QUESTION: Can a private student loan garnish my retirement (IRA, 401k, pension) when I retire?
Private student loans can take money out of your bank account after they sue you and get a court order allowing them to do so. Until then, they can't forcefully take money from any source.

Honestly these are horrible options pushing regular law abiding citizens back against the wall. I’ll never forget reading online about someone that left the country and became a drug dealer who paid off their student loans. This is a horrible situation for Americans.
Is it worth it to file an adversary proceeding on a previous Chapter 7 bankruptcy, from about 7 years ago? Does it make sense if you are in the income repayment plan with a very low payment? I am moving to the Philippine's for ministry, and not sure how long I will be there.
It really depends. If you're comfortable your plan, then maybe it's not worth it to you.

It depends. Some attorneys charge a lot less. I charge a lot more. My cases typically range between $8-20k. It's a lot of work to do it right.
