It cannot be transferred to a private entity for a sweetheart price. If it is, the original owner is due additional compensation and the recipient MUST report the difference between the market price and what they paid to the IRS as imputed income. Take a look at how the New York Times acquired their new location by such a process. They still haven't paid the IRS the taxes on the imputed income they received through the corruption of New York City. Hell - New York State as well as the city should be seized under enterprise corruption.

I think the original idea was for actual emergencies like a state of war or massive disaster after which the property would be returned. That I can actually understand being a thing. This is called, eminent domain! This is happened to my family first hand in St. Charles Illinois when they wanted to expand the library. They took my aunts home by the use of eminent domain. She fought for 10 years and still lost. I hope you folks have better luck than my family did!!
A town near me in Bradford, Ohio did this to an old man. Ended up arresting him on some bogus charge after harassing him with fines. The night he was arrested they burnt his house to the ground with all his belongings. The news got involved got him lawyer and the city ended up having to build him a brand new home. I remember hearing the old man treated the mayor and told him he had a 5 gallon can of gas he carried in his car and he would get his revenge one day whether that was true or not I'm not sure but some one coming to the end of their life they have nothing to loose. I remember hearing a story of old miner with terminal lung cancer, being fired just before the retired to screw him out of his retirement. One day after being fired, he walked right into the mine owners office and shot him dead right at his desk. Rumors are he told him just before he shot him dead, If I can't have my retirement you'll never see yours.
Back in November/December, a judge ruled that the town of Charlestown, In. violated the Eminent Domain law not to mention giving preferential treatment to the developer who had undersold a lot of properties that they themselves owned and that the city did nothing to apply the same fines to the developer of those properties that were in disrepair. The city was accused of stealing from the poor to give to the rich and that the mayor was given an ultimatum by the court: the judge ruled the City of Charlestown must enforce its property maintenance code in a "consistent" way against a neighborhood group and a private developer, siding with homeowners who filed suit over redevelopment of the Pleasant Ridge neighborhood. It also imposed an injunction on the city itself: if the city waives fines for property owned by development partnership Pleasant Ridge Redevelopment LLC as it has agreed to do, it must do the same for the Pleasant Ridge Neighborhood Association - or any other property owners.
This is why I tell people that you can’t actually own a home. You “own” it but you have to pay the government for the privilege of living in it, ask permission to build additions, and at the end of the day, they can just come take it. You don’t really own it. The government does.

THIS HAPOENED IN ARVADAFA, COLORADO! In the mid 1990's through early 2000's, Arvada, a suburb west of Denver was becoming a hotbed for New home development. One particularly hot area was the "olde town/ water tower" district. The developer made a shady deal with Arvada, they agreed to pay the city $100 for every old house ( dating back to the 1920's) they condemned or closed on via eminent domain. Within a couple months,over 130 homes, including an apartment complex were condemned. By 2004, the city had condemned 490 homes. These were replaced by trendy high-end townhouses and lofts. All the while, long time residents protested, tried to stop the project, filed lawsuits..... But ultimately lost and ended up having to move. Today, the area is filled with upper end homes, shops, and restaurants. BMW's, and Lexus vehicles drive the streets once used by Ford's and Nissan's. The end.

here in Oregon and many other states ... we have what is called Mobile Home Parks / some have been here 50 years / they have up to 300 homes on them / but the land is owned by only one person who collects monthly rent from each home / so a land developer just offers the one land owner a hugh amount of money / end result? 300 mobile homes half to be moved within one year / this has happened in several areas in just Oregon alone / so the state got involved and forced the land owner to pay up to $10,000 to move each home / but where are they going to move too? all the other parks are full and it cost up to $15,000 to move a large home across town, set it back up ect / so this is actually happening all over the United States / yes it is sad / you work 30 years and someone can change the laws on you and take everything you got / then you get old and the hospitals and health insurance companies take the rest / on the news in Oregon they showed all these old homes just being destroyed because they had nowhere to move them to / so basically the land owner (was forced) to give $10,000 to a person, but the home was worth more then that / and yes, they put up new $300,000 homes with big yards and strip malls / this all happened in Eugene Oregon a few years back you can Google it

The "beatiful" homes are 10 feet apart,they tried to put MicroMcMansions on lots that are barely big enough for the foundations.
Here in California, wildlife and agriculture are being replaced by stacked-shoebox nieghborhoods with space-greed so grotesque, the streets allow only one car to pass at a time and your door opens to a shared driveway to 6 other "dwellings"

I think the original idea was for actual emergencies like a state of war or massive disaster after which the property would be returned. That I can actually understand being a thing. Like most laws they tend to make it vague enough they can expand it's reach as needed. Laws need to be specific. Like, eminent domain is okay in these specific situations followed by a list.

