In 2004 to 2010 All trespassers were recruited -- people with out any knowledge on coding got H1 B in 2000 to2004 .. Husband gave experience certificate to Wife and got her job is USA. Ladies use to come to India for delivery -- Now exactly opposite happening -- every couple will invariably deliver their baby in USA ( so that baby becomes Citizen of USA) .. Easy money from 1995 onwards killed entire culture of decent living -- cost inflation from 2000 to 2022 is more than 15 times -- An acre of land sold in 2003 for Rs 12 lakhs 4 KM behind Meenakshi mall today for SFT it is 7000 ( 30 crores per acre of land ) -- All happened due to easy money IT people earned and they pumped into real estate .. Today clock has turned oen full circle

Please save money as much as you can. Do not buy fancy gadgets like the latest mobile or car/bike. Don't rush for silly vacations with selfish pals or relatives - they will vanish as soon as you get into trouble. Do not care what your relatives say or think about you. Kick them out asap. Stop your parents if they ask you to marry - even if they mean well. This is for both girls and boys. Marry only when you have 2 YEARS worth of money saved for emergency funds. Go for health insurance ( from Govt. firms ) as soon as you start your job.

I was in a IT company and went through similar push out when I questioned the MNC Management's ethics in allowing credit-stealing (by a top Management guy to justify his salary) of a path-breaking IP *(originated solo by me)* which is now fetching millions of dollars of revenue to the company. I have triggered a public grievance with the PM's Office (which is now under radar of Health Ministry) seeking Acts that impose effective reforms in HR services of such MNCs to safeguard the mental sanity of our much exploited Indian IT employees.

Which is why I immigrated to Canada as a Permanent Resident. I too worked in Chennai, India, and I was sacked by a project and I had to be in bench for nearly 6 weeks to get to a project just in time before I would be fired from my organization (starting with W end with O).
I then realized that our nation's market is going to be like this for IT, Banking/Finance/Automobile/Logistics/Supply Chain/HR/Management, and many other common professions which most of us educated people are part of. Hence prepared for IELTS, did other processes for Canada Permanent Residency
Landed here and I got a L1 job which is way low skilled compared to what I was doing in India but still able to get paid more than even my Senior Delivery Manager used to get in Chennai, India.

Why so afraid of criticism!? Afraid I may be right?
No industry, government, company can do anything about hard working children or their parents if their work and output has no commercial usable value.
Engineers are still being hired at a rapid rate while many lose their jobs at the same time. And many are being rehired. Why is that?
Companies are pivoting to different industries, markets and technologies just to survive. If the talent doesn't follow suit and adapt, then it will be wiped out. Forget industry, this is how nature works.
Now whose fault is it that we are mostly putting out young engineers capable of only clerical coding and not situation-specific development?
      Should we blame:
      the young engineers?
Or the industry that is trying to survive and keep going?
Or parents and colleges that glorify engineering only as a game of scoring marks with no critical thinking associated.
Because I am sure you know that industry is still paying top money for skills that they need and are in demand.
If we haven't prepared the kids to understand that and act accordingly, then whose fault is that?
How can any parent protect ill-prepared children for the rest of their lives?
What value is such hard work and heartburn if you have not prepared the young ones for how brutal this world can be?
Now, in my opinion the glorification of the engineering vocation by itself and not the knowledge is why we find ourselves in this position today. So instead of producing just generic "engineer" clones, how about skilled and well-rounded individuals who can adapt and thrive, who will have the wherewithal to survive in this current economy, where plenty of opportunities still exist.
      Rant over, peace out!

Labour Commissioner has no authority to decide if a employee is a workman or not. Its a disputed question of law & facts. Its a duty of a Labour court to decide on the said issue & declare if it has Jurisdiction to adjudicate the case before it or not.

Why would an organisation do away with its resources?
    1. Because they don't have enough projects to leverage these resources.
    2. The resources may not be adding value during that state of buisness.
    3. There may be disciplinary issues.
    4. There may be personal issues with people managers / supervisors.
As a resource people should understand that once an organisation has decided to move you out for any of the above reasons, your long term survival in that organisation is not viable.
An organisation at best can be empathetic about it and probably give a decent notice period and a severance package.
Does an employee think so much about an organisation when they move for better opportunities ? In today's world it's okay to be laid off in two to three jobs, no one would judge you because you were laid off from some company. Even Steve job got laid off from Apple.
So if you are laid of any of the above 1,2, reasons fact is that much cannot be done. If it's 3 and 4 it needs to be handled well according to the situation.
Our regulations also need to come up with modern thoughts like allowing moonlighting, standards for gig economy, work from home etc.
There is no point in trying to form unions and taking action against the company etc as a collective. One will only end up creating a combative image which may hamper future business opportunities. Imagine what would have happened if retail shop workers created a union and created ruckus during lock down. What could the retail shop owner do ?
Software industry workers could at least work from home during that time.
Its time we Understand that all the jobs ( not only IT) in the world are volatile like this. If everyone started making collectives and taking action, progress is hindered.
What could employees do in such a situation, pause and do a self analysis, develop own skills and be more relevant to the organization. As long as you are resourceful with right attitude, you will find opportunities. Ups and downs are part and parcel of life and learning from that and moving on is the best option.

Information Technology (I.T.) Companies in India are *Parasites* They earn huge profits, but complain about infrastructure, lack of skilled manpower ....... They do not want to go rural areas and setup there , everything for them should be plug and play. On the other hand manufacturing companies have set up in rural and hinterland and have invested in infrastructure and providing employment to poor. In fact many colony /township set by manufacturing companies have become cities today like Jamshedpur, Bhilai, Rourkela, Dandeli.....I.T. companies are only profit minded, talk big on ethics ,CSR all show off.

In any industry there is an employment contract between the employer and employee which clearly states the terms of employment, including leaving the company, retrenchment, etc,.
Employers are obligated to provide a agreed upon severance package when letting go of an employee. That's it.
Similarly the employee can quit anytime by paying the penalty for not serving the notice period as agreed to in the employment contract.
Why do some employees still seem to believe they have a birth right to be provided employment under all circumstances?
Alternatively, why do employers seem to believe that they can hold back, hire and fire as they please?
Are all these professionals on all sides so dumb not to understand basic aspects of commercial contracts and market dynamics?

Unfortunately it looks like companies get away with this sort of blackmail in India due to lax enforcement of the laws. It is very difficult to dismiss an employee in the US for performance issues - a strict procedure needs to be followed including giving the employee a chance to improve performance. However it is relatively easy to layoff an employee - for financial or organizational reasons - a layoff does not stigmatize an employee in any way with other companies. Moreover in the US companies have a policy of not giving a recommendation to their past employees - other than confirming the dates of employment - to other companies. Your colleagues or supervisors may give a reference in their personal capacity - and no one will give a bad reference - they will just decline to be your reference. This is because the employee can sue the company or the referee for damages for a less than optimal recommendation.
