For Biden to be declared incompetent to stand trial and doctor would have to evaluate him and find out if he understood the charges against him and can assist in his defense. I'm 99.9% sure that Biden can understand the charges and assist in his defense, considering he gave a state of the union address that seemed coherent. He should have been indicted and a jury could have considered his dementia at sentencing.

Hur's report is conflicting. In one part he said there was evidence that Biden willfully retained and shared classified documents, which is a crime, but that due to his age and dementia a jury would view him as an old fart with a poor memory. So he had evidence of a crime, but didn't indict due to poor memory? Then in another part he said there was insufficient evidence to file charges?
