For the few of you concerned about whether or not I should be discussing my legal strategy: none of that was discussed in this video. Filing for dismissal has nothing to do with the plaintiff. My legal defense (should I be required to show up in court) will not be discussed externally for obvious reasons. However, I do intend to circle back and wrap up this topic once court proceedings, etc. have played out.
Why not ignore this man, if he is looking for attention you're giving him, In your position I would just ignore and deal with the legal side when it came to that.

Oh man, I used be an IT professional in Fort Wayne, and grace computers has quite the reputation around town. They're a ripoff scam company that gets recycled equipment from the local omnisource and screws old people who don't know anything about computers. There's a whole lot more if you'd like to know.

I reclaim pc stuff since 2009 and more i do it, more it make me sick to see how people, who's the same who want to be green, preserve the ressources, don't care 'bout sending to the shredder working reusables 1Tb hard drives (in both 2.5 & 3.5" formats) (i've arround 20Tb at all, ready to use). And since last january, every stuff i pick in my local disposal site is working (i don't even understand why they just don't try to give it free or, at least, resell it in specialized shops like Cash Converter (or just Ebay) ?)
But when you see they believe bullshit as "CEO like to firing workers and enslaving the lasting ones", nothing astonish you further...
The guy in IN sounds like a whack job. I was wondering if someone in that area did a little digging, if they'd find he's filed (or allegedly filed) suits before against other businesses and individuals for perceived slights against him.

Good way to get f'd as a business. Attacking a public speaking personality on a world wide format.
Additionally, there are unhinged people who follow just about everyone and if you criticize something, the fanboys can act in ways you would never intend or wish. People are weird. There is just no way to know everything about this area as it is always changing. You can delve toward boolean logic in one direction looking for how data can be transmitted on both rising and falling clock signals (DDR) or how CAS latencies are going to make a difference between single-ranked versus double ranked memory and time to do other stuff goes by. Greg is a smart guy who appreciates valid, useful critique because he learns from it and is better for it. Then you run into lazy grifters whose mental health isn't good enough to have sufficient impulse control to be in business. Again, don't know anything about the clown in question throwing lawsuit threats like darts at a dartboard.

Nope, not gonna happen. Indiana Small Claims court manual explicitly states that if you do hire a lawyer, you won't get the fees paid for, even if you win. And he doesn't need a lawyer to dismantle a sham of a lawsuit anyway. Just wasting money.
Robert Harvilla I may be wrong, but I believe that only applies to the plaintiff. It states that the only way you would get lawyer fees paid for is if you can prove it is the defendants liability to pay them.
You can’t really “sue” for attorney fees per se...You can either have the complaint dismissed with prejudice, and you have to ask for attorney fees to be paid by the plaintiff, or you can go through the court proceedings and if found that no harm was done, you can ask the judge for relief as in payment of all fees.
I was sued frivolously like this once. I called around to law firms, found the most expensive lawyer I could with the clear understanding that when we win he will be suing the guy for court and lawyers fees. My lawyer had him in and out of court for 6 months and by the end that prick was in debt almost 50k. I kept track of him afterwards, I'd tell you how he ended up and how happy that made me but you'd definitely think considerably less of me.

He sued me for 500k for "pain and suffering" as well as "loss of wages".
My lawyers proved that 1: The sidewalk was the towns property, not my own, as in my town X feet from the center of the road is public property, and my sidewalk fell within that. 2: The doctor this asshole went to was his golfing buddy. 3: He had a history of frivolous lawsuits that he drops if the other party isn't willing to settle out of court. 4: He never lost a single day of work.

That disclaimer he put at the bottom of his email is a Hipaa Notice. Hipaa basically protects patients with their information in the medical field. I know this solely due to the fact that I work with hipaa daily

The notice itself does not mean anything, it is only there to notify a potential accidental recipient that the information within is confidential. So if you just toss it in with something that isn't confidential by law it doesn't make any sense.
Imagine you were to get an email with confidential info, you might take a screenshot and post it to twitter with a caption sayin "lol the government sent me someone's mail #analsex". You would be prosecuted.
However, if you got a similar email with the disclaimer at the bottom you would know immediately not to do that. The disclaimer is basically a service.
Hire a lawyer and for the frivolous nature of the complaint, compensation for your trouble, he'll have to pay your lawyer's fees.

