      I see, so he not only did this small businessman who served the environment by saving functional PCs from the trash bin while giving middle to low income people an opportunity to own an affordable PC, he went through great efforts at providing customers the .50'cent factory reinstallation CD that the massive OEM corporations USED TO PROVIDE BUT STOPPED, quite obviously a industry-wide strategy not merely aimed at cutting cost but shortening the product lifespan as owners frustrated with an inoperative, infected system and no immediate means of repair would likely buy a new PC.

      Because they prefer to use 10% of your hard drive space on a "restore partition" instead. You buy a computer advertised as having 500GB of storage but in reality the drive manufacturer lied to you and you got 460GB instead and the computer comes pre-loaded with software and operating system, that's 400GB free now. Except 40GB had been used for the restore partition. enjoy your 360GB of storage.

      @@FrankoBurolo That's not true... Microsoft website has windows 8,8.1 & 10 as freeware... Like Rossman pointed out, the value is in the license, not the software.
      A long time ago i built a PC, when Win 8 & 8.1 came out, I downloaded windows, which is free on the Microsoft website.
      Freeware license last for 30 days. After 30 days, windows automatically shuts down ur PC. U turn it back on & u have 1 hr to keep using it until ur PC turns off again. U download it & u will see a windows freeware watermark.

      @@HipHopHead187 re-check the definitions. Freeware (not to be confused with Free Software) is GRATIS software. If you have to pay for a license, or else it expires, it is not freeware. And that's exactly the case with Windows - if you don't have a (usually paid for) license, it expires. It is not freeware. Much less free software.

      quick FYI, windows is free, with some disadvantages. the free version does not let you personalize themes and other stuff related to visuals, keeps that Activate Windows watermark always on the bottom right corner of your screen, you cant use microsoft office and it only offers updates crucial to the system like windows defender updates. it is free, but if you want the whole premium package where you can do basically "everything" you want you have to buy a license and that costs money. here is the microsoft link to windows 10 download page: www.microsoft.com/en-us/software-download/windows10

      A Judge doesn't need to know about the intricacies of technology, that's the role of an expert witness who is independent and unbiased to either party to present to the Judge the facts. The Judge then apply law as it applies to the case.

    If he'd been providing a way to circumvent Microsoft's licence key then it would have been an issue, but I don't regard what he was doing as being a crime, since the files were useless without the end user having a valid licence key. I do however regard Microsoft's lawyers manipulation of the justice system as highly inappropriate. Particularly if they have deliberately misled an elderly judge, exploiting his lack of understanding of technology. That in itself requires investigation.

      This video gave me a scare for no reason. The title of the video was misleading and the argument gave was also biased. Simply put, if a company were to make a website link for a software that people can download for free, it does NOT give a person the right to copy and burn onto a disc to be sold to the anyone regardless of how useless this particular software is. This website is the goodwill of the company and the price of this software is pointless to even address, since it is WRONG to download and sell for personal gain. Nonetheless, regarding the pricing of the software disc, yes, though the selling price of 25 cents is pretty much the price of a disc, the focus here should NOT be what is the cheapest you can get for this disc. Have you not gone through a claim with the auto insurance, in which you were the victim with no fault, and the insurance company simply want you to get an estimate for the damage incurred? You could go out of your way and repair the entire vehicle yourself (if you know what you're doing) and just send the invoice price of the parts to the insurance company as your estimate. However, in some cases, it could just be your neighborhood auto body shop, and the insurance company will honor the estimate regardless of how much cheaper another shop could offer to fix it. The 20 dollars, the lawyer argued, for the software disc could just be the price enough people are willing to pay to avoid the hassle themselves. How little you, as an individual, are willing to pay for this software disc is inconsequential. It is how much the company who was wronged could POSSIBLY receive for the disc that is the determining factor here. It is subjective, but it could be argued. Anyways, this video is not helping your cause in a positive way. Nevertheless, keep on fighting, i do respect your effort.

      My great great grandmother is 114 and lives in a nursing home the year before last we got her an iPad. She literally cries when she talks about it. She says it changed her life. She'll sit there for hours showing you things on it. She's got everything from old newspaper articles to pictures of the Vatican museum. She knows more about that iPad than any of her great great grandchildren. There's another generation on the way and we hope she gets to meet her great great great granddaughter. Don't ever say older people can't learn how to use technology.

You appear to believe that your great great grandmother is the rule. She's not. I regularly deal with tech issues for older people. Most of *them* believe that they can't learn, or do not want to learn, which amounts to the same thing as being incapable of learning.
      Hell, I'd even go so far as to suggest that if she knows more about her iPad than any of her great great grandchildren, her great great grandchildren clearly don't know much of anything at all about them.

