      Exactly, and if it doesn’t work there’s already art.16, which is specifically designed to be used in this type of situations.
      The real issue is that the protocol is working great, just look at the NI economy. But if NI is flourishing in the single market, what does that mean for Brexit ?????
      See THAT’S why the protocol “is not working” and they now want to drag NI back into the Brexit damage zone

      Because he and his Leave cohorts in 2016 lied to get Brexit, he and his new government in 2019 lied through their teeth to 'get Brexit done', knowing fine well they'd say anything to ram through what they wanted and not stick to it down the line, which is what we're seeing today.       The agreement with the EU is not an international law, it is an agreement written into law by all involved that does not make it an international law.
      In that trade agreement as in most trade agreements there are clauses that say that any dispute has to be negotiated in good faith by both party's and this the EU has refused to do therefore the EU is in breach of the agreement.
      According to international law any trade agreement can be terminated legally if one party acts in bad faith.

      Given that secession or what some imbeciles call brexit has brought about the holy grail of the abolition of unemployment in the United Kingdom I would suggest that secession from the euphemistic union was a remarkably sensible and wise thing to do anyway it is done and that is the end of it. United Kingdom is no longer a member of the EU Federation.

    Yet another reason to not ever take Johnson at his word, ever. He claimed that the Brexit deal that he said was "oven ready," during the 2019 General Election campaign, but it turned out to be anything but. The truth is, in the times we're in, we need to pick our fights, it shouldn't be with our closest trading partner, the EU. Trade wars never end well, they only succeed in driving the already climbing prices ever higher 🤦‍♂️

    Let's be clear, this is breaking international law. You can dress it up as "necessity" but it subverts the agreement and put the TCA in jeopardy. To clarify that implication, we know that Brexit deal cost us about 4% GDP annually, a no deal would increase that to 10%.
    I know that some people don't give a damn about NI, but this impacts their pockets and people tend to care about that.

      There is nothing to prevent Parliament from doing as it pleases, and since for all practical purposes the majority in Parliament *is* Parliament and the majority of Parliament is led by the Prime Minister Mr Johnson, Mr Johnson may do as he pleases regardless of any religious mumbo-jumbo.

      Wrong this is about Boris and Westminster having to be forced to act like Northern Ireland is part of the United Kingdom. SF are marxists and republicanism is a flag of convenience. Also If the border was at the Irish border instead of the middle of Irish sea they would be up in arms, no pun intended. The Protocol is threatening the Good Friday Agreement Principle of Consent - every Unionist elected in last month's election wanted the end of the Protocol. The cost to business here is £millions just for the administration of goods coming in. Ireland is not to be involved in legislation in Northern Irelend.

      @@hminchella7423 from the outside looking in it very much looks like that the DUP barely tolerated the GFA when they were the biggest party, but now have no quams about scuppering it now that they are not. They want the protocol scrapped (which lets not forget was to try and mitigate the hard Brexit which NI didnt vote for in any form) but have not clearly said what should replace it. Brexit is not compatible with the GFA, indeed the SM and Customs Union made the GFA possible. Personally I think that Bodge Jobson would rather ditch it because NI has been a fly in the ointment of his Brexit fantasy (which he doesnt even believe in - it was purely a political vehicle for him), he’d be happy for a hard border and not care about the consequences. The DUP have been DUPed by him and they cant even see that for themselves.

    Well, as long as Ireland is part of the EU, you can have an open border between Ireland and NI, or you can can have an open border between NI and the rest of the UK, but you can’t have both. Not without having an open border between the UK and the EU, which I presume defeats the purpose of this whole mess. So unless he is secretly planning to annex Ireland, it would behoove the PM not to sell the voters impossible things that can not exist for reasons of simple geography.

      You talk as if the UK is the only side playing chicken here. The UK can choose to not enforce a border, east-west or north-south. Then it is for the EU to decide whether they want to force Ireland to enforce a border with the north. None of this resolves the original border problem and it appears to defeat the objective of Brexit, but we'd be much further along as a sovereign nation than if we capitulated to remainers. Also none of this is guaranteed because parliament is a nest of snakes and weasels.