Has anyone considered that the computer seller might NOT ACTUALLY BE the business mentioned in the craigslist ad? Could this be a price gouger trying to profit off the reputation of a legit business by doing a "white van in the parking lot out back" deception?
Small claims court is for amounts under $5,000.00 (maybe It's $6k or even $10k now? ) idk but I am definitely from Indiana. It's usually about car accident damage, loans between individuals, bad checks, and landlord / tenant stuff. Judge Judy would have a field day with this one. Until you get a summons registered mail consider an e-mail attachment a photoshop creation.

I applaud you for making a teachable moment for your audience out of this ridiculous yet stressful situation.
So a quick recap, he violated Craigslist rules by posting his business's inventory as a personal ad, got exposed, couldn't handle the criticism so tried to change his listing (the 16-minute video he did) to claim it came with more than was previously listed, and continues to harass you? If a lawsuit does happen counter sue for harassment and attorney fees and ask for a restraining order because going to another state to continue the harassment is definitely a red flag and may put you at risk.
The thing is - people like Dustin are likely broke AF and not worth a counter suit. It is just a money pit - but on top of that Dustin does not have the money to sue in the first place. He likely does not even have the money to pay a processor to serve the notice. He probably got away with a similar threat in the past, maybe had some bad parents that pulled stuff like that and thinks it actually works on people with real money. He just got his ass handed to him so hopefully he crawls back into his hole of debt and learns something from this experience before he gets himself into real trouble.
@@madspaz77098 I understand what you are saying, and are probably right. But a counter-suit may be necessary for Science Studio (forgot his name at the moment) in order to recoup any losses such as attorney and court fees, even loss wages if he has another day job. The suit would also let Dustin know, if he loses his case, that he cannot just go around wrongfully suing people. It will also protect SS if Dustin files for court fees and legal fees which can happen even if the judge rules Dustin won but the actual damages are $1 (which has happened in the past).
Just the main thing is Science Studio needs every option to protect himself and his brand.

This isn't the case, as the channel is the business, and the reference to LMG is that it's a production business making UA-cam videos. It has nothing to do with drama or being a "real businessman". Linus has responded to drama in the past, but the videos are more vague. Greg, Kyle, and even Jay have made direct responses to stuff like this

Here’s what I learned from my college Business Law class in regards to this situation ..
1. Small claims - Don’t bother getting a lawyer (judge is there to hear your stories)
Also based on my understanding, Craigslist would be considered a “public space” and he willing made his info public when posting that ad.
When you beat him, sue him back for slander and defamation.
Go to judge judy or something.....
Slander and defamation are pretty much impossible to sue for.
Its almost impossable to sue for slander and deformation and any youtuber is default consider a public person making that bar harder now due g for cost of your defence and wasted revenue while dealing with it that could be done

This is what I was originally thinking, but I think based on how personal he's trying to make this issue it's likely a failing business owner who's hit rock bottom professionally and has finally found a way to "get back" at those he believes wronged him.. i.e. UA-camrs exposing his bad business practices
The guy who sued H3H3 lost his case and it was very similar, in the slander sense. I'm from Indiana, not a lawyer but someone who studied law in spare time, and I know that Indiana DOES have laws against online harassment and bullying that would allow for him to press criminal charges, even if you are from a different state. From what I have seen you have not done anything that constitutes harassment or anything illegal. Another thing is that if he sends any harmful messages YOU can have him charged criminally under Indiana law. The law is this: Ind Code Ann. 35-45-2-2. If he sends any harmful messages to you while within the border of Indiana he is breaking this law. He also must know that in a civil suit you don't need a lawyer. He also cannot include sales tax in a civil suit as it isn't the direct value of the item. You shared no information that he didn't make public himself.
I would be careful with videos, however. If he does decide to hire a good lawyer they can VERY easily warp what you are saying to create implications about the meaning and intent of your past statements to further their arguments. Something like situational evidence, it's hit or miss. But the hit chance is still there
People from Indiana are petty, including myself. This guy will likely continue until he himself commits harassment or some other crime. All you simply need to do it make a VERY CLEAR statement to him that you no longer wish to have any contact with him and that any further contact will be considered harassment. Once you request it and if he continues he would meet the minimum for harassment in most states.

He already said he would get one if it was needed, at this point it's not. Right now the lawsuit is filed in the wrong state so why hire a lawyer to handle it? An LLC *must* have a lawyer. The LLC is a separate legal entity from the members, so unless a member is also a licensed attorney, no member can represent the LLC in court. That would be practicing law without a license. A member can represent the member but NOT the LLC, even a single member LLC. There are two defendants here.
