    Thanks so much for all the positive comments! Just a few quick clarifications:
    -We do expect to be fully reimbursed for the repair (minus the $6,400 deductible) by our cargo/transit insurance company. If we do not we will certainly let you all know.
    -Ultimately it probably is on the shipping company or their insurance or another third party for the damage however, in order to get payment for the deposit from our insurance company they required us to sign a subrogation form meaning we relinquish our rights and give them to our insurer to pursue the matter on our behalf.
    -We think it is crazy that we owe a $6,400 deductible for something that happened before we even touched our boat especially when there was an option to sign up for a "Deductible Guarantee" program offered by the shipping company that was not presented to us. This is in addition to $4,000 airbnb because we could not stay on the boat in the yard. Insurance refused to cover this expense.

      To put it bluntly, insurance companies suck! They take your premiums and then when it’s time to pay out it’s a major hassle! Glad you were able to get the boat fixed.

      As a retired attorney I can tell you that your situation is not at all unusual. If you look around at insurance companies, they and the financial institutions have the swankiest corporate offices in most cities. Whose money has financed these fancy digs, but their policy holders. So either the premiums and deductibles are too high, or the written coverages and actual payouts too low, or both. I did not specialize in the field, but I can say with some assurance that insurance companies are in business to make money and pay the smallest amount they can legally get away with on claims. They count on the fact that most policy holders don't read their policies, even the summary declaration page, and have no experience in dealing with claims. Without state laws and insurance regulators, the policies and payouts would be even more egregious and harmful to the innocent consumer. You are not coming out whole (given your deductible and housing expenses), but then had you been more properly informed, you may have taken the risk anyway in light of the increase in premium to have a lower deductible and housing coverage. I agree you should have had the option upfront.

    The shipping company should be required to foot the bill for shipping damage. At the very least, cover the insurance deductible. 🤦‍♂️

      You have to pay a separate ins for damage during shipping to the shipping company or its all down to you IE if the ship catches fire and you do not have shipping ins you will get ZERO

      Don't take ownership till the boat is deveverd to you on your terms. FOB your marina.

      Agreed, it comes down to integrity, ethics, morals. When a company is responsible, they should fix it, plain and simple. If they don’t, their reputation will ultimately be damaged.

      It clearly states that its the property's owner who is responsible to insure the goods while on the ship ! If you don't IE when the container ship grounded in the Suez canal if its not insured and you want your goods it will cost you 10's of thousands to get your goods or just swallow hard and let them go its all very clear in the terms and conditions of anything being shipped at sea.

    this must be an American style insurance sytem. In Scandinavia the insurer would pay the repair yard as soon as the surveyor has given hi/her opinion on the damage and an approximate cost. Poor guys across the pond! You should get some boating organisations together and target the insurance companies to get their shit together and not try and hold off the repairs by not releasing the funds.

    Contact the insurance commissioner of the state insurance was issued. Insurance companies will fight you on claims. I’m not sure how boating insurance works. But educating yourself on your policy is a plus. The shipping company should cover everything as it was them that did the damage. The insurance commissioner over looks all insurance companies in their state, and they maybe able to help recoup more of your loss. Good luck. Thanks for sharing your experience. Love the videos

    i own a trucking company--if there is any shipping damage we pay--we have insurance for any major loss and they are good about paying it--we do not screw around paying for the damage and we train drivers not to accept any damage done while loading or if the receiver damages the freight while unloading--it can be a pain but its part of the process

    This is a massively important video! Everyone should be aware of the pitfalls of buying a new yacht, and how to protect their investment. The 'Lessons Learnt' should be watched by everyone. Even if the cost of repairs and your up-front costs are reimbursed, people should be aware that they made to spend many weeks in alternative accommodation, which s not covered.

    Some insurace companies will not pay you in full until you get a lawyer. Then, they pay promptly to avoid legal fees.

    Insurance companies are such a pain. It seems once an attorney gets involved, the insurance company changes the way their attitude and responses.

    Something I do not understand is that you should have taken full ownership of the boat only after Seawind completed the commissioning. This means the shipping should have been under Seawind responsibility and Seawind should have delivered to you a spotless unit with any damage fixed by them before selling away.

      Unless the boat is "sailed away" from the factory, Seawind doesn't do the commissioning, the buyer's dealer does. Seawind sells the boat to a dealer, who subsequently transfers it to the buyer, with the transfer happening when the boat leaves the factory in Vietnam. The dealer/buyer arranges for the transportation/shipping of the boat from SW's factory to the destination.

      @@Alsinsin A judge would not find non-acceptance of delivery of a yacht due to damages that do not effect the functioning and operation of the yacht to be reasonable. So if not accepted, the manufacturer could sue the original purchaser for failure to comply with the purchase contract, so original purchaser would be forced to accept a damaged boat or the boat would be sold to another, and any shortfall in the resale would have to be covered by the original purchaser.

    Had Razzle Dazzle in the same spot on the same foam blocks 12mths before you. Bridgeport stuck to their quotes despite scheduling challenges and were very flexible on getting stuff done. Recommended.

    I found if the threat of an attorney is given the insurance companies changed their attitudes really quick so maybe just a threat of getting an attorney.

    Seawind HAS to have some liability, at least they should NEVER allow anyone to use that shipping company. This is crazy.

      Why? Once it leaves the factory, be it with the owner, delivery skipper or on a ship, Seawind aren’t responsible for what happens. This is 100% on the shipping company.

      If not the manufacturer then the dealer needs to correct this. What if your new Toyota was damaged during shipment? Is it reasonable for you, as the customer, to accept delivery and then fight with the shipping company? No.

