I found out my aunt (dad’s sister) had severe Alzheimer’s when she passed recently. I didn’t know anyone in my family had ever had it. I don’t know about uncles, as they passed at early ages from heart disease & diabetes

in the UK at least you are presumed to retain capacity to make such a decision until the time that you are deemed to lack capacity, usually by a Dr or a consultant. Even if you know someone clearly cannot make that decision, until it is medically confirmed they can. It’s a very difficult issue.

@@Laure__LineI don’t know all the details since I haven’t ever been involved in any inheritance type stuff but here are the things I know in the US: -when you set up things like life insurance or retirement funds, you select beneficiaries for when you die. So if she hasnt gone through all his paperwork (which it sounds like she wouldn’t know how to do anyway) all of that will go to the kids most likely with his first wife dead. -things that aren’t lined out when you set them up, like money in a plain ol’ bank account or physical assets like properties and valuable items, can go one of two ways. If someone sets up a will and testament (which he probably did as an old guy with money) that will trump everything else and all the items and money will get sorted out according to that. If you don’t have a will, that stuff will first be used by the government to settle debts and then anything left over gets split up between living spouses and children. How it’s split up I think depends on your state.
@Laure__Line Yhe children don't inherit everything if there is a surviving spouse in France, the spouse would retain their half of the community property and at least 1/4 of the decedent's estate. In the US it depends on the state law, if the surviving spouse is the mother or father of the deceased spouse's children then it is typical for the estate to go to entirely to the spouse, but if the children are from a previous marriage then the children and spouse split it. Arkansas is much closer to French law, where the spouse would get at least 1/3.

-when you set up things like life insurance or retirement funds, you select beneficiaries for when you die. So if she hasnt gone through all his paperwork (which it sounds like she wouldn’t know how to do anyway) all of that will go to the kids most likely with his first wife dead.
-things that aren’t lined out when you set them up, like money in a plain ol’ bank account or physical assets like properties and valuable items, can go one of two ways. If someone sets up a will and testament (which he probably did as an old guy with money) that will trump everything else and all the items and money will get sorted out according to that. If you don’t have a will, that stuff will first be used by the government to settle debts and then anything left over gets split up between living spouses and children. How it’s split up I think depends on your state.
