Lawyer: *finds decisive evidence that the witness is lying* "will he get out now? There's no evidence that he's guilty." Judge: *well yes, but actually no*
Unfortunately, given the incentives of elected prosecutors and the quality of their average voter, our system is only as strong as jurors are independent, intellectually honest, and insightful.
That's the thing though. He *was* technically proven guilty in the first trial. The presumption of innocence flips then and now he has to prove he's not guilty.
Yea like wft there's supposed to be these things called innocent until proven guilty, and beyond a reasonable doubt. Neither were displayed here, in fact the opposite happened.
NO it's not. Once you are assumed guilty, the burden of proof is on the prosecution to provide evidence, sometimes that evidence is only a so called 'witness' (who COULD be lying). But it works like this (for an example) Hypothetically lets say, IF you are suspected of a crime, and enough evidence can be found/created/presented to arrest you (could be a witness on the spot), you are taken to jail to wait for a hearing. The taking to jail part is your fist clue you are guilty and must prove your innocents. Now they give you the information that they have that they are using to PROVE your guilt so YOU can PROVE it's not true in order to get out of jail. So, in actuality you must prove your innocence before you can be released. .. I want to add a couple of things I use to work on some years back.. to entertain one's thoughts. #1 is your Miranda Rights. I have asked many people including police officers if they "know" what their Miranda Rights mean. I had an officer of 12 years who was in trouble call me, I asked him the question during our conversation. Funny, but neither him nor any could answer, all they could do is recite them. they mean: You have the right to remain silent BECAUSE everything you say WILL be cut up and used against you in a court of law! Anything you SAY that they can use against you they will, anything you say that can be used as a defense is for your attorney to defend. And there were examples I used. If you had a court hearing on Monday at 8am but got into an accident on the way and was rushed to the hospital, then explained later to people of substance, "I was unable to make it because ..." the petitioning party will only tell the Judge "You said you were UNABLE to make it".. the rest is your defense. So the Judge is deceived. It would also be your job to notify the Judge they intentionally deceived the judge and then prove that. #2 NEVER EVER PLEAD "NO CONTEST". No Contest not a plead that can be appealed without EXTREME circumstances and you have 30 days to prove and 'request' an appeal, so.. a No contest plead is explained that you may NOT ever for any reason except proven extreme circumstances reversible and it IS used as a guilty plea. "Nolo Contendere" which translates as: you do not with to contend or argue against the complaint. In actuality you are stating to the court that you are incompetent (as a 2 year old child) to take a plea on your own, and therefore you are allowing the court to do so for you; which because of your own incompetence you will never appeal, because.. well.. you are incompetent. (that's not exactly what it means, but it is about the equivalence).
@@sandraamigliore7285 first, why did you write a whole dissertation about this, second guilty until proven innocent is a bad mindset, every person is innocent until they're found out to have done something guilty, having it the other way around is unfair, and has also caused cancel culture, where falsely accused people get called clowns on social media and assumed to be guilty of whatever they're being blamed for, until the truth comes out that they're innocent.
An actual aspiring lawyer wouldn't fall for a cartoon youtube video. This video, like so many others leaves out key facts and only nitpicks evidence they don't like. There is a lot more to this case. Even if the trial were started all over today I would have enough to convince the jury that he did it within the first 10 minutes.
Terrorism* And people wonder why people with a conscious laugh and smile when they hear that these terrorists and their "judge" counterparts get killed for what they are.
If you go to a group of scientists and say “THERE WERE ALIENS IN MY BACKYARD! I SAW THEM!” Saying you saw something absolutely does not make it true, and it’s so ridiculous that the court cares about witness testimonies.
I really dont remember who had said this, and I'm mostly paraphrasing, but they said, "Eye witness accounts are the weakest form of evidence in science, but the strongest in the court of law..."
Human society operates based on different principles than nature. In the real world it would be almost impossible to convict members of mafia/criminal organizations of something without witnesses/snitches. In America there is only 1 situation in which you are innocent until proven guilty, that is a wealthy, powerful, and very much white person with no priors, and maybe on a very rare occasion just plain lucky. If someone is missing any one of those traits or may a Supreme being help them if they're missing more than 1 of those traits, they will be considered guilty until proven innocent. The American justice system may have better living conditions than other countries but is a terrible system when it comes to providing "fair" trial...
Not really, it's innocent until proven guilty to a bunch of ordinary people who are conscripted to act as jury, and then you are guilty until you can prove your innocence unless a judge or governor realizes a gross miscarriage of justice and chooses to issue you a pardon.

isn’t it innocent until proven guilty, not the other way around?
Not after conviction. Then it is the other way around.
Yeah but Only for rapists 🙄
NO it's not. Once you are assumed guilty, the burden of proof is on the prosecution to provide evidence, sometimes that evidence is only a so called 'witness' (who COULD be lying). But it works like this (for an example)
Hypothetically lets say, IF you are suspected of a crime, and enough evidence can be found/created/presented to arrest you (could be a witness on the spot), you are taken to jail to wait for a hearing.
(that's not exactly what it means, but it is about the equivalence).

