- In today's van life video I want to talk to you about an incident that occurred recently with a Police officer. He pulled me over in my Ducato camper, and the result wasn't a good one! My licence is now in jeopardy.
Other than that. In this video I was on the way to Essex, and found a random place to stop over for the night! I also cooked a pizza in the air fryer and made my morning coffee with a borrowed cup! (Thanks starbucks)

My advice? Take it to court, Black Belt Barrister recently said it is not illegal to touch or use a mobile phone if it is in a cradle, he even cites the specific legislation that covers it, basically the law states if you are holding the device while using it, that is illegal, othwise if it is fixed or held in place, you can touch the screen to use it - every copper in the country has been told it is illegal to touch your phone while ini the driver seat and this is wrong otherwise every Tesla driver in the country is driving illegally (and any other car with a touch screen display in it).
So my defence would be I was not using the phone, however it was secured in a cradle which means it’s not classed as a handheld device anyway and quote the legislation that states this, and let them prove otherwise.
If I was in your position I would take it to court, but that’s because if I got done for that offence I’d be out of a job, we have cradles in our busses, but I don’t use mine and took it out and put the phone down the side of the door for the very reason you’re now in this problem (because I looked from the outside and it wasn’t clear if I was touching the phone or not).

I've got some bad news for you, physical evidence (video or Bodycam) regarding the use of a hand held electronic device (Mobile Phone) is not required for a successful prosecution, it's an urban myth. The word of the Police Officer is taken for gospel......been there done it.
Yes, however lots of video evidence in Adz youtube videos that predate the stop showing clearly that he keeps his phone in a cradle whilst driving would cast some doubt over the police officers believed observation@@kevinsmith2994

Microwave ovens. A few years ago I stopped boiling water in a kettle for my coffee. I don't need to kill germs etc, it's just a waste of power. I just give my mug 2 minutes and that's it and I only heat the water that I use. It must save a lot of power. My mother fills a kettle and brings the whole thing to the boil for a cup of tea.@@Adz
Pants is plural, becasue the word comes from the word pantaloons Pantaloons were tight leg coverings worn by men hundreds of years ago, which you have probably seen men in Shakespear plays or pirates wearing these garments. Pantaloons were actually two seperate items of clothing. You would need to put on each leg peice seperately then you would wrap of tie these two leg coverings at the waist. Later on pantaloons evolved into a single garment that we see in modern trousers, however they were still referred to by the plural. This is why we call them pants instead of pant.

I remember having an argument with a biker coo saying I’d gone through a red light …. Not so at all! I approached in the torrential rAin, it turned to amber right in front of me but it was safer to proceed than break hard…. He was a reet knobber!!!

Old Bill told me he could clearly see that i was using my mobile and started writing the fine.
Thought i was screwed but then i asked him to wait while i went online and pulled up my mobile usage and could prove on the spot I hadn't used the phone for just over an hour.

But anyway down to the serious part I am a criminal solicitor I know that sounds so drastic considering its a so called driving offense well that's what the policeman says but to be honest I have been watching you a long time now and I know u wouldn't have been on the phone mate, but saying that I am willing to help you and deal with this for you free of charge and to be honest you won't get the 6 points and you won't even get a fine either because unless they have it set in stone and the video evidence clearly See's your hand on that phone while your driving the only thing you Will get is an apology and then you can either say that's the end of the matter or you can get some sort of compensation for being victimized, as I said I am here to help you if needed and of course free of charge. There are solicitors you can pay that can win the case. I paid about £800 for them to win the case. They had no evidence that I was on my phone..

Strange as it may seem, that purple sun and grey skies was due to wildfires in Americaland, smokey stuff was carried high above the Atlantic by storm Agnes and made tingletime with atmospheric unicorns to produce this rate phenomenon.

