- This is an automatic shot my brothers and I found on Double Dribble for the NES back in the 80's when it was released. I know most gamers are already aware of this, but as long as you release at the right point it is automatic. The half court shot i took at the end goes in 80% of the time, but i didn't want to keep recording....HAHA

This footage of my playing was used in an episode of Family Guy that aired on Sunday May 14, 2016 without my knowledge or consent. I was subsequently hit with a copyright claim and the video was taken down by UA-cam's Content ID system. After a few days the story broke across the internet and the video was restored on May 20th, 2016 without any of my doing thanks to FOX. All that i wanted was my own video back!
I have to say it is pretty exciting to make the front page of pretty much any tech news site and video game site! Namely Gamespot, Neogaf, Game Informer, Kotaku and so many more. The Internet riot by the gaming community and support was pretty awesome! I was also covered by a lot of popular UA-cam gaming channels which is very cool to see since I watched and was fans of most of them already.
Thank you to any party/person involved that help get this resolved and thank you Family Guy for the exposure of such a small video!
I also want to thank Seth McFarlane for tweeting about the issue and looking into it!.

Well, after much confusion and internet buzz around the web it seems i got my video back without even doing anything. I really appreciate that because is all i wanted was my video ... nothing more. And thanks to Seth McFarlane for tweeting that he was going to look in to it!

Dude, take advantage of this. They used your content without your information. Then they proceeded to CLAIM it as their own. You can make serious dough off of this.
Good luck trying to claim damages on a piece of derivative work. The only potential avenue here hinges on if the channel is monetized. Then you could sue Google (not Fox) for the $1.50 in ad revenue lost while the video was blocked by their bot. This isn't the first time it's accidentally flagged something as infringement.

However, even if it was Fox, there's no case here. Unless the channel owner owns the rights to the game itself, there's no real recourse, aside from reporting Fox for filing fraudulent DMCA notices (if it does happen to be their doing). At any rate, the point here is that bringing a civil lawsuit against anyone over this would be a frivolous case and a waste of our judicial system's time. This is a case with, at best, 4 figures worth of punitive damages, and that's not going to cover the court costs. This is more of a matter for a regulatory agency to be involved in. All the hyperbole in this comments section is one of the major reasons our court system is as broken as it is. You're not meant to get rich over a screw up this minor.

Trying to collect punitive damages on fair use content would be an exercise in futility. As far as your analogy goes...just no. You generally create your own intellectual property using a tool such as MS Paint. So long as you own a copy of the tool legally, anything you create in there is original content.

I remember 9th grade in 89, skippin school playing this it was hilarious the sound effects when the ball was passed I laughed histericly. My brother lived on the east side of Madison, I laughed histericly at it and the music stayed in my head. it brings back memories not thought of in two decades.
Also regarding the the copyright claim from Fox I'm pretty sure this is how it happened. So fox didn't actually seek out your video and put a claim on it and it was all automated.
How Content ID works is it can detect audio and video. What Fox and other networks that choose to with their TV shows is they upload the full length TV show to UA-cams Content ID server so that if someone tires to upload a TV show to UA-cam it will scan what's in the server to see if it matches anything on the Content ID server.
Then in this case they uploaded the family Guy episode to the content ID server and since they used your clip in the episode that was also part of what was uploaded to the content ID server. Then when it scanned youtube your video matched the audio and video of what was on the family Guy episode causing a Content ID claim on your video. This also works the same way for music uploaded to UA-cam too if it matches what's on the Content ID server it will create a claim. TV stations can also detect their watermarks in videos too.
Okay fine, but why in the world would they use someone else's content commercially without contacting them first? Do they have zero understanding on how copyright works? 4 years later and this still blows my mind how fox thinks it is above the law

@@BluecoreG Technically it’s not copyright. The only thing FOX/Family Guy used was the game footage (which isn’t owned by the uploaded, but rather Nintendo/Konami). They added their own audio, making it fair use.

This brings back memories. I used to get over 200 on 5 minutes on the hardest level hitting half court 3 pointers over and over. The trick is to stand on the bottom wood board and have the ball shadow perfectly to the right of the half court line and jump to maximum height and then let go. I used to give people 100 point handicaps and still beat them.

I'd argue Fox or Family Guy producers owe you some money. I don't think what they did qualifies as Fair Use at all since they used most of the clip and it was used in a for profit basis. Nice to see Fox getting caught infringing your copyright.
+Alfonso Sintjago -- technically Nintendo/Konami owns the copyright. The guy who made this video is showing their game. He doesn't own anything except any talking done over the top of the video, which Family Guy stripped out and put their own in.
So, if anyone has a case, Konami does against Fox. But, I am sure Fox covered their bases by getting permission from Komami before-hand.
Fox was 100% in the right to "steal" this content if they had permission from the original owners: Konami or Nintendo.

I think he has a better fair use argument than Fox. he is criticizing and analyzing the game while Fox just ripped him off. it's not just talking over but also him playing. removing the sound shouldn't be enough to say it isn't his creative content derivative from Konami's and Nintendo's copyright. granted he did not ask Konami for permission but removing the sound should not be enough as long as it shows him playing.
"Playing ability" isn't copyrightable. Fox may have done something shady, but they are 100% in the right if they had proper permission from Nintendo. Like I said: this content belongs to them. Nintendo can send a takedown notice to YT and have this video removed and they would be 100% in the right as well. They own it the content. This guy doesn't have a case whatsoever. It'd get thrown out if he tried.

He can't monetize something he doesn't own. There's not even any commentary-just raw gameplay.
Not an expert, but I am pretty sure Fox can use his footage and use their supplied commentary (corner 3!) and it is fair use. Same way those POS bad lip reading videos are allowed. Same way those videos with the movie audio switched with video game audio is allowed. Fair use goes both ways.
I used to shoot from the bottom left side where the 3 point line start to arc. Also could you not dunk from the 3 point line at the top?
