If me and my fiance are not married but we close in 2 weeks.. can we put the vesting as husband and wife under community property with rights of survivorship? I ultimately want to put our home into a trust.. thanks

My siblings and I inherited property through intestate probate. We refinanced and paid siblings out and then two of us ended up on title. Nobody asked us how we wanted to hold title. It’s as joint tenants. We’re both married and have kids. I would like to change title to eventually leave to my kids. How do I do this with out triggering a reassessment. Honestly we were just clueless.
Excellent explanation! So, with the 75 year old woman with Rico Suave situation what's the recommended way for her to take title? Sole Ownership? If so, is that allowed if she's married to Rico Suave? If it is allowed, then I assume the woman would then transfer the Sole Ownership title into a Trust?

My document says ... 1. Sole and Separate; Spouse’s name_______________ (if an individual is married and acquiring title as his/her sole and separate property, we will require a “Spousal Deed” from the spouse.) 2. Single Man 3. Unmarried Man I’ve never been married and I don’t plan on ever getting legally married so I’m thinking I should go with “Sole and Separate” 1. option, but I’m not sure... can I get some feedback?

If I go with Community property with right of survivorship upon death will my wife have to pay tax on the price I bought my home for and whatever the value is upon my death. How come the Government doesn’t look at the gain as a gift? Thank you!
