We judge by what's apparent not in the heart
But isn’t it minor kufr if he believes Allahs law is better but major kufr if he believes his law is better than Allahs law
Why shouldn’t one takfir. If all the conditions are fulfilled and the people or the ruler is made aware and still he does this kufr (in this case not establishing sharia and ruling with man made laws). Why shouldn’t he be takfired?

There is no excuse in shirk akbar, except ikhrah (coercion)
People excuse the mushrikeen with various things, for example Jahl (ignorance), Taqleed, (Following the teachings of somebody) Ta'wil (Wrong Conclusions made on the basis of misunderstanding a topic.
Why Jahl isnt an excuse is shown in Surah Al A-raf 7:172, and Surah Al-Tawbah 9:6;
وَإِذْ أَخَذَ رَبُّكَ مِنۢ بَنِىٓ ءَادَمَ مِن ظُهُورِهِمْ ذُرِّيَّتَهُمْ وَأَشْهَدَهُمْ عَلَىٰٓ أَنفُسِهِمْ أَلَسْتُ بِرَبِّكُمْ ۖ قَالُوا۟ بَلَىٰ ۛ شَهِدْنَآ ۛ أَن تَقُولُوا۟ يَوْمَ ٱلْقِيَـٰمَةِ إِنَّا كُنَّا عَنْ هَـٰذَا غَـٰفِلِينَ[ ١٧٢ ]]
And ˹remember˺ when your Lord brought forth from the loins of the children of Adam their descendants and had them testify regarding themselves. ˹Allah asked,˺ “Am I not your Lord?” They replied, “Yes, You are! We testify.” ˹He cautioned,˺ “Now you have no right to say on Judgment Day, ‘We were not aware of this.’
وَإِنْ أَحَدٌۭ مِّنَ ٱلْمُشْرِكِينَ ٱسْتَجَارَكَ فَأَجِرْهُ حَتَّىٰ يَسْمَعَ كَلَـٰمَ ٱللَّهِ ثُمَّ أَبْلِغْهُ مَأْمَنَهُۥ ۚ ذَٰلِكَ بِأَنَّهُمْ قَوْمٌۭ لَّا يَعْلَمُون[ ٦]]
"And if anyone of the mushrikeen seeks your protection, then grant him protection so that he may hear the words of Allah. Then deliver him to his place of safety. That is because they are a people who DO NOT KNOW
Why Taqleed isnt an excuse is shown in Surah Al-Ahzab 33:67
وَقَالُوا۟ رَبَّنَآ إِنَّآ أَطَعْنَا سَادَتَنَا وَكُبَرَآءَنَا فَأَضَلُّونَا ٱلسَّبِيلَا۠] [٦٧]]
And they will say, “Our Lord! We obeyed our leaders and elite, but they led us astray from the ˹Right˺ Way
Why Ta'wil isnt an excuse is shown in Surah al A'raf 7:30
فَرِيقًا هَدَىٰ وَفَرِيقًا حَقَّ عَلَيْهِمُ ٱلضَّلَـٰلَةُ ۗ إِنَّهُمُ ٱتَّخَذُوا۟ ٱلشَّيَـٰطِينَ أَوْلِيَآءَ مِن دُونِ ٱللَّهِ وَيَحْسَبُونَ أَنَّهُم مُّهْتَدُونَ] ٣٠]
He has guided some, while others are destined to stray. They have taken devils as their masters instead of Allah-thinking they are ˹rightly˺ guided.
Hadith 32, 40 Hadith Qudsi
On the authority of Abu Hurayrah (may Allah be pleased with him), who said that the Messenger of Allah (ﷺ) said:
A man sinned greatly against himself, and when death came to him he charged his sons, saying: When I have died, burn me, then crush me and scatter [my ashes] into the sea, for, by Allah, if my Lord takes possession of me, He will punish me in a manner in which He has punished no one [else]. So they did that to him. Then He said to the earth: Produce what you have taken-and there he was! And He said to him: What induced you to do what you did? He said: Being afraid of You, O my Lord (or he said: Being frightened of You) and because of that He forgave him. It was related by Muslim (also by al-Bukhari, an-Nasa'i and Ibn Majah).
This hadith proofs that ignorance is a valid excuse for shirk.
