      You have got to be kidding? Trump has a target on his back that’s obviously the case. However the democrats in the White House have now set a precedent. The FBI and DOJ have tried for 6 years. After a while you have to ask yourself how and why?

      Or less. I got denied a job because I was self-employed for awhile and couldn’t provide conventional paperwork for their background check. I had multiple clients rather than one employer.

      It's that way for a president in case the opposing party sets a candidate up the ppl can still speak up and vote for who they want. Our forefathers understood that ppl in office may use their position to try and stop someone from being elected. They're doing the opposite. They're setting him up for the win even if convicted

      Passive is the right to run for an office and being elected.

    Could it be argued that although current law does not disqualify Trump from running for President, there are other laws prohibiting candidates running for Congress if found guilty of federal crimes. Can parallels be made in a legal argument that would apply equally to Trump? The current interpretation that a person could serve as President from jail is patently absurd and needs to be rewritten and coded into law that clearly disqualifies anyone from running for President who is guilty of a federal or state crime.

    We are in a Constitutional crisis and we should have seen this coming. For most of our existence as a nation there were legal boundaries and there were moral and ethical boundaries that, for the most part, pols from all parties agreed to follow even though it wasn't, strictly, a legal requirement. Our founding fathers could not imagine a party that has no shame, no moral or ethical boundaries, no problem shattering a long-standing self-prohibition to not do certain things. That they do all that and act with indignation when they 'suspect' the other side might be doing what they ARE doing.

    Not entirely true. While he is currently only charged with the Classified documents under the Espionage act, were he to be charged with the simple possession of records belonging under the presidential records act, he could not serve as president or anywhere else in the federal government - Concealment, Removal, or Mutilation of Records
    (18 U.S.C. § 2071)
    (a) Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both.
    (b) Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.

    I think Donald would drop out of the Presidential race if all the charges against him were dropped. Unfortunately for him, that's not an option because the Manhattan hush money case was always awaiting him even if he didn't try to overturn the 2020 Election results. In fact, that's one of the main reasons that January 6 even happened in the first place; Donald was desperately trying to stay in office so that he wouldn't have to face those criminal charges in Manhattan

    What everyone seems to forget is the fact that even if Trump *is* elected again, and he's already in prison, he's "incapacitated," meaning the Vice President is the one with Executive power and could enact the 25th Amendment to make themselves President.

      In many states you can't vote in jail or while on probation or parole. I.e. you can't vote yourself.

    Aside from Eugene Debs running for President from a prison cell, there was also a Congressman from Wisconsin in the early 1900's named Victor Berger who won election to Congress *twice* but the House refused to seat him both times because he was under indictment for, and later convicted of, supposedly violating the Sedition act during WWI (he spoke out against America's involvement in the war). His conviction was overturned by the Supreme Court on free-speech grounds, and he went on to win several more elections and did serve several terms. Like Eugene Debs, Berger's "crime" in the eyes of our politucal system appears to be that he was a Socialist; and like Debs, he was a man of strong principles.

    While there aren't laws barring a criminal from running for office, there also isn't a legal mechanism to release him if he did win the popular vote. I would assume that the electoral college would ensure that the States votes went to someone who wasn't imprisoned.