Older people (typically), just aren't interested in it enough to put forth the time to learn it and then they blame the world around them that they don't know this new stuff. they just need to invest a little bit of time learn how to use Google and figure it tf out. If you're illiterate, and have access to the internet, you can figure it out by yourself. Google isn't difficult. I'm not saying they need to learn to code, but having functional knowledge of technology isn't asking too much, if you think so, then maybe you are saying old people are just stupid. You think whatever you want. Also, we don't use Apple products, because yuck. We just got her the iPad because it's simpler.

      Correct, it's actually an OEM Manufacturer License key, which is common with either the batch of PCs or the entire OEM Brand. For example I remember a Freeware Windows Restore image was available and allowed you to select the specific brand of the Computer you wish to restore; Asus, Acer, Samsung, Dell, HP etc etc. The License key was mostly even a common activation key, which means thousands of the same branded PCs used.

      brand and load that version complete with Lenovo or Dell or Compaq logos and
      wallpaper. There is NO reason a 50 cent DVD cannot be tossed into the packet

    In front of a judge born in 1943, Eric used the words "freeware" and "licensed key", Microsoft's lawyers used the words "counterfeit" and "illicit".       Sounds like an independent agency is needed to audit such cases and overturn such complete nonsense in the legal system. Millions of people would agree that what has been going on is wrong, so the legal system must allow for public overturn of nonsensual verdicts. This is highly necessary for a well functioning democracy (which most of the world unfortunately isn't).

I like Louis and think he brings a useful perspective to most issues, but I am wondering if there's more to the story than he either knows or is reporting. No argument that the way this sounds right now is very bad, but I'd want more information before I condemned the decision here.

    He lost the appeal? I can't believe that. Such a miscarriage of justice. He got sent to jail based on false testimony and ignorance. This is the issue we face when we have old baby boomers making tech laws and ruling on cases involving things like Facebook and Microsoft products.

      This is all the more obvious when you look at the Zuckerberg hearing, where it seems like only a handful of the senators seemed to have any clue how Facebook or computers actually worked. Several of them asked for FB to add features it already had.

      Here's the thing, I though the same thing when I first read the headline and a little of the story. However, after reading everything, the government has some legitimate arguments. His issue is that he had the discs faithfully reproduced, including the Microsoft logos. That was his mistake and why this was counterfeiting and not just a case of someone trying to help the community. And he very obviously recreated the discs with the printing and logos because he was trying to sell them for a profit. Everyone is trying to say he was selling them for $0.25, and that was what he said in court, but in his written official response he claims he was selling them for $4 a piece. So what is true? Well, more likely his cost was $0.25 per disc, and he was selling each disc for a pretty nice profit. The $0.25 that is quoted in this video, and most of the news articles, is not accurate. it is not what he was selling them for, he was selling them for $4 each. On top of that, the software on these discs is available for totally free online. If he cared, he'd tell people how to find the downloads, not charge them $4 for a disc.
      Now, Microsoft is wrong in claiming the disc is the valued part and the license isn't. BUT IT NEEDS TO BE MADE CLEAR THAT MICROSOFT IS NOT THE ONE'S SENDING HIM TO JAIL! The federal government intercepted a shipment of his counterfeit dics, the ones where he took the originals that he bought and sent them to china/india to be completely reproduced label and all. The federal government is the ones prosecuting him, they simply asked Microsoft to a witness to help put a value to the discs. Louis attacking Microsoft like it is them that is prosecuting Eric is just another example of Louis being negative anti-business Louis.
      And, again, Louis' video focuses on one judge. The appeal court consisted of 3 judges! Not a single old judge, but 3 separate younger judges.
      But Eric Lundgren is far from guilt free. Eric Lundgren PLEADED GUILTY! HE. PLEADED. GUILTY.

      If it's shot down by the 9th circuit court, Supreme court is less likely to want to contest it. Worse, Supreme court trials are crazy expensive. Low average 300k USD and it goes up from there i've heard.

    I agree this case SHOULD be called a mistrial due to unfair, misinformed (or uninformed) Judge.
    We are now in the age of "the user is the product", we, as consumers are bought and sold time and time again. We are living in a continuous commercial that keeps us in a continuing buying cycle. Making products that lock the end user out, forcing them to seek only "authorized repair centers" (monopolizing the repair of that particular item), making the authorized repair centers not easily accessible to everyone and having repair cost close to the cost of a new device, keeps the cycle of consumers (us, the product) on the continued buying cycle and their sales and profits on the rise. It's a sad, sad trend
    I often wonder why no-one is questioning why "we", the end user, whose information is being sold for profit, why "we" don't get a portion of the proceeds? Isn't that "my" information, "my" identity, "my" brand"....Where is "our" share of that money? It's "My" product ....Where do we go to file a "cease and desist order" for places selling "me".
    Which brings to mind ...we are all being put into human trafficking...it may not be our physical bodies being trafficked, but it is "our" names, identities, likes, habits....all of which are unique to us as an individual.

