The burden of proof standard being talked about applies to jurors deciding on the evidence that is being provided to them in a civil case. Of those that are accepted my understanding is that civil trials by jury are relatively rare, making up less than 5% of cases. If you ever find yourself in a civil jury trial as a juror you will likely be relieved that the standard is so much less. They are often very, very grey in nature and, “slam dunk” cases are the rare exception.

However, if the plaintiff refuses, invoke contributory negligence as an affirmative defense. If your jusrisdiction bars recovery where contributory negligence is present, then you may be exempted from liability.

It depends on the case and courtroom. Testimony taken under oath can be used for impeachment.
