- The state of California has issued a red flag order against a man who does not reside in California. He hasn't even visited the state in a significantly long time. However, the order was approved by a judge and the man "from Texas" was served. How is this possible?

Maybe file one against Gavin Newson and his family, plus any PO who protect him. As he shown how dangerous he is, in my personal view.

It’s the FBI enforcing it. NICS is the background check to sell someone a firearm. This means you will not be able to purchase one. If you have a concealed carry license or FFL it may affect that but they do not have the ability to get what you own confiscated.
simple solution is to treat cali drivers license as a invalid license outside of cali

The state leadership chose to ignore Prop. 8 voted on by a majority of the people of California. They just got the State Supreme Court to rule against a Proposition that was suppose to be on the Ballot to reverse recent Sales and Gas Tax increases. This Proposition had more than enough Petition signatures to be on the Ballot but Supreme Court didn't like the way it was written....yet they want to "Save Democracy!"..lying POS.

Here in illinois, Red flag law says to hold a secret court against targeted person. And that the person who files the complaint will be held secret from the targeted person. You cant even sue them for harassment

Registry implies you line up and register your guns. Stealing and gathering the data by other means is legal.
Its like we are living in a dystopian society. If you traveled back to the 1940s and told someone that the government will register all guns install cameras everywhere, and track your every move with a cellphone. They would say are you talking about Germany.
Red Flag concept might look like a good idea to some people, but I believe it will only make people resist talking to anyone about their mental health troubles. Shutting people up due to fear causes further isolation.

@marvintuomala9724 When they confiscated them, they put them in the San Diego PD's gun room. I was given 180 days to get them out. But, the bureaucratic nonsense (filing paperwork, going to court, dealing the state DOJ took 174 days.) When I got the documents that released my firearms back into my possession, I was told by the SDPD that the state had removed them from SDPD's possession and destroyed them 3 weeks earlier.

If someone in California can file one against someone in a completely different state, then someone in a completely different state can file them against someone in California. Someone should look up Gov Newsome's security detail and file against them.
Wait a minute this person is in Texas. Can they take this to the fifth circuit. Needs to take something like this up to the Supreme Court don’t we?
This should as a state trying to enforce a red flag law on someone who legally lives in another state falls within federal jurisdiction and if that state does not have red flag laws that only thing that should be sent back to the state with the order is a video of the order being used as toilet paper.
They probably allow it under the national extradition laws.
I would say this is a problem with NICS more than anything else.
What would happen if someone filed a Red Flag against a police officer, or a chief of police, a politician, or someone on the 9th circuit etc... Maybe they would look at this more closely. Just a thought.

Criminals do not care about red flag laws, it won’t stop them getting a gun from the street. This hurts law abiding citizens who are screwed over by someone with a grudge.
Facts. Happened to a friend of mine who a Marine vet. He can't have possession of a weapon til 2027 because he had weapons in his trunk (in a locked bag, with ammo separate) on a college campus while he was couch surfing and living in hotels. He broke some girls heart and she got back at him worse. Poor guy.

Goa, FPC, the 2nd amendment foundation, VCDL, Gun owners of California, and other pro 2A organizations need to start lawsuits to fight these red flag laws.
This case might even be the perfect case for one of them since California courts wouldn't have jurisdiction and they could fight it in the 5th circuit. The Texas attorney General might even sign on to have Texas be an additional plaintiff.

Happened to me about 2-3 years ago living in Minnesota and a cousin filed a restraining order from California that led to the MN sheriffs co serve me the restraining order and being from California they said i had 24hrs to turn in my legal firearms. Got a lawyer, case thrown out after my cousin was a no show in court but it’s really happening!!! God Bless America

This can only be made possible by somebody who does not respect the second amendment. Somebody who does not understand the separation of powers at the federal level. Or somebody that understands that states have sovereignty. I have an uncle that dealt with a similar scenario. A very vindictive woman filed multiple ERPOs in different states. He had to clear each one. Nightmare.
After that 1st "incident" I'm sure they will realize that it's probably a bad idea.
Why cant someone get an official to propose several amendments to the law1- must be in calif 2- must go through the courts to legitimize the need for removal?

As horrifying as this is, it could help in a future SCOTUS case. They already touched on it in Rahimi that you have to be deemed violent by a court before you can be temporarily disarmed.