    i work for an e-waste recycling company... and the hoops we've jump through to please Microsoft is ridiculous.
    very early on ( ~ 6 years ago ), we were contacted stating that we were not even allowed to MENTION if the computer even had a COA on it.
    not allowed to re-install the OS either; not even allowed to sell a computer with a windows OS installed on it.
    we CANT EVEN GIVE AWAY!!! computers with a windows OS installed on it.
    instead we have to BUY a $40 REFURB LICENSE, to DONATE COMPUTERS to CHARITIES!
    believe it or not, microsoft openly charges EXTRA to charities for reinstalling DONATED computers; there is a whole section for it in their refurb partnership program.

    Someone born in the 50s (my grandmother) doesn't know the difference between Linux Mint and Windows 10. My Uncle Tom built the PC that my grandmother used for the last 4 years, and he included Linux Mint. She later bought an HP laptop with Windows 10, and somehow didn't see a difference.

      @tg deen I use linux and I agree the incompatibility of software is a huge pain in the ass. but more and ore software is being made for linux and if I were in your shoes I would start using linux and open source alternatives like blender and stuff. for everything else I would use a VM like virtual box or qemu, there is a small performance hit, but that's the price of freedom I guess.

Hi Louis, I was born in 1942, I have been involved with electronics for most of my life, I have been a Microsoft Beta tester for over 10 years, now called Microsoft Insiders, as you will know Windows computers have been digitally signed for a few years so they no longer have a COA label. If someone wants to replace the HDD or change to an SSD and they don't need any data off the original drive or maybe it has been rendered unreadable, all they need to do is download Microsoft's MediaCreationTool on another computer download a legal copy onto a USB Memory Stick, put it into the computer with the new SSD reboot and when it has finished the first time it connects to Microsoft it will re-activate legally..
    BTW I watch all your UA-cam and Twitch Videos, I have learnt so much about smd soldering techniques from you, so much that I now own enough equipment to do my own smd work.. I am not interested in repairing mobile phones.

      Hi, I had been running XP for many years, I was asked to test Vista sometime in 2006 before its release in 2007, like most early Beta versions I had lots of the dreaded BSOD also no drivers for many peripherals, I was asked by my Radio Ham friends should they upgrade to Vista, I told them not to bother and to stick wit XP. At the time I was still running XP as my main OS, I never really used it as my main OS, it was too unstable. BTW support for Vista ran out April 11 2017..

      The license for windows transfers if the computer changes ownership, however it is not transferable to resellers and refurbishers. If they want to take your PC and fix it the license is yours the whole time. If they buy it off you to resell the license does not transfer, and the refurbisher/reseller is required to pay $25 for a new license. I think Lundgren would have a case if he didn't plead guilty that the refurbishers were the ones breaking the law, because I believe they could also have had legitimate uses for them such as repairing a computer and returning it to a customer. I'm not sure that Microsoft would be able to prove that though without tracking down every PC and checking the license and chain of ownership so they went with the easier case. Unfortunately, thinking he had it in the bag, Lundgren pleaded guilty but argued the value of the CDs was 0, however he was shipping them to people who could not legally use the free downloads to resell a PC. It's a gray area.

      @@centralintelligenceagency9003 You don't have to enter your password every time to get elevated permissions if you change the setting. You can change Windows to make you enter your password every time you need administrator permissions, the difference between the two is just out-of-box default settings. And installing software on Linux is much easier than on Windows. You can use GUI to install any software, it's just that most people prefer Terminal because it is better once you learn it. You mentioned apt. Linux distributions that have apt also have a GUI package manager called Synaptic. I would suggest using Mint or POP!_OS for you. The things you said about GNU/Linux were valid 5 years ago. r/linux4noobs if you need help.

      Central Intelligence Agency I just put linux on a new hard drive I got for my desktop. Took me 15 minutes to download the OS, make the USB installer (which is real easy if you google it, Rufus has a GUI), AND install it on the drive. And then I was able to install steam without even opening a web browser by as you said typing “sudo apt install steam”, although this could’ve been done with a GUI if you prefer. The reason it asks for the password all the time is security, permissions, and keeping you from accidentally doing something really bad. Some of these security features you can tone down, so it won’t ask for your password so often if you really want.
      Do you not use gmail because google is neurotic about logging into a new device?

He won't believe it because he trusts Microsoft because they're world famous, and in the eyes of a senior, that's all you need for trust. We live in a dark world.

