The ICC can`t, its governed by the Rome statue about who and what it can prosecute and terrorism is not currently included in that statute, there is work going on to amend the statute but at the moment the ICC doesn`t have the legal standing to issue a warrant for him as the Oct 7th attack was clearly an act of Terrorism.
