  • A jury found armorer Hannah Gutierrez-Reed guilty of involuntary manslaughter and not guilty of evidence tampering in the fatal shooting of cinematographer Halyna Hutchins on the set of the film “Rust.” Hutchins was killed, and director Joel Souza injured, by what was thought to be a prop gun during an Oct. 21, 2021 rehearsal in New Mexico. NewsNation legal contributor Jesse Weber, "True Sunlight" podcast Liz Farrell and "To Catch a Predator" host Chris Hansen join "Dan Abrams Live" to discuss.

Alec refused to hire enough people with firearm experience. Alec knew accidental gun shots were happening on his set, and wrecklessly pressed forward until he killed his cinematographer.

Yes that is the law and noone else can relieve you of the legal duties that goes with it. That is why the government does not call them props even in stage use. If it is able to fire a round it is a gun. There are props of various materials the look real but lacks the means to fire any round. They even make blank only guns that have an only partly bored barrel and vents added at slight angles to permit gasses to pass for smoke. They often will have a stepped chamber to preven a real bullet from being introduced also. Still has some risk in the revolver styles fireing blanks as there is a gap that can cause the holder to be hurt with an improper grip resting past the cylinder.

Doesn’t take away from the fact that she loaded live rounds in the pistol. Regardless of who mixed the ammo on the cart, she was responsible to check each round. Doesn’t make Baldwin less guilty. He was also responsible to check each round. He also aimed the gun directly at the person behind the camera. Weapons are always aimed off target during filming and rehearsal. There are more people guilty than just the armorer.

She put a gun with a live round in the hands of an actor and told him "The Gun Is Cold." Period. Every actor has the 100% reasonable expectation that when an armorer puts a gun in your hand and tells you "the gun is cold" that it is. Now, sue Baldwin for negligence as a producer of the film? Sure. But involuntary manslaughter? Only an idiot would want to do that.

The safe handling of a firearm is not a "job" . It is an individual legal requirement set forth in state and federal law. Handling of a firearm with a willful disregard for the safety of others is considered criminal negligence. If a person dies due to that criminal negligence, then it is involuntary manslaughter.
There is LOTS of case law on this. After all, Baldwin isn't the first person unintentionally shooting someone. It happens about 500 times a year nationwide. The most uttered sentence after an unintentional shooting is: “I thought it was unloaded”. It never works in court.

The woman doesn't grasp the concept that more than one person can be culpable for the same crime. Just because Halls and Hannah G were convicted for their roles it doesn't absolve Baldwin from his responsibility in the tragedy. He was in possession of a deadly weapon. He knew it was a deadly weapon and failed to exercise due care and circumspection. He failed to personally verify that the firearm was safe by inspecting it. Secondly, he acted recklessly by pointing a firearm at another human being (a firearm that he knew was capable of lethal force and that he had not personally verified to be safe). Thirdly, he pulled the trigger. regardless of what Halls or Hannah G did, his responsibility existed discreetly, and he will be on trial for involuntary manslaughter with a very strong legal case against him. He won't be able to offload his responsibility for gun safety onto anyone else regardless of what they have been charged and convicted of. Special rules regaridng gun safety don't apply because you are on a movie set. One size fit's all.

Many reported they would do target practice between takes as well, if true that is troubling indeed. It is rare any live rounds should be used on any normal set but there are a couple exceptions.
Documentry or testing shows that film how guns and ammo perform, sometimes against various items. Some reenactments or range shoots in a limited way with a gun range condition. Also with reenactments actors often spend weeks to train before filming. TNT's Rough Riders had some good bts bits if interested. Also some civil war reenactors can give detail. Glory had a couple live shots I believe with the load faster bit as they show the whole loading process.

