    Hello
    It always cracks me up watching these councillors who believe they can just tell the public to shut up and get out. They don't seem to understand they work for the public. They seem to think the public are there to serve them and pay for what ever the next stupid idea they come up with. Time to wake them up I'd say. Just imagine groups like yours going to every council public meeting over the whole country.

    Rachel I came across this fantastic book that I think would help in understanding the theory and concepts behind the principles of our Constitution. It was written by Lord John Somers, who just so happens to have been one of the co-authors of the Bill of Rights. It isn't written as a book but as short, and some not so short, numbered paragraphs, so you can dip into it as you like.
    [EDIT: Wouldn't allow the link, I'll post it on my site for you, if you remember.]
    I would say that if you understand every part of what is being said here then you pretty much understand our Constitution.
    "¶ 33. The same reason that obliges people to submit to governors and magistrates when they govern according to the laws and constitution of the country, and act for the good of the society, does as much oblige the people to oppose them, if they design their ruin and destruction; it cannot be supposed that God who has obliged mankind to preserve their lives, and consequently to use the means that are necessary to that end, should require people to suffer themselves to be destroyed, or made slaves, to gratify the lust or barbarity of any single person, or a few who are by nature their equals, and only above them by being in an office which the people erected for their own convenience."

      @@Successfulgardendesign You're more than welcome Rachel.
      It sounds like you're picking it up quicker than I did. The content of the book will confirm what you already know to be true about right and wrong, but with regards to the Constitutional principles at the root of the relationship between governing power and the governed. It demonstrates with examples from history and religious texts, the logic and reasoning behind the core principles that make our English Constitution what it is.
      It's no wonder that the present lot don't want us to know about it. 😉

      Lord Somers wrote other pamphlets too, one on Grand Juries. I haven't read it yet but the first two paragraphs follow a similar theme to his other pamphlet in describing the true nature of our Constitution:
      "THE Principal Ends of all Civil Government, and of Humane Society, were the Security of Mens Lives, Liberties and Properties, mutual Assistance, and Help, each unto other, and Provision for their common Benefit and Advantage; and where the Fundamental Laws and Constitution of any Government have been wisely adapted unto those Ends, such Countries and Kingdoms have increased in Virtue, Prowess, Wealth and Happiness, whilst others through the want of such excellent Constitutions, or neglect of preserving them, have been a Prey to the Pride, Lust and Cruelty of the most Potent, and the People have had no Assurance of Estates, Liberties or Lives, but from their Grace and Pleasure: They have been many times forced to welter in each others Blood in their Masters quarrel for Dominion, and at best they have served like Beasts of Burden, and by continual, base subserviency to their masters Vices, have lost all sense of true Religion, Virtue and Manhood.
      Our Ancestors have been famous in their Generations for Wisdom, Piety, and courage, in forming and preserving a Body of Laws to secure themselves and their Posterities from Slavery and Oppression, and to maintain their Native Freedoms; to be subject only to the Laws made by their own Consent in their general Assemblies, and to be put in Execution chiefly by themselves, their Officers and Assistants, to be guarded and defended from all Violence and Force, by their own Arms, kept in their own hands, and used at their own charge under their Princes Conduct; entrusting nevertheless an ample Power to their Kings, and other Magistrates, that they may may do all the Good, and enjoy all the Happiness that the largest Soul of man can honestly wish; and carefully providing such means of correcting and punishing their Ministers and Councillors, if they transgressed the Laws, that they might not dare to abuse or oppress the People, or design against their Freedom or Welfare."

