Never rely on home inspectors unless they are insured. When they miss something, you have recourse to sue them and get money from any errors and omission insurance covering them. Otherwise, you are going after someone with no assests of wages to garnish.

What if the seller went back to India ? How could you recover from him knowing that it will be almost impossible to chase him in another country, especially if that country doesn't have any laws about that ?

Defects must be declared as in common law is they could reasonably be known by the seller. I have done this in BC and won the small claim court case with no lawyer being under $35,000
patent defects are obvious and are typically discovered during an inspection of the property, latent defects are hidden. In this case it seems to be a latent defect and the seller is liable for all remediation costs plus lawyer fees.

"As is" clause needs to states in the purchase agreement but probably is not stated as "sold as is"

Latent defects must be disclosed and if not the seller is liable within seven years after the sale. Just because a sale has gone through does not mean the seller can get away with known defects.
