    I started tonight's livestream with some good news and some not-so-good news.
    On the not-so-good news front I discuss why it is so difficulty to win SSD "start over" and file a new application after you have been denied at a hearing. Generally speaking you will not win unless you show that there is something new - a new impairment, or, even better, that you have moved into the 50+ or 55+ age category so that the Grid Rules (gridrules.net) apply.

    On the good news front, I discussed a recent case where the judge gave my clients 11 months more benefits than we asked for. Not every judge would do this, but we found ourselves in front of a very wise and compassionate judge.

    This isn't a question, but a huge thank you.
    Back in December of 2017, I was told by my therapist she thought it might be a good idea if I filled out an application for Social Security disability.
    I had some major problems functioning, keeping a job, having panic attacks, etc. Medication wasn't working, and it had gotten to the point I couldn't even drive without having problems.
    Before I even started, I wanted to know what was a disability. I'd never even thought about it.
    I came across your videos, signed up for emails. In a matter of a few days, I figured out what my therapist was seeing, but I refused to believe it.
    I filled out my application by phone December 14th, 2017, 13 days after my 55th birthday. I went to several doctors, and by May of 2018, I was done. June and July went by, and I said "Ok, so I didn't get it. At least I got checked out."
    The first week of August, I received a letter. I was approved. I should have been happy, but I cried. I didn't want to be disabled.
    I wanted to go to work, do things. I wanted to be fixed.
    Took me a while to accept it.
    Now, I go to all my appointments and I don't have to worry that I won't be seen. I don't get a lot of money. But I'm careful, and I do ok.
    I took the money I received from the prior year and with my friends and family, we built a tiny house. It's my home, it's good, and I have you to thank. God bless the work you do.

    I have followed you for months now, since I figured I was on my own when it comes to thinking about applying for disability. You have given me the confidence and know how to apply with an attorney from the get go. I should qualify under the grid rules for my age(58) and disability of Lumbar and Cervical Stenosis. I also have suffered from depression and anxiety for years. I’m just getting anxious waiting for a decision from the DDS. I watch your videos, and they help me get through the process. Thank you so much.

      _I think that anyone over age 55 has an increased chance of winning b/c SSA knows that older workers with diagnosed medical issues will have a more difficult time finding work._

      @@ssdattorney that is good to know. I’m anxious because my case is currently with the DDS, and we have corresponded fairly frequently, pertaining to release of information from my orthopedic surgeon. I have been diagnosed with advanced foraminal stenosis, cervical and lumbar stenosis, and have suffered from depression and anxiety for years. I wish I knew how good my chances were, and how much longer I will be waiting for a decision. I do have a scheduled CE for my mental state. In about 3 weeks. Any suggestions from you would be helpful and greatly appreciated. Can’t wait to catch you live in about an hour by my time. Take care.     I'm 38 and this is my 2nd time trying for disability not much has changed but I have a more aggressive attorney and my dr is willing to testify at the hearing if I get to the point. My struggle is age, education, and past work history. Do you have any suggestions how I can get around this? Thanks for all the information you provide!

    I worked all my life up to 57 years where I had my second heart attack which resulted in a quad bypass, with more than 50% of my heart is not functioning. I have other medical conditions and even failed to win my case at the hearing level. I am 59 now and haven't worked for 3 years due to the demanding physical job I once did. What do I do now?

    Regarding TWP- this is a 9 month period in which we can work and still get SSDi, no matter the amount. But after the 9th month, you can still work but have to stay under SGA $1,550 in 2024, correct?

      _Correct. If you use up your TWP months but stay under SGA you will not lose your benefits. However if you have a month where you go over SGA then that month would be considered overpaid and you will be asked to pay back that month's check to SSA. Also if you use up your TWP you are more likely to be flagged for review based on "medical improvement."_

    Lumbar spondylosis, described above, worsened from prior exam. There is advanced thecal sac stenosis at L3-4 with clustering or roots and loss of adjacent CSF space.
    2. Multilevel mild to moderate bilateral neuroforaminal narrowing, described above.

    I didn't know l was giving only 5 years on disability .What do l need to do to show them l need to stay on my disability.Tell me what to do to keep my disability

    You can’t live on SSDI. It’s only worth the battle if you’re near retirement and have a pension or major investments to draw upon.
    The only other exception is you have a spouse that will carry you.

      From what I understand is you can as long as money is directly deposited. Your case has to be finalized, meaning no checkups

    I was fired from pizza hut to being to slow due to arthritis cramping up my wrists, and hands they just lock up and get stiff, along with my knee pain, back spasms, and mental/memory issues from brain injury. I just applied again a few weeks ago after being denied in 2016, with a new application.
