Are Digital Downloads Subject to Sales Tax?

A viewer asked if digital downloads are subject to sales or use tax. There is an answer but it depends on where the seller is, where she has nexus, and the tax rules of each jurisdiction in which she has nexus.
For various reasons, we rarely discuss taxability on this channel. The field is very dynamic and there are a lot of variables that can affect whether something is taxable.
We can provide you a tip that can maybe short circuit some of your taxability questions. If you don't have nexus in a jurisdiction, you are not required to know their tax rules. But, you have to determine if you have nexus (i.e. a presence) in the jurisdiction, first! If you have a physical presence or meet applicable economic thresholds, you have nexus. Then you have to concern yourself with determining the correct taxability of a transaction.