This is called, eminent domain! This is happened to my family first hand in St. Charles Illinois when they wanted to expand the library. They took my aunts home by the use of eminent domain. She fought for 10 years and still lost. I hope you folks have better luck than my family did!!

A town near me in Bradford, Ohio did this to an old man. Ended up arresting him on some bogus charge after harassing him with fines. The night he was arrested they burnt his house to the ground with all his belongings. The news got involved got him lawyer and the city ended up having to build him a brand new home. I remember hearing the old man treated the mayor and told him he had a 5 gallon can of gas he carried in his car and he would get his revenge one day whether that was true or not I'm not sure but some one coming to the end of their life they have nothing to loose. I remember hearing a story of old miner with terminal lung cancer, being fired just before the retired to screw him out of his retirement. One day after being fired, he walked right into the mine owners office and shot him dead right at his desk. Rumors are he told him just before he shot him dead, If I can't have my retirement you'll never see yours.
For less than the cost of replacing one of those structures, both the mayor and the developer could be replaced.
Back in November/December, a judge ruled that the town of Charlestown, In. violated the Eminent Domain law not to mention giving preferential treatment to the developer who had undersold a lot of properties that they themselves owned and that the city did nothing to apply the same fines to the developer of those properties that were in disrepair. The city was accused of stealing from the poor to give to the rich and that the mayor was given an ultimatum by the court: the judge ruled the City of Charlestown must enforce its property maintenance code in a "consistent" way against a neighborhood group and a private developer, siding with homeowners who filed suit over redevelopment of the Pleasant Ridge neighborhood. It also imposed an injunction on the city itself: if the city waives fines for property owned by development partnership Pleasant Ridge Redevelopment LLC as it has agreed to do, it must do the same for the Pleasant Ridge Neighborhood Association - or any other property owners.

THIS HAPOENED IN ARVADAFA, COLORADO! In the mid 1990's through early 2000's, Arvada, a suburb west of Denver was becoming a hotbed for New home development. One particularly hot area was the "olde town/ water tower" district.
The developer made a shady deal with Arvada, they agreed to pay the city $100 for every old house ( dating back to the 1920's) they condemned or closed on via eminent domain. Within a couple months,over 130 homes, including an apartment complex were condemned. By 2004, the city had condemned 490 homes. These were replaced by trendy high-end townhouses and lofts.
All the while, long time residents protested, tried to stop the project, filed lawsuits..... But ultimately lost and ended up having to move.
Today, the area is filled with upper end homes, shops, and restaurants. BMW's, and Lexus vehicles drive the streets once used by Ford's and Nissan's.

This happens all the time in cities. I live outside Chicago and there they are always condemning homes or neighborhoods to the benefit of developers. This mayor is the same as any other mayor that wants higher taxes for his town. Building bigger homes means more taxes for the community. Good luck for the people of that town.

here in Oregon and many other states ... we have what is called Mobile Home Parks / some have been here 50 years / they have up to 300 homes on them / but the land is owned by only one person who collects monthly rent from each home / so a land developer just offers the one land owner a hugh amount of money / end result? 300 mobile homes half to be moved within one year / this has happened in several areas in just Oregon alone / so the state got involved and forced the land owner to pay up to $10,000 to move each home / but where are they going to move too? all the other parks are full and it cost up to $15,000 to move a large home across town, set it back up ect / so this is actually happening all over the United States / yes it is sad / you work 30 years and someone can change the laws on you and take everything you got / then you get old and the hospitals and health insurance companies take the rest / on the news in Oregon they showed all these old homes just being destroyed because they had nowhere to move them to / so basically the land owner (was forced) to give $10,000 to a person, but the home was worth more then that / and yes, they put up new $300,000 homes with big yards and strip malls / this all happened in Eugene Oregon a few years back you can Google it

We got an admendment against unreasonable fines though so fining someone 50 dollars a day for a screen door tear is unreasonable.

I was born here, (actually I'm Scott, German, English, French, and a touch of Delaware Indian......or Lenni Lenape to be exact........you know, a mutt), my parents were born here, my grand parents, great-grandparents, etc, etc back to the mid 16 60's. So that makes me a Native American.
