In the Achmea Decision, the European Court of Justice effectively interdicted investment-treaty arbitration between Member States and investors from other Member States. In the years since that case, the European Commission has dutifully set about implementing that interdiction. Part of those efforts includes challenging the enforcement of arbitral awards from such arbitrations.