      Well let's consider this. When in the EU. German and the UK were the only ones to enforce 100% of the rules. The further South and East you go the lower the amount the rules are informed. We aint in the EU now. I doubt the EU will risk WTO rules. I would put money on them selling the Irish out. Remember they have issues with not attacting rather a lot of American companies that are based in the Republic. Just a theory

      Article 16 was also agreed and ratified because it is part of the NIP.
      And it does not allow unilateral action. It is there to protect the protocol.
      Did you ever read article 16 or you just parroting headlines from the Daily Mail?
      When the UK thinks that the EU breaches international law, it can do something against.
      But why does nothing happen?
      Because the EU does not breach international law.
      I would put a bet that you don't even know what "international law" is.

    There are two options for a customs border for Northern Ireland: the Irish Sea, or something which violates the Good Friday Agreement. The US is guarantor of that agreement. Boris is pushing for the UK to have US economic sanctions placed against them.

      Wrong on both notions. The UK operated with a border with the EU for quite awhile when it was not a member of the EEA. The US has NO say on the Good Friday agreement, its an agreement with London and Ireland and the NI assembly on power sharing inside the NI border.

      At this stage, Britain is like a shopkeeper who's gone to the bank to negotiate a new overdraft facility, but has spent the past 20 minutes standing outside the bank manager's open office door, loudly shouting at other customers coming and going about what a moron the manager is and his wife is a fat simpleton and the bank needs him ore than he needs them and this will be the easiest overdraft to arrange in history.
      The EU has no reason to humour Britain any longer, and isn't that fussed about supporting Ireland any more, so it'll snap the ledgers shut and give Britain all the paperwork and punitive legislation it's been jockeying to get. Britain will find EU trade dramatically harder, while other trading partners will be watching Britain to see how it honours its agreements, or not - and if not, as a dishonourable partner, who will want to make deals with her, or at what cost?

    Under Criminal law, the concept of "Necessity" is a defense that permits a person to act in a criminal manner when an emergency situation, not of the person's own creation compels the person to act in a criminal manner to avoid greater harm from occurring.
    The reality is that this necessity (if it is to be believed), is directly the creation of Boris. Secondly, it misses out on the net benefit of the protocol to NI which means that there is no greater harm. This bill in fact inflicts greater harm.
    Legally, while necessity is a term that is allowable it does not apply because of those 2 reasons. It is used here as a cover. Should it have applied then it would only apply to the minimum needed to alleviate the situation and that does not include removing the ECJ role overseeing EU law and rules.
    Those are 3 gaping holes in the legal logic.
    We all know that this is an action for domestic politics. More specifically internal Tory party politics.

      There is nothing to prevent the United Kingdom government or the House of Commons from derogating from a treaty, because the House of Commons is sovereign which means subject to no other or higher authority, or in plain language, Parliament me do as it pleases, Moreover it is a Cardinal principle of the sovereignty of Parliament that one Parliament cannot bind another, or rather a preceding Parliament cannot bind a subsequent Parliament

      There is International Law, you can decide to follow it, ignore it or break it. However, international law does exist. It is at it's basic level a set of norms between nations, but it is more than that as it is the fundamental base for all international organizations from NATO to WHO to UN. The enforcement of international law is done by the other participants. Their controls may be sanctions, financial punishments and/or even war.

    I guess EU will have to ban all UK goods that have not been formally checked if UK is not doing it. This also means a hard border with 100% checks at the border between Ireland and NI if UK does not do it. -> unilateral safe guard measures ...
    At that point, I encourage ROI to give a passport to the NI inhabitants that want it, including a relocation package inside EU. When UK and NI are going to lose inhabitants and business that are paying taxes and participate to the GDP, the politicians are going to reconsider their position.

    A lot of people talking about article 16, from what I have read that could be challenged by uk courts, if successfully challenged in a uk court there would be no domestic unilateral approach moving forward so it is not a route they would be willing to go down.

      All that is necessary is a one line bill in Parliament stating that the relevant agreement is of no effect, and there is nothing that the courts can do about that because the courts have no power over Parliament which as the recent Supreme Court decision makes clear is sovereign, which is to say that Parliament can do as it pleases, including abrogating or amending treaties.