    I was just re-watching and want to point out something fundamental regarding your comments about knowing our Rights. I'm in no way being critical of anything that you said, only to show something that is useful to know to gain a broader perspective.
    Parliament (nor the King) cannot give or bestow Rights, they can only legislate to restrict or diminish the exercising of those that we have. It's worth remembering also that legislation is not set in stone, meaning that it can be repealed or voided at any time. Therefore those Rights are always potentially there!
    We being "born of nature" are born with every right that Nature endows us with, but it's only because we are also born as members of a Society that some Rights have been, as I said, restricted or diminished for the "better running of Society".
    It's a fundamental common law principle that we are free to act at Will and by our own good judgement, providing that there is no law (or statute) to prevent it.
    “The absolute rights of man, considered as a free agent, endowed with discernment to know good from evil, and with power of choosing those measures which appear to him to be most desirable, are usually summed up in one general appellation, and denominated the natural liberty of mankind. This natural liberty consists properly in a power of acting as one thinks fit, without any restraint or control, unless by the law of nature: being a right inherent in us by birth, and one of the gifts of God to man at his creation, when he endued him with the faculty of free will. But every man, when he enters into society, gives up a part of his natural liberty, as the price of so valuable a purchase; and, in consideration of receiving the advantages of mutual commerce, obliges himself to conform to those laws, which the community has thought proper to establish.” - William Blackstone, Commentaries on the Laws of England, Book 1, Chapter 1, Of the Absolute Rights of Individuals.
    William Blackstone's words have been used to teach students of English Law, and in legal arguments, for centuries, so he is a good authoritative source for "persuasive" arguments it you need them.
    When you have the time it is highly recommended that you read through this chapter of this book because it details what the common law considers "Absolute Rights", rights that should not be encroached upon by anyone, regardless of their social status. It should go some way to helping you understand why the Law is our birthright, for what it protects.
    Hope that helps. 🤓

    • @Successfulgardendesign
      @Successfulgardendesign  Рік тому

      Thank you, yes that does help. I hadn't considered it in that way before, makes a lot of sense. I will hunt out the chapter you mention when I get a mo! :o)

      When I first read your comment I assumed you meant some of our rights have been diminished or restricted for a better running of society is covered by cause no harm, loss or injury to another. But are you saying we've given up more than that? If so, can you give me an example to help cement it in my brain? Thanks

    • @dizwell
      @dizwell 9 місяців тому

      He literally says that whilst natural rights exist, they can be surrendered 'in consideration of receiving the advantages of mutual commerce' and that laws and statutes are there to provide laws 'that the community has thought proper to establish'.
      He is not arguing that Parliament cannot abridge natural rights. He is saying that Parliament _may_ abridge natural rights in furtherance of a well-functioning society in which all may find benefit and profit. A very Whig viewpoint, but true nonetheless.
      So you are absolutely correct in your statement that 'we are free to act on our own good judgement... providing there is no law to prevent it'. Spot on: but it practically means we are _not_ free to act on our own judgement, which is a very good thing indeed!

    If Parliament cannot pass laws then why do you accept the Bill of Rights 1689? This was an Act passed by Parliament. Alternatively if only judges can pass laws please provide a citation for the case that the Bill of Rights came from

    • @LancePeatling
      @LancePeatling 10 місяців тому +2

      I do understand why this might lead to that sort of circular thinking - remember this is Rachel and her 10 minute take (as a relative novice) on what was and is both a simple and complex topic (sorry if that comes over as cryptic). Firstly, the Bill of Rights (alongside the 1st Act of Parliament, and the Coronation Oath, and later the Act of Settlement) are not Law. Peacekeepers would never suggest that they are. They are simply the authorising documents that kick of the whole thing. They effectively establish the rules of the game. They are also very restrictive. If you really need to understand what law is (by that I mean what it actually means then I would point you to my substack where the first 9 (brief) articles explore the whole topic in a digestible way - the last one is a bit of an eyeopener - even for me. The running order for the series is in the notes on the substack page itself - just do a free subscription.
      To the point about law is made beautifully in the bill of rights itself under article 13 - parliament may amend, strengthen and preserve it - at no point do their authorising documents state that they create it - that's the point - we make law in the courts and parliaments purpose (aside from resolution of our grievances) is to enact it as legislation. That, done properly in this way would give legislation the force of law. I trust that makes better sense of it all? just look for lancepeatling substack - lancepeatling.substack.com/
