever. Cool your jets, and maybe learn the law and your own rights a bit.

My parents were almost killed by being hit by a drunk driver. America has a serious drinking and driving problem. However, I also don’t believe in checkpoints either as this runs constitutionally thin on people being able to freely travel without probable cause being utilized justly (no weaving, slow/fast driving, no impairment shown, etc).
I truly think officer resources are better used looking for drunks where they are usually found and displaying bad behavior. All DUI checkpoints do is waste people’s time, gets them upset and makes departments look bad in the public eye. I appreciate what all law enforcement do to protect the public but DUI checkpoints are not a wise idea for the public good. It comes across as a fascist style of law enforcement.

It was 4th of July weekend (check the upload date) so I'm glad they had such a checkpoint. But this guy handled himself and stood up for his rights well. And the cops were able to see he was sober so in a way it was a win-win.

The right to travel and operating a motor vehicle are not the same thing. There are laws and regulations regarding vehicles that everyone has to follow. If they see someone with an expired tag, license, or insurance then their privilege to operate a motor vehicle will be questioned and they'll be justly fined.

Well, if you answer questions they will use what you say against you and possibly interpret what you said as admission of guilt or waving of your constitutional rights. They cannot detain you for longer than reasonably required to conduct an investigation. They will ask you questions to get you to wave your rights and basically offer up evidence against yourself. The cop asked the U.S citizen if he had anything to drink today. The biker should ask the cop if he brushed his teeth today and showered. Stopping anybody who has not broken the law is illegal. Cops are law enforcement officers and can only enforce the laws. If you did not break a law then the cops can not detain you and interrogate you.

Nope. They usually lie but when someone is inebriated from alcohol their will be physical indicators present.
Alcohol has a strong odor, the person may slur their words or their eyes will appear glassy.
The person may also have a difficult time keeping their balance or following basic instructions.
I still don’t understand how random stops for DUI or license checks have passed constitutional muster. They are blatant violations of our 4th Amendment rights.

The driver was very smart in keeping his visor down. Cops will "smell alcohol on your breath" and then suddenly they have probable cause. Always record, only crack open your window if in a car to hand them documents. No matter what, you have to hand them your license, registration (they prob don't need this), and proof of insurance if your state requires it. Never answer questions to these bullies. Trigger phrases; "Will you do me a favor?" "How about you tell me..." "Where are you going?" Your answers should be "Am I being arrested? Are you detaining me? What is your probable cause?" If they say no, they are not detaining you, you ask if you can drive on then.
If an officer asks me if I've been drinking I respectfully tell them I want to know why I'm being asked. If they say they want to test me (breathalyzer) I ask them on what probable cause. If they say I smell alcohol I know I got em. I ask when was the last time they went to recurrent schooling and when was the last time their Breathalyzer was calibrated. They always ask why and I tell them they just admitted on record that they NEED recurrency training because if they had a memory worth a shit they would remember alcohol has no smell, no color and no taste. So their probably cause just got busted. I SERIOUSLY pissed off a trooper in Colorado and he threatened me with arrest and towing my car including making the young man (11 year old girlfriend's son I was taking for a ride in my corvette) walk home in 20* weather. THAT PISSED ME OFF!!! I took the test and blew zero. He mouthed off and I gave it to him. He said have a nice night to which I responded...you too officer...dick...bottom line..."I smell alcohol on your breath" is NOT probable cause....in fact it is the way you win your case

How does showing an ID prove you weren’t drinking?
Asking for ID is like a Law Enforcement officer looking for license plate lights out, If your license doesn't turn out it gives them reasonable suspicion to detain you and look for more reasons to write you a cite.

They are programmed what to say. When a driver like this does things outside their “training” then it shows they don’t know the law. They are cleverly trying to get motorists to provide information they are not required to give. Every traffic stop is an opportunity for escalation into a DUI or narcotics arrest, a suspended license, expired registration or no insurance enforcement action and revenue enhancement.