      @@coylezo Obviously you are no lawyer, but it is a cardinal principle of English law - recently underlined by the supreme court that parliament is sovereign which means that parliament*is* the law and the courts accept that and it follows as the night the day from that that if parliament wants to pas a bill into an act, the courts can do *nothing* about it, so called(and *in_fact* non-existent) international law, notwithstanding, for the childishly simple reason that the unequivocal sovereignty of parliament means that it is subject to*No*-repeat *No* authority whatsoever, as the supreme court made clear when the PM tried to suspend parliament. It is also trite law that one parliament cannot bind another.
      There neither is nor can be any such thing as " international law because all law stems from sovereigns and the simply is no international sovereign or any body to which many countries will accept has having authority over them, least of all the USA Russia China, ukland or any other sovereign nation.
      The key thing for you to grasp is that sovereign means subject to *no* repeat*no* authority and what nation that had not been defeated would willingly submit to the *any*other authority, mostly because those foolish enough to go in for democracy regard the electorate as sovereign, and what electorate that was not composed of docile weaklings would willingly surrender that unless it had been defeated in war?
      So *No* international law for want of any international sovereign and sovereigns are only sovereign because the have the power to *impose* their authority which in so-called 'real life' comes out of the barrel of a gun and what do you imagine could effectively threaten or impose its will on all of the countries of the world including the usual suspects?
      To ask that question is to answer it, is it not?
      If you tried going to the high court or above seeking to enjoin(get an injunction against or seek to restrain) parliament, your application would be immediately struck out by the court of its own motion and any judge failing to do that would immediately find himself at the business end of a weapon wielded by one of HM soldiery and all the judges I know and I know many, really would not fancy that one bit it, or in plain language they know which side their bread is buttered. Parliament also likes to call itself the high court of parliament (which puts it above *all* courts without exception) so parliament really *is* a 16' tall gorilla with a submachine gun-it sits anywhere it jolly pleases(if you know that joke question)
      Can the courts enjoin or otherwise control parliament? There is not a judge in the land that would not tell you in short and no uncertain terms, the answer to that.
      Clear now? There is simply*No* doubt whatsoever about that.

      So there is your answer. A rather decent and jolly chap by the names of Charles- the first of that name once tried to dissolve parliament at the point of several guns and you may have some idea what happened to him. He committed the war crime of *all* war crimes; he *lost* a war.
      You take my point? Sure there are tribunals established by treaty such as the wWTO,but the generally have all the teeth of a dead sheep, and appeals to what is called " the rule of law" tend to fall on deaf ears of rulers scared witless of the ruled. You saw how members of congress very nearly wet themselves when a few irate Americans got a bit excited, and a certain George III tried bleating about the rule of law to Americans and you probably know how far that got him.
      Not once, not twice but *Three* times what is fancifully called "the people" of ukland voted for secession from the EU, do you really suppose that they have all magically changed their minds? - and Boris is their man, so he has a fairly large gun, to say nothing of a majority in the house of commons.
      Our Boris also knows full well what all but the witless know and that is that most of those that voted for secession are not wildly fond of aliens and the more obviously they are alien , the less fond they are of them, the religion modernism and its cognates or synonyms of sin notwithstanding.
      Vile though the lower classes may be they do all of the work and they are not timid, so it is best not to cross them.
      If in any doubt, suck up to them like mad and forget all that religious morality/ethics bunk.

Truly we live in a world were elected officials can say screw you to (if you would rather i put it) international conventions without the people's approval, screw you to the future trust of the nation and screw you to the people who lent us the power, we just pander to you anyway, no matter the moral and ethical implementations. And we think we have come so far yet this is were we are.

      PS - for all Brexit idiots - International Law has already settled this situation; a domestic law of one party cannot set aside an International Treaty. That would take agreement from both Parties (Vienna Convention on Treaties).

      You can democratically vote out democracy. That's why there is allways something tecnocratic in any democracy for self preservation.

    I'm just a simple older person on Disability Allowance living in the Republic - Brexit has impacted the Republic severely. Tesco rarely has own brand products, Amazon is not in the Republic, Amazon UK suppliers are withdrawing from supplying to us, and Amazon in France, Holland and Germany are levying harsh delivery rates to the Republic. I am now paying near to 50% more for my purchases monthly overall - groceries and other sundries. Brexit sucks and the EU has let the Republic down badly.

    Three points. Any attempt by the Tories to unilaterally change the content of the agreement signed with the EU breaks internationally agreed on treaty protocols. Second, the Tories have not broken international law until they actually bring this into force on the UK side. Third, In the treaty, written with international agreed treaty protocols in mind any change of national laws to undermine the content of any international treaty is illegal.
