    The 16 year old would clearly prefer to live with the Father, but he is now sentenced to reside with his Mother against his preference for the duration of the trial. This mockup clearly leaves aside the relevant child support issue that arises with the orders, and child support is probably the real reason that the Mother seeks primary custody.

    A temporary order been seen to lay the ground for a permanent order defeats the purpose of it being temporary. It’s not suppose to be that way.

      As usual the Dads attorney wasn't on fire. Dropped the ball having had several opportunities to have had some objections on record or rebutted things he left open. Leaving the Dad not near enough to try justifying an appeal. And not one mentioning of or even any mention of the Dads possible Constitutionally protected Rights to equal parenting time. Same ole same ole. First mistake Dad did it was leaving it in the hands of an oral argument. I never won oral arguments but always won evidentiary hearings except for one when the judge blatantly ignored clear and convincing evidence. Just because father can't afford an appeal and get a trial court decision overturned doesn't mean the trial court did the right thing. So yea there's that.

    "A temporary order is just a temporary order" Ofc you´d say that, if it was a permanent order, the Court couldnt keep filling it´s pockets with the father´s money, disgusting.

      " joint legal custody is what they already agreed to" that is not the same as joint 50/50 physical custody which is why they appeared. I re watched it and no where did anyone say " 50/50" - that was why there was this hearing- but dad lost, naturally. As he should have. Hopefully dad can get his shyt together and adventually get 50/50 . But number one these kids need to be safe and comfortable. 16 yr old should have spoken or written a statement of his wishes.

    This is a joke, but it's defiantly more the rule than the exception in Utah. I know this is a mock hearing, but where's the fight, just let this happen without making any arguments in order to prepare for an appeal??? Pro-se would have gotten the same ruling, the father should get his attorney fees back to him. Any judge that rules like this is too ignorant in family matters to be sitting on the bench deciding what's best for the lives of other people.

      I’ve been a family law attorney for 40 years, and I have gotten fathers custody of their children. many, many times. It all depends on individual circumstances and facts. The notion that fathers always get screwed is a myth. Regarding child support, we all owe our children a duty of support. Which gender one is is irrelevant.

    My ex wife wants a temporary order and we don’t have any kids she won’t sign the papers and I asked for a uncontested divorce.

    This is what happens to men, it’s like we aren’t considered human. Just because during the course of a relationship, a men would tend to work late hours doesn’t necessarily mean he can’t rearrange that schedule if the need arises.
    I was in the same situation but the magistrate corrected my ex and said to her, when two people are together they help each other, if one parent works longer hours it’s still for the benefit of the entire family, but since you guys aren’t together anymore, he has shifted his schedule to accommodate the fact that he is going to have to play the role you did, and the same is true for you, you’ll have to provide for the children in areas where he was able to for yourself as well. And she burst out crying!

    “in the best interest of children” is actually “in the best interest of lawyers”

      Thank you for watching and commenting. I'm no fan of the way much of the family court proceedings are handled, but you're oversimplifying. There are plenty of greedy lawyers, but they are only part of the problems.

      Thanks for watching. Unlike other videos that give you a misleading idea of what happens in court, we staged this example such that we did not know what the "judge" in this video would decide. We both argued the case as if it were a real case, so that it would come across realistically.

    Though I get so frustrated seeing courts side constantly with moms. But holy smokes, he literally buried himself. The drinking, pornography, work schedule, i mean come on. Plus his body language when things are said negatively about him aren't good at all.

      yes, but mine was alot shorter. her lawyer caused me of abuse and said he had 6 witnesses to testify against me. which isn't true. after not seeing my kids for over a year I agreed to temp custody. I walked in they took my financial information wam bam out the door paying child support and seeing my kids the next weekend....its corrupt and needs to be abolished.....the courts prey upon female nature and take advantage.....I hope you women are happy for the society you are creating for your children. where have all the good men gone...ill tell you they're not be raised by single mothers!

      Well yes and no! Dad only deserved minimum parenting time. In fact with dad's serious charges of a dui he could been only awarded supervised visits. I think he made out like a bandit. I would have argued for only supervised visits IF the DUI was more recent than the 5 mos. If mom allowed visits while knowing he had a DUI she knowingly approved of his visits part time anyway.

    Too bad you can’t hear each person at the mics. It appears to be on a toggle switch. When the camera is on the Judge you can hear him. When the camera was on the attorneys, you could hear them. This is crazy.

    So if being available for the children matters, lower child support, so the dad doesn’t have to work and can instead be available for the child

      Child support is not paid to mom when dad has the kids in the Summer and extended stays per utah code..Everyone knows that. It's not about the money . Dad pays less to mom when he has them.

    Just a querey do Temp orders normally become permanent
    My ex wife got sectioned for mental health and social services took kids away and 1 of them if mine got a Interim order in September 2023 for 8 weeks
    November i got another interior order for him to live with me for 8 weeks ,Mother still unwell and can only have supervised contact
    Next hearing in January 2024

    Father's rights... time and time again... Are dismissed and not appreciated. In a separation like this I do not understand how even in a temporary case that both parents aren't given equal time.

      Not true. The father allowed this schedule for 5 months why would the judge change it? There are no witnesses no evidence of the mother being unfit or evidence that he was a caregiver or involved. The judge is going along with what they did in the first place for 5 months. During the temporary they both parents can prove who either is unfit or more involved.

      @@pamelapap a parent doesn't need to be deemed unfit to share 50/50 and have equal time with their children. In my eyes father's rights are dismissed frequently so my statement is not an untrue statement.

      Shjade Smith your eyes and reality are two very different things.
      In this case 50/50 was not possible because the parents apparently agreed to her having primary for 5 months why would the judge change that? The father’s lawyer gave no evidence as to give the judge an impression that should be changed. Not only did this schedule exist for 5 months but children are now accustom to it.
      Both parents need to be deemed fit to share 50/50.

      @@pamelapap I don't see where the father was deemed unfit. If the location and school doesn't change 50/50 is not an issue. Kids get abandoned for 6 plus months and that parent can still get 50/50. Those are the new laws being pushed throughout. You should look them up to be honest instead of using the word unfit constantly in an improper manner. Not sure why you are so upset about my view regardless. It is mine based off my experience and you will not change that.

      The judge in this example of a temporary orders hearing is actually a criminal law defense attorney who is very skilled at what he does. You'd be lucky to have him on your side, but I don't think he'd take offense to being called a nerd, just so you know.

    Does he have a driver's license?
    Can he drive the kids to school?
    Does he have a car?
    Was DUI once ..or more?
    What is his insurance like?
    DUI is pretty irresponsible. ....for other kids in the neighbourhood...as well...let alone for his kids. Plus the pornography??...we are talking about a person who is not entirely 'fit'.

      No evidence was presented to prove their allegation of pornography! Did his attorney object to those accusations? If not then that is unacceptable. So much for innocent until proven guilty or his attorney objecting on the basis it was hearsay. But whatever.

    Judge did correct. This judge don’t want the mother to be all alone by herself and the her boys will give her some type of protection. She brought these children into this world not the father the “man”. The time has come for women to stop being treated like man’s possession. Good judgment........

      I was thinking the same thing. It’s better safe than sorry on a temporary basis, then in a full hearing he can be ordered to not drive with kids or take a class or something and then given his 50%.
