What isn't available is rigorous testing to ensure that information is fully understood and actionable by the reader, nor the stringent ethic guidelines associated with such delicate work. There are mountains of information a patient gives during every hour of assessment and therapy that we don't (and can't) have access too - any psychiatrist and psychologist worth their salt knows that and won't sully their craft by jumping to their conclusion. I'm also torn on the whole "their brain hasn't fully developed so they shouldn't get life in prison" argument. Because at 14, your brain has developed enough to comprehend the severity of murdering another person. And it might be different if he had started crying and called someone right after the murder, but he kept her poster, he slept on her body... that's a level of psychopathy that doesn't get explained away with "but he's just 14."

    • @lymmea
      @lymmea 3 роки тому +35

      I personally think trying a child as an adult is a bad call, and I support Not Doing That in general - it's very true that someone can change over the decades to be a completely different person than they used to be, especially when going from childhood to adulthood. Even more to the point, but someone who is actually being punished for their crimes, going to therapy, etc, can be rehabilitated even if they were *originally* a monster. So I wouldn't object to this man's case, and himself, being re-evaluated now. (Although, to be fair, I guess he himself already has been re-evaluated? But he's still in prison, so that says some things.)
      Mind you, that isn't the same as saying I think this specific criminal should go free, either on the basis of having been wrongfully sentenced or because I think he's genuinely changed. It's more saying that there needs to be room in the system IN GENERAL for criminals to change and be rehabilitated, and eventually be released if/when they are successfully rehabilitated. Obviously people who don't/can't get rehabilitated, who don't comprehend the gravity of their crimes and feel remorse for them, people who are a danger to society still - those people should and indeed need to stay behind bars.
      The fact that this man has never given a true version of the events that led to/caused Maddie's death - one consistent with the physical evidence - makes me feel that he's not at all sincere in his supposed reform. He's not willing to own up to what really happened or what really motivated him - why? Presumably because it'd make him look worse. That says that he's prioritizing his own welfare, making it *intentionally* impossible for anyone to judge him fully on the true extent of his crime, over justice, the truth, and those who were hurt by his crime. You don't see that level of self-interest in someone who truly wants to make amends.
      So while I think the legal precedent that put him behind bars without parole was flawed, and should be changed, I don't think the *result* was actually incorrect. (It's the "a broken clock is right twice a day" effect. Sometimes you can get the right answer even when you're using the wrong methods.) If this man is ever going to reform, it doesn't look to me as though it's happened yet, and perhaps it never will. But if he can't even be honest about exactly what he did and why, even after all these years, no one should trust anything else he says, either.

He showed a complete lack of empathy multiple different times during and after the murder took place. If you ask me he has a very high likelihood of committing another murder. There are so many serial killers who were imprisoned SEVERAL times and let go, so they continued to murder. If you can’t be 100% sure he will never murder or hurt anyone again, I don’t understand why you would want to let him back into society. And the fact that he wouldn’t write the family a letter of apology because HE wanted them to actually see how “sorry” he is, is ridiculous. That continues to show a lack of remorse. If he was genuinely sorry, then he would apologize to them in whatever form THEY wanted. Because the most important thing is that they get an apology for his actions. Btw, I don't know if he was sent to a real jail or some sort of a jail for youth, or a juvie, though I can't imagine a 14 yo in prison with adults. Anyway I think it's ridiculous to send a 14 yo to spend the rest of his life in prison, just because he's not fully developed at that age. People say he knew exactly what he was doing, that he wasn't a child, but he was and the fact that he decided to do it and didn't stop himself (however gross it is) doesn't mean he knew the consequences or the gravity of his actions. Try to put it into perspective and imagine a 14 yo girl murdered by a 20 yo (same age difference as in this case), you'd say a child was murdered with the whole life ahead of them. I just don't think you should ever take full responsibility for what you do when you're 14. I've done some dumb things when I was 14, I feel like I'm a totally different person now. Why are there even any laws protecting minors if they can be treated like adults anyway? If a 14 yo is able to comprehend sexual matters, why is the age of consent 18, not 14? Same with drinking alcohol, that's just stupid that you're way to young to consent to sex or drink, but you're not too young to be sentenced to life. Also, I don't think you can be 100% sure of anyone that they wouldn't hurt or kill someone, there's a lot of "bad" people out there. And to be clear, I think he should be locked up, ideally with some psychiatric help, just not for the rest of his life.