...After serving my time, I came back home to an eviction notice on my door and someone replaced me in the 1 of my 3 jobs that was paying most of my bills.
*... It's not about if you're innocent or not. It's about law enforcement and the court not willing to admit that they made a mistake.*

Our founding fathers would be ashamed of our justice system today. Especially the Texas justice system.
Chump Johnson they are turning and voting blue finally they can be fixed :)
Pfffff... Have you seen the Brazil justice system yet??
@@marcov8796 I doubt a change in politics would do anything meaningful or substantial.
i know scared games s2 was right.
What's is wrong with the texas system?
The system kept him in jail even though they knew he was innocent, but didn’t even scentance a person for one year after lying about being a witness for money benefits?
We need people who are going to go through the federal government with in order to say you can break this innocent men out of prison, and I am for doing it. Yes we need to get guns against the guards if their dishonest slap smear on those decides Need to get kicked in the head one with the help of Uncle Sam the United States government that is, in yes we have a duty to fight for somebody civil rights, because that was the absolute violation And if it means were gonna have to do things like vandalise prisons to get people like that out with the help of the US Government Then we will do that halili!
@Game Plays 1230 Just because we live in America doesn't it makes it my country
The thing is if that was a law she just wouldn’t have admitted to lying and probably would’ve just stayed silent

Me: YES VERY MUCH YES
Yep
Yep definetely
U.S.: 10yrs for treason and lack of respect to the American government
The system is a joke because jokesters make the laws and clowns enact the judgments.
Next thing we know echo2407 is caught in the "system"
Those who lie and ruins someone’s life should been sentenced to life. If you take time out of someone’s life for a crime they didn’t commit you should have your life taken
ur spitting facts rn
I wouldn’t say death, but I would say they should get the amount of time the same amount of time the “criminal” got
most people that lie was most likely forced by the police.
Facts!!!
For real.
In finland if you are found innocent you get paid for all of those lost years in prison.
Same in most countries
Who cares about money when you lose your life
AEplays That’s because Finland is a just county!
AEplays which is probably why this man never got a new trial if he got a chance to prove he’s innocent they’d have to pay him but if you stall the trial untill he’s dead
@@remxdy9342 Exactly time is money so why would you have to lose the prime years of your life for a few thousand
I love how they put him in jail for almost no evidence, and even after all that evidence is debunked, they wouldn't let him out, and the reason is he can't prove it.
That's exactly why they offered him 5 years if he admits he is guilty, the government just doesn't wanna pay for the wrongful conviction.
Yet city councils will drop hundreds of millions into stadiums.
That witness who lied about Spencer should be on life sentence.
@Abdul Jalloh , YAHWEH EL ELOHIM knows all.
Yeah
Yes, sadly the statute of limitations and the difficulty to prove perjury makes prosecuting her impossible.
Judges: well he’s probably innocent buuuut we can’t prove it so.
Everyone else: *but you can’t prove he’s guilty either*

Didn't the prisons get money per prisoners?

This video got me soo triggered. This also proves that our justice is kind of bs.
We shouldn’t support the American police or government
*Spencer's special ability: Suicide*
I mean...at this point the real meaning of Justice is "the Impossibility"
@H La Create a better system? You don't have to. Just swallow your pride that American must be the pioneer of everything, and learn something from other countries, especially northern europe ones...
I too am dealing with a corrupt justice system in Pa. I served almost five years for misdemeanor s and came home to relentless harassment. Constant and ongoing. This justice system is nothing but a corrupt money hungry machine anymore.
We gotta break spencer out, they can’t stop all of us

If he took the 5 years, he woulda served, got out and had the conviction an probably never proved his innocence
Its amazing how they needed no physical evidence to convict him but so much evidence to prove his innocence .
If he took 5 years, he would have 'jail experience' (I don't know how to name it) so it would be difficult to find a job.

When the crime happened, people were innocent until proven guilty.
In todays age, you are guilty until proven innocent.
That female "witness" deserves jail time, and deserves it more than Spencer.
watch because she is woman, she gets an hour in jail as opposed to 28 years+

@@aceshadowins1310 i think you should look at the sarcasm in my comment.
Used to be, but now is guilty until proven innocent unfortunately...
Not really, in my country the law principle is more like "we prefer to let the criminal run free rather than putting an innocent people in jail". So the plaintiff is actually the one with the burden to prove his claim/statement.