Going to court means you need a solicitor, loads a money. If you get your phone data and it shows no activity during the pull send that straight away. Also if you did speed awareness then you should have zero points. If you get the six you still have another six to play with.
He said he got the 3 points for a 56mph average speed in 50mph zone, the previous year was a speed camera snap and that’s where he went on the course so 6points here will see him on 9. Hopefully I got that the right way round and let’s see what PC plods camera footage shows. It may be the case mysteriously gets dropped 🤞
He mentioned that he got 3 points after the speed awareness course shortly after getting the van.
Just remembered that my bad, but still need to avoid court. Fingers crossed it all works out.
@@nealbedford2904 no you don’t, take it to court, it’ll be magistrates you don’t need a solicitor there you can represent yourself. Also judges don’t like it when Police waste their time and I would use the full account of the stop to prove the copper is an idiot, ask him how many times he entered the number plate incorrectly into the computer before getting it right, then suggest that if he can’t read a number plate correctly when standing a few feet away how could he see that you were on your phone from several hundred feet away…. That in itself should be enough to establish reasonable doubt. Courts are only scary if you don’t prepare or go in with a chip on your shoulder, half the time the judge will help you too if representing yourself lol.
It’s a shame you didn’t argue the middle speeding fine as it’s not set in stone but you can argue a 10% +2mph. Now this can be a slight difference in tyres fitted at some point which could make you speedo read incorrectly.
Well with no evidence as you were not doing it. They can’t do anything. 🤞🏻 they see sense and drop it.

Quality, i was in the sainsbury carpark on sunday , homebase there is so funny, bought some bathroom shelves and then asked the guy what kitchen shelves do you sell, he said... ive never heard of kitchen shelves!! 😮
you need to be told a time you are suspected to have been on your phone and the time logged. Then any allegation can be disproved via the phones internal logs(as smart phones keep a log of when and where any apps or keys were used and can be accessed by a tech), and presented as evidence in court. Innocent until proven guilty doesn't seem to be a thing anymore, a policemans word can carry enough weight when backed by a magistrate court judge to land you in hot water on his assumptions.

You need to be careful in those places. Even small places often have ANPR cameras and time limits. I broke down in the summer and worried my wait for the recovery truck would result in a parking charge.
Also need be careful if you enter and leave the same ANPR car park in the same day as they generally count the first visit of the first visit and the last visit of the last journey which is naughty!!

Similar experience with phone...if you can move it to the centre...two reasons..if the window is open it could bounce out..and also no errors of judgement can be made

Can you touch your phone in a cradle UK?
If your phone is attached to your car's windscreen, dashboard or air vent, using a phone cradle, you're not contravening any rules. Indeed, you're doing the sensible thing, especially if you need to use your phone for navigation. However, you are not allowed to touch your phone for any reason.
Using hands-free equipment is also likely to distract your attention from the road, which could leave you open to a charge of careless driving. To stay safe, we'd recommend always pulling over in a safe place before attempting to program or otherwise manipulate your smartphone or sat nav device.

It’s illegal to hold and use a phone, sat nav, tablet, or any device that can send or receive data, while driving or riding a motorcycle.

You’ll also lose your licence if you passed your driving test in the last 2 years.
You can get 3 penalty points if you do not have a full view of the road and traffic ahead or proper control of the vehicle.

Re speeding. Just remember your speed in a van is 30 in a residential area 50 on single rd, 60 on duel cartiageway and 70 on motorway unless otherwise indicated. It is not the same as a car

In our society the onus is supposed to be on police to prove you guilty of a crime but with traffic offenses we have apparently okayed it so that we have to prove ourselves innocent. That is not supposed to be how a fee country works. Take it to court mate. The only thing you deserve to be found guilty of is making a baked bean pizza. WTF is wrong with you?
Speeding causes no loss, harm or injury to a third party. A victimless crime and before you say it, doing 31 in a 30 doesn't guarantee you're going to kill someone and there is a separate charge for manslaughter.
I’m not sure if you are aware of this or not, but, you are legally allowed to touch the screen of your phone “when it is in a phone holder and if you are for example using the sat nav function”. So I’m sure that’s what you were doing. If you have the phone in your hand then your screwed.

