    Our caller, Michael recently got into trouble with the North Carolina Board of Surveying. And, for what? Believe it or not, Michael was just trying to create some drone maps for progression reporting. Do you really need a surveying license to create drone maps? We clarify what you CAN do and CANNOT do as a drone mapper without a surveying license.

    And btw, at 23:41, You nailed it. I did discover that this is exactly what happened. I placed an ad for a survey company to work with them on a job I was going to bid on... that was requiring drone pilots but they also required that you had a Licensed Surveyor. He answered the ad, we spoke, I explained to him I wasn't a surveyor, and that I was wanting to bid on a job that required one, so I was looking to partner with one. He seemed very nice and that he understood what I was asking. Turns out, he did exactly what you said here...went 100% protective mode and turned me in accusing me of "Practicing without a surveyor's license." Friend of mine that he didn't know happen to be in a shop he was in the other day, and this guy was unaware that the other guy was my friend, and went to blabbing. Same day you made this podcast, I shared it. and my friend called me and said..."Thats so crazy you posted this, because I just was in this shop and mentioned your name and this guy started going off about how what you were doing was illegal and there was going to be something said about it and I was going to get in trouble." LOL. Crazy!

      Research your state board and see what what services requires licensing. I'm guessing this job required a licensed surveyor and your state board requires the work to be done under the responsible charge of a licensed surveyor, which means an employee working under the surveyor and not a sub contractor. Usually it's mapping used for engineering design that requires a licensed surveyor. Mapping for construction progress or volume reports would not require a licensed surveyor.

    As a survey tech who has plenty of field injuries, stings, cuts, ticks, mosquitos, machete close calls, snakes, freezing, heat, wet…. Falls. The health and safety of the survey field guy far exceeds the risk the public faces from this question. It should be an OSHA conversation as well. Drone technology is the evolution for the greater good of survey and mapping.

    We produce videos for real estate agents and on occasion, we will mark the "boundaries" of a property with 3-D tracking imagery in After Effects. We include a disclaimer statement in the video stating that the lines are for informational purposes only and cannot be considered as survey lines or used for legal purposes. The disclaimer states to reference the legal land survey. I know you all are not attorneys, and will not hold any comments as legal advice, but I wondered if you could comment on this practice.

      I do this as well because I'm aware I'm not a licensed surveyor nor am I trying to be one. But including informational boundaries to give them a snapshot is helpful for realtors and clients. Like the OP said, is this practice acceptable with the disclaimer? We're not trying to push any boundaries with surveyors FYI (see what I did there?)

    40 years in the business, 30 of it licensed, 35 years involved in the state organization .... and I don't see the problem as long as you don't locate monuments(or at least not state their veracity), or show accurate boundary information ... such as stating that 6" from a wall.

    North Carolina does appear to have an overly broad definition for the practice of land surveying. Drone mapping should require a licensed surveyor when that mapping is to be used for engineering design and that mapping should be done under the responsible charge of a licensed surveyor, which means an employee, not a contractor. This is a point that Paul does not get. Paul calls them minions and lackeys, but those minions and lackeys are UNDER the responsible charge of the licensed surveyor. This is how one becomes a licensed surveyor, you have to work under a licensed surveyor. That said, if the mapping is for construction progress or volume measurements, it should not require a licensed surveyor. But North Carolina appears to require a licensed surveyor for even that type of work.
    Paul has found surveyors to sign off on drone mapping that he created, but I bet that surveyor is breaking their state code somewhere by signing off on data that was created NOT under the surveyors responsible charge. Beware of your state code before you go and spend big bucks on all the required equipment.
    What Paul says at 8:02 is not correct, there are regulations that prevents one from providing topographic mapping from drone mapping in North Carolina. (Paul is creating a strawman by equating stitching pictures to providing topographic mapping.) North Carolina does regulate more than just measurements of property lines.
    Here is North Carolina's overly broad definition for the practice of land surveying:
    § 89C-3. Definitions.
    (7) Practice of land surveying. -
    a. Providing professional services such as consultation, investigation, testimony, evaluation, planning, mapping, assembling, and interpreting reliable scientific measurements and information relative to the location, size, shape, or physical features of the earth, improvements on the earth, the space above the earth, or any part of the earth, whether the gathering of information for the providing of these services is accomplished by conventional ground measurements, by aerial photography, by global positioning via satellites, or by a combination of any of these methods, and the utilization and development of these facts and interpretations into an orderly survey map, plan, report, description, or project. The practice of land surveying includes the following:
    1. Locating, relocating, establishing, laying out, or retracing any property line, easement, or boundary of any tract of land;
    2. Locating, relocating, establishing, or laying out the alignment or elevation of any of the fixed works embraced within the practice of professional engineering;
    3. Making any survey for the subdivision of any tract of land, including the topography, alignment and grades of streets and incidental drainage within the subdivision, and the preparation and perpetuation of maps, record plats, field note records, and property descriptions that represent these surveys;
    4. Determining, by the use of the principles of land surveying, the position for any survey monument or reference point, or setting, resetting, or replacing any survey monument or reference point;
    5. Determining the configuration or contour of the earth's surface or the position of fixed objects on the earth's surface by measuring lines and angles and applying the principles of mathematics or photogrammetry;
    6. Providing geodetic surveying which includes surveying for determination of the size and shape of the earth both horizontally and vertically and the precise positioning of points on the earth utilizing angular and linear measurements through spatially oriented spherical geometry; and
    7. Creating, preparing, or modifying electronic or computerized data, including land information systems and geographic information systems relative to the performance of the practice of land surveying.