      I bought a new C&C Landfall 35 in 1984. The mast was lost intrasit. I dealer had to make good on having a new one build.

      @@stan4d1969Again, it depends on the sale contract but once it leaves the dealer’s forecourt (as in the case of a car), if you organised the delivery method then you’re responsible for the vehicle in transit. That’s the whole point of transit insurance.
      The person / parties responsible for shipping will be the contact for the shipper so if it was the buyer that organised it, there’s not a lot the dealer can do.
      In saying all that, I am surprised the shipper has a deductible on something they absolutely caused. We had to have similar insurance when we shipped all our goods to the Carib and when things went missing, it was on us to deal with the insurance.

      Ownership of the boat transfers to the dealer or the buyer when it leaves their factory. The commissioning at the destination is done by the dealer, not Seawind.

    I think I would find out if somebody is an attorney and they can write some letters demanding payment. It’s amazing what happens when you get a letter from an attorney as compared to just a little old you and me.

    Sorry you have to go through that. When you purchase anything new, it shouldn’t be damaged.
    And if it is, it should be corrected…………quickly ! It shouldn’t be that difficult for you to get it done. It should be difficult for who is responsible for the damage.

    Been watching for quite a while, finally subscribed today.. I started working in a fiberglass boat shop when I was 16, now 66. You guys need to start reaching out to your subscribers and fan base.. If that was the only fiberglass damage y'all had, the bill should have been only $1200-$1600.. I don't know what y'all actually paid, but it sounds like you were severely taken advantage of, because (based only on what you showed us in this episode) it was absolutely not a major job at all.     Have watched you guys for several years. My take away from your transitions through several boats and all the DIY/Professional repairs is the it really doesn’t matter if you have a 40 year old boat or a four month old boat. You are going to pay big bucks to operate and maintain it! I have always thought of living on a boat or RV full time but have come to realize its all relative, and not much different from living in/on land, in a house with fresh water, sewer, stable electricity, access to food, repair services, etc,etc. Although maybe not as cool or memorable which is, I guess, the whole point. Keep at it!

    Generally, if you go through a broker and they fail to correctly insure you then they are at fault and you can sue them. Still, so glad you got it fixed.

    I have had the exact same problem while moving my furniture overseas, insurance is a product where you are dammed if you buy it and dammed if you don’t.

    Sorry you guys had to go through so much crap on a new boat. I just got through looking at my insurance for my boat just to make sure I don’t have any issues but all looks good. But who knows when I actually need to depend on my insurance. Only time will tell. Hopefully all is well with you guys and that you get back to sailing soon. Good luck and much love.

    When purchasing any insurance for coverage of this size, have a lawyer go over it and through it to make sure you understand it and find out if there is anything else you need to do and if you are okay with say, a $6000.00 US deductible. He will also be able to tell if you have to pay upfront or at the end of a repair, and how long they have to pay (especially if it falls off the shipping container.

      Marine insurance is a different animal.. rooted in tradition. Very doubtful that most attorneys would have any knowledge about the ins & out. Find a marine insurance specialist.

    It’s so surprising to me(but in reality, I guess I shouldn’t be), that when you’ve already paid a fair bit for shipping, neither the shipper, nor the transport companies, take any responsibility for damaging your boat. I guess there’s no incentive for doing a good job, if there’s zero detrimental repercussions. Sad world. Nice that it’s all fixed, and that you were allowed to work while in the boat yard.

    I would have thought the onus and claim was totally on the shipper to fork out the Full amount of the repair work !
    As per usual Insurance companies will do there utmost to avoid liability for bloody anything-makes me so mad!

    Thanks for explaining how the insurance claim process is going. You know you can't say you have a good insurance company until you have a claim and they come through for you. I would have thought they would send an ajuster to check out the damage as soon as you filed the claim and then authorize getting an estimate. You did everything you should have, especially advising of the damage on Day One.

    The more I see from Seawind, it seems that they might be a manufacturer to avoid. Window stays that don’t hold up the window that they’re supposed to holding open (bad engineering) to not ensuring the boat makes it to the destination undamaged.Then on the new Ruby Rose 2, they had a halyard that was twisted so badly that it was unusable to my novice understanding of sail rigging.

    I can not imagine the frustration you have experienced. Thanks for the heads up and warnings. I hope I never need to deal with an insurance company. It is better to have good insurance than none. Insurance is there to cover expenses that you can not afford or do not willing to pay. looking forward to more sailing.

    Ya, it seems marine insurance is really always full of all kinds if conditions. So read carefully. In a lot if circumstances your not covered. I found a clause that said an out of date fire eqtinguisher would void the policy. We have 6 on board. Go figure.

    Anyone along the Gulf Coast of the US could have told you that the insurance process was going to be a nightmare. That's why it's so ridiculous when idiots say "oh they have insurance". Insurance will try to mess you around every which way they can. Hope y'all get everything straight and you are made whole fairly.

    Ok,I understand your frustration; but.....
    Insurance company's main job is to keep the collected funds for thier shareholders.
    They do this by investing premiums
    The longer they can avoid, by any means, paying claims, the more return on investments.
    Your claim **may** only be $xx; but imagine the interest on several or hundreds of claims in the same time period! That could amount to really big bux.
    That is why so many cruisers simply "self insure"😂
    I realize you had some sort of broker due to the international purchase; but "caveat emptor" still and always applies.

    hope you didn't get hit with hidden charges at Bridgeport, they use to be DIY but now I would not go anywhere near that dump......next time go to Norwalk Cove a class operation.....se you down the coast