Good luck with the law mate. You should be given the benefit of doubt given how that phone is situated. More importantly than losing the license, you redeemed yourself with that pizza. Pants/trousers is right for the complete thing, but you can use pant or trouser when talking about indevidual parts.. "I cut a trouser leg off today out of curiosity".. "I farted so hard i busted the elastic in one of the pant leg holes" You get a trouser pocket, not a trousers pocket.
When talking about window coverings, it depends if you are talking single or multiple, "Draw the blinds mate" or " Can you close that blind, its too bright in here" You can have venitian blinds (but that is referencing them in the plural so it needs the s on the end) So those just use the standard single or plural rule

A lot of plod are getting it wrong, the law was revised recently but having read it and the BLACKBELT BARRISTER has done video, the law still says HAND HELD MOBILE DEVICE, there is a lot of talk about using a phone in holder cradle, is now illegal but its not as far as I can see or the barrister above!
I was on duty with police on operation the other week and there was a lot of confusion over the handheld vs cradle and many unsure what was illegal!
Problem is the court will often take the officers statement as gospel! I am ex job myself and now work with the ambulance service as well, seen plenty of coppers in police cars using their phones!

He didn’t ask to look at the phone. But yeah they can get the phone records if they want to see for themselves
Problem is, the police ae corrupt and being innocent is no guarantee of justice.
Thing is with these modern phones is that you could be using them for stuff other than calls, so proof that you weren’t making a call is not sufficient. He might have been playing snake or if he has one of those new fangled ones with a camera, he might have been auditing suspicious police vehicles crawling around industrial estates. Hopefully he can prove that he wasn’t using the phone illegally, as otherwise might become a he said she said with weighting towards the government official.
In a worse case scenario. Can you get a foreign licence, French etc and have full points on that? I'm in Oz and it's an island, so it's not an option here.

you need more cameras lol. on my van i had a 4 cam cctv running 24/7 and it made a great dash cam showing all 4 sides while driving as well as parked up but i keep meaning to get a dash cam to point at me, years ago you were innocent till proven guilty but these days you have to prove you are innocent. it sucks. go on line and select lowest price first and grab a dash cam just to record you while driving. it may get you out of future sticky moments.

I would never use a electric blanket because of safety issues but mostly because how it affects your health on long term ..
That’s why I’d never use a 12v one. They catch fire a lot. I use a proper one from a reputable brand, and it has an overnight setting and safety features unlike others that aren’t supposed to be left on. And there’s no health worries that’s a myth

Sorry to hear about the mobile phone saga. Insist that it goes to court before paying the fine as the court will insist that there is evidence beyond reasonable doubt before they can convict. If its just the officers word against yours that you were using your phone then the case will get rejected. Stand your ground on this and hopefully all will be OK.

Defo take it to court I've been in similar situation with my livelihood a stake ,,had the good luck to speak to a professional legal who said small chance police will go to court as they will have to appoint a barrister / QC to prosecute which of course is expensive and not up to the pc who instigated the case..sure enough they notified me they would not be taking further action. Note check said industrial estate is indeed a public road and not a private road as some industrial estates are not public roads,,,,,
There are specialists lawyers to solves these problems but it costs
iv only been driving almost 1 year but have a speed limiter in my car to keep me correct
if a policeman said this to me, i would had got my phone and gone to the call list in recent calls and show him. then if he still wasn`t having it. i would get a bill from the phone company and take it to the court match the time i was stop to prove my point that no calls was made or taking from the time he said. but you can use hands free, plus i would put a dash cam inside the van on you. I`ve done the same it can help (or not if you do something wrong and you get caught)

I've been done twice in the last year when they changed a local road to 20mph,and apparently tens of thousands also got caught since
