The burden of proof should be higher. It encourages bull shot law suits. There should have to be some proof before you can even bring a lawsuit. And punishment if it’s proven bull shit and the defendant had to pay to defend themselves

The burden of proof standard being talked about applies to jurors deciding on the evidence that is being provided to them in a civil case. Besides arbitration, many civil suits are resolved through mediation and bench trials and not trial by jury. Many are thrown out before anything can happen at all because of the issues you mentioned and other factors. Of those that are accepted my understanding is that civil trials by jury are relatively rare, making up less than 5% of cases.
If you ever find yourself in a civil jury trial as a juror you will likely be relieved that the standard is so much less. They are often very, very grey in nature and, “slam dunk” cases are the rare exception.

It depends on the case and courtroom. Testimony taken under oath can be used for impeachment.

You can take two routes on this. (1) Trespass to Land and maybe (2) Negligence. If I were you, I would contact the injured person and try to get them to sue your neighbor for negligence.
Get an attorney and work with the injured person's attorney to work out a deal by which you get the plaintiff to sue your neighbor instead of you. However, if the plaintiff refuses, invoke contributory negligence as an affirmative defense. If your jusrisdiction bars recovery where contributory negligence is present, then you may be exempted from liability.

Might want to clarify what witnesses you hire. I'm going to go out on a limb and say you're talking about Expert whiteness. I'm pretty sure you can't hire people who can do the job better than the actual witness but I don't know, you know how the legal system is.