Alec Baldwin is not the only additional person that should face a trial - the others mentioned below should also be in the dock!
Only having just watched most of this trial, the evidence given by Seth Kenny seems that is has been over rehearsed with the Prosecutor beforehand!
It is twisted and confusing in order to baffle the jury!
The Defense didn’t intervene to insist that his gobbledegook be clarified for the benefit of them!
Why was Seth Kenny not fully investigated?
Why was Sarah Zachary given a deal by the Prosecutor?
Why was David Hall, the first assistant director and safety coordinator, allowed to get off with a 6 months weird charge after claiming that he was “negligent" and should have checked the firearm.
What actually qualified Hannah Gutierrez-Reed to be given the job of Armourer in the first place?
Who actually gave her the job of being an Armorer on the “Rust” set - how did they assess her capabilities and experience to do the job correctly?
What paperwork was signed and how was she paid and by whom?
If this was presented as evidence then it wasn’t apparent to me in what I was watching.
Hannah has more of an appearance of an adolescent teenager and not that of someone capable of being in control as is expected of an Armorer!
David Hall was the first assistant director and safety coordinator on the set of the movie “Rust” with Alec Baldwin. Hall took the stand to say he had no concerns regarding armorer Hannah Gutierrez and her performance on the job.
Someone supplied or brought live rounds onto the set but they can’t prove who that was.
Hannah has been found guilty of involuntary manslaughter.
Yes, she warrants blame but all of the others do so too!
She should not have been in the dock alone and to me this appears as a miscarriage of justice.
I did find it really strange that at one point whilst giving his evidence, Seth Kenny actually took out his mobile phone on the stand to “look at something” and no body intervened!

In the trial, the director clearly says he was only to pull the gun out sideways to figure out the scene, never to point it at the camera. That is going to bite Baldwin big time. It's frustrating to watch mainstream media not addressing past incidents and how Hollywood handled it.
This isn't the first time it happen.
One very famous case is the death of Brandon Lee in 1993.
He was killed by a prop gun that was used for blanks. The co-star was not charged and lives with guilt.
Another is John Hexum when he pointed a prop pistol to his head and the blank charge went off while waiting for action.
Another big accident involves The Twilight Zone movie.
Landis, Folsey, Wingo, production manager Allingham, and explosives specialist Paul Stewart were tried
and acquitted on charges of manslaughter in a nine-month trial in 1986 and 1987. They brought down a UH-1 Huey on Vic Morrow
and child actors Myca Dinh Le and Renee Shin-Yi Chen. The chopper blades...😢
History has shown that being in charge doesn't mean guilty like the CEO of a company after a workplace accident.
They can try Alex Baldwin but it will end in acquittal.
You have to prove beyond a reasonable doubt that Baldwin meant for a round to leave the chamber and it's not there.
How does he know there were live rounds in the weapon and yes some sets are on a tight schedule.
Yes, it's stressful like Tom Cruise blowup on Mission Impossible set.
Not a fan of Alec Baldwin but this was on the armorer using set props for live fire.
Why not just use different weapons and have a clear conscience...

    • @charliefoxtrot5001
      @charliefoxtrot5001 21 день тому +1

"You have to prove beyond a reasonable doubt that Baldwin meant for a round to leave the chamber and it's not there." -- BLATANTLY FALSE! c is charged with involuntary manslaughter, meaning he DIDN"T intended to kill someone. If he did, then he would haven been charged with murder.
The safe handling of a firearm is an individual legal requirement. Handling of a firearm with a willful disregard for the safety of others is considered criminal negligence. If a person dies due to that criminal negligence, then it is involuntary manslaughter.
I highly recommend that you study the NM jury instructions for manslaughter (NM 14-231). The key sentences are:
      - Alec Baldwin should have known of the danger involved by Alec Baldwin's actions.
      - Alec Baldwin acted with a willful disregard for the safety of others.
      - Alec Baldwin's act caused the death of Halyna Hutchins.
The first point is clear. Alec Baldwin testified that he knew that he was handling a real firearm and therefore was aware of the danger involved in pointing it at the victim, cocking the hammer and pulling the trigger. Alec Baldwin also testified that he had 3 decades of firearm training. He certainly should have known that there could be a live round in there and therefore should have checked it for himself, or simply not pointed the gun at the victim, cocked the hammer, and pulled the trigger. In fact, he is on video on the Rust set saying that.
The second point is clear by his testimony and by the evidence. He assumed that the firearm wasn't loaded, pointed it at the victim, cocked the hammer and pulled the trigger. By his own testimony, he wasn't sure that the gun was or wasn't loaded. Baldwin isn't the first person unintentionally shooting and killing someone. It happens about 500 times a year nationwide. The most uttered sentence after an unintentional shooting is: “I thought it was unloaded”. It never works in court.
The third point is clear by the evidence. He shot and killed the victim.
      Baldwin is toast!