    I know really old people that can easily explain the difference between the repair disk and an actual licence.     A lot of comments are saying that he did indeed do something wrong by using their logo. To be clear, I acknowledge at 9:35 in the video that there is an argument to be made that the use of the manufacturer logos is incorrect, and that a punishment could be issued for that. I don't hide this at all.
    The valuation of the disc by itself at an equal dollar amount to the disc + product key/license, and issuing punishment based on that assumption is where this turns to shit. This is what I claim he is innocent of, and I believe I am correct in stating that fact.
    He never distributed something of equal value to a product key. The sentence of 15 months was given **with the context that the value of the CD was worth far more than it actually was.** The system's failure to distinguish the issue of him using a logo that wasn't his with the issue of distributing product keys/software licenses is a troubling one.
    Microsoft's willingness to have their attorneys and expert **lie to a judge about the value of these products** is an issue, as is the judge's **sentencing him based on an inaccurate lie.** Even if you think what Eric did was wrong, even if you dislike his character, the punishment should be based on the crime he committed, and not a made up one. If they are willing to make up a crime to prosecute him and you don't defend him because you disagree with him - someday, it will happen to you.
    **TL;DR - rake him over the coals for the misdeeds he took part in, not for the made up ones.**

      You forgot something: windows has now a Media Creation tool that downloads windows 10 to your pc and then you can burn or write to a usb disk to make it installable, also that had Microsoft Digital River (if I remember correctly) where ALL the windows ISO's since W7 are on, just download burn to disk or stick and isntall your copy of windows (You need a key)

      yep he sold a fucking C.D.R and the data on it was freeware, its a joke and the judges are too dumb to understand.
      basically Microsoft want everyone to buy a new OEM or retail license and not reuse one from a dead PC (a license that has already been paid for and guy is only charging money for the disc)

    I once fixed a laptop someone dumped at Goodwill, they picked it up for $20. All I had to do is a simple format and reinstall windows. It's amazing how some people will just toss out a perfectly good system because they don't understand how to do this.

      Don't be an idiot. They never claimed to be any expert. They were only speaking about one part of most peoples' lack of computer knowledge and how he was able to very easily fix one problem with computers. Don't be a dick.
      And most (even knowledged) people can't fix complex hardware issues unless they 1. designed the product, 2. know how the product works, 3. know how to replace the faulty parts. Most 'tech' people just send the faulty products to the manufacturer to get it repaired or replaced.

      nambinhvu That's not particularly true. There is a factor of cost in relation to benefits. If you buy a broken laptop for 20 dollars that is worth 100 dollars in working order, and the process of fixing it would take a dozen hours and several hundred dollars worth of hardware... You would be a moron to repair it, regardless of whether you know how. I personally will fix anything and everything that breaks, so long as the cost of materials does not outweigh the cost to buy a functioning replacement outright. This is true even when the amount of time spent repairing might ultimately not be worth my time. This is because it is also a very relaxing hobby, and it gives great purpose and joy to the person doing the repairing, very similar to the act of creation that brings so much joy to craftsmen. I can admit to having spent stupid amounts of time fixing things that I really should have just gone out and replaced. It's quite a lot of fun googling things, seeking tutorials, hunting for schematics, and doing something you have never done before, especially when you succeed.

      Yeah. Nailed it. By leaving out that the guy was sentenced for trademark infringement. He put protected logos on these disks he had no business putting on there... If those CDs said "Good Guy Windows Repair Disk" nothing would have happened, but he put everything from the Dell Logo to the Windows Logo on there...

      Daniel Lopez Technically, he sold a physical medium that contained the software to people who for whatever reason weren't going to download it themselves. Supposedly, he was selling them for like $5 or something, which is a bit much unless you have to put a bit into manufacture & distribution. Then it about evens out.
      It would have helped his case if he'd had links to official downloads on his business site or something.

      "fake Windows disks" ... they literally give you the tools to do so. Type in "Media Creation Tool"; it's a tool created and distributed by M.S for free that's sole purpose it to allow you to create restore disks. It is useless if you don't own a license however

      OMG, another person who doesn't understand guns, commenting on guns. There is no such thing as an assault rifle, it's just a damn rifle, it doesn't matter what it looks like. There are several other rifles that use the same exact ammunition, that other gun ignorant people would not consider to be "assault " rifles.
      Furthermore, If you go to a store and buy a gun, more than your driver's license is required... You have to fill out a federal form, the dealer calls a specific branch of the FBI, who do a background check and decides whether or not you can have a firearm. This happens at EVERY SINGLE STORE WHO SELLS FIREARMS IN THE ENTIRE UNITED STATES.

    I guess one way of doing the same thing is to setup a computer in a store with instruction on how to download the legal image and burn it and then charge for it after the customer has burned the disc. I don't like the way manufacturers are heading these days. Repairshops exists because people are not interested in purchasing official repairs which in many cases would be the same as buying a new device. It's so great that you point this out, so people can see why they should stay away from these companies
